About this file

This is a Q&A document related to an RFP for Paternity Genetic Testing Services for the State of Michigan's Office of Child Support (OCS) and child welfare system. The document contains 45 questions and answers covering various aspects of the contract requirements, including specimen collection services, testing procedures, reporting requirements, and technical specifications. The questions reveal that in FY18 there were 7,184 staff collections and 8,692 vendor collections, with major counties like Wayne having 4,926 specimens collected in 2018. The service requires collection capabilities across all Michigan counties, including correctional facilities, with three collectors currently serving the larger counties.

The document clarifies pricing requirements through Tables 1 and 2, with Table 1 covering pricing for counties not wanting full-time collectors and Table 2 for counties opting for full-time staff. Insurance requirements were adjusted to more standard industry levels: $2 million for cyber liability, $1 million per occurrence/$3 million aggregate for professional liability, and $5 million for umbrella coverage. The contract requires specimen storage for 10 years and a turnaround time of 7 business days for test results. A web portal must be maintained for authorized users to access case information, though several IT security requirements were questioned by bidders as potentially excessive for genetic testing services.

Q #Document and SectionPage #Bidder QuestionFinal Answer
1Schedule E1In regard to Table 1: Can the state confirm that Table 1 is only asking for pricing in the event that the counties do not want to exercise the option to have full time collectors in the counties listed?Yes. The State confirms that Table 1 is only asking for pricing in the event that the counties do not want to exercise the option to have full time collectors in the counties listed.
2Schedule E1In regard to Table 1: Can the state define the service scenario wherein the service provider would charge “draw fee price”? Under what conditions would the vendor provide such a service? This scenario may happen in rare circumstances. The State is requesting the vendor to provide a cost in case these services are needed.

3 Schedule E 1 In regard to Table 2: Can the state confirm that Table 2 is only asking for pricing in the event the state decides to exercise the option to have full time staff?

Will the three collectors be for all of the counties who choose to have the collection services? Yes. Table 2 is to identify additional costs in the event the state decides to exercise this option.

The 3 collectors were provided as a baseline. Currently there are 3 collectors that serve the need. This number may change depending on volume and need.

4 Proposal Instructions and Vendor Questions Worksheet section 2 2 Regarding the Table RFP Structure and Documentation we find a listing for Schedule D – Disaster Recovery Plan with guidance “Bidder to complete and submit by proposal deadline”.

Please provide a copy of the document or form for Schedule D – Disaster Recovery Plan. The Disaster Recovery Plan is a request that the State is requiring to be submitted by the bidder based on their current policy and procedure. There isn't a template, but should be something bidder creates and submits as "Schedule D - Disater Recover Plan".
5Statement of Work section Requirement #A.12Statement of Work section Requirements #A.1 states the following: Arrange for specimen collection services in all counties, and provide, at a minimum, annual training (or otherwise as requested) to OCS designated child support paternity establishment personnel to do self-collection where requested by OCS designated child support establishment staff, and child welfare caseworkers. The Contractor must schedule and arrange clinic schedules for the purpose of specimen collection. The Contractor must also provide staff or services for specimen collection outside the State of Michigan and in all types of prison and jail facilities.

Please provide the current schedule for each site that lists the address, hours of service required and the number of staff collects vs. vendors collects at each site for the past year. Please also provide information regarding collections at correctional facilities to include the address of the facility and the number of collections required for the past year. The State is unable to provide the number of staff collects vs. vendor collects for each site. The State is able to share that in FY18 total staff collects were 7184 and vendor collects were 8692.

Available list of county offices is within this excel document uder the tab "County Offices". Hours of operation are general office hours, but each office maintains their own specific office hours. The actual days and times the vendor collects at county offices is mutually agreed upon by the vendor and the county office.

The State is unable to provide a comprehensive list of correctional facilities and the number of collections from the past year.

6 Schedule E 2 This table lists the estimated annual collections per county but additional information will be required to provide pricing.

Can the state confirm how many staff collections and/or vendor collections and/or other types of collections (clinic or hospital) were performed last year at each location listed on this table? (Number of specimens specifically for each collection scenario). The State is unable to provide the number of staff collects vs. vendor collects for each site. The State is able to share that in FY18 total staff collects were 7184 and vendor collects were 8692.
7Statement of Work section Requirement #53Regarding the table listing specimen counts from 2015 to 2018.
Does the state have an explanation why the sample counts have dropped during this period of time?Michigan (and the US) birth rates in general have declined. This includes a decline in unmarried births. Therefore, resulting in fewer incidents of DNA paternity testing.
8Proposal Instructions, #7 Delivery of Proposal3In this item, you write "The bidder should submit all documents in a modifiable (native) format (examples include but are not limited to: Microsoft Word or Excel and Google Docs or Sheets). In addition to submitting documents in a modifiable format, the bidder may also submit copies of documents in PDF."
Are you looking to have the bidder submit the proposal electronically in both the native format (e.g. Microsoft Word) AND in PDF format, or is native format sufficient?Native is preferered, but will accept both.
9Proposal Instructions, #7 Delivery of Proposal3In which format (i.e. native or pdf) do you want the proposal emailed to RiggS@Michigan.gov?Native is preferered, but will accept both.
10Statement of Work section Requirement #74Please describe what the state envisions as “full-time”. For example does this mean staffing a site Monday through Friday of each week during normal business hours? Each county office maintains a mutually agreed schedule with the vendor. In general, county offices with larger volumes have vendor staff at the offices for two to three days in a month.
11Statement of Work section Requirement #74At the option of the State, bidder is required to provide staff as needed on a full-time basis for specimen collection services. The following counties currently have specimen collection services in the following locations: Wayne; Oakland; Macomb; Genesee; Washtenaw; and Kent and its surrounding counties. The following are the approximate number of specimens collected in a twelve-month period (January 1 – December 31, 2018) from some of Michigan’s larger counties: Wayne – 4,926; Oakland – 639; Macomb – 848; Genesee – 720; Washtenaw – 296; and Kent – 880.

How many of these collectors are currently full time in each of these counties?

How many hours are vendor collectors scheduled total for specimen collection services in each county?

How many sites are currently supplied by the vendor? Currently 3 vendor staff accommodate onsite collection for the stated counties. While specific schedules are not readily available, in general, county offices with larger volumes have vendor staff at the offices for two to three days in a month. The volumes of collection activity will dictate the number and frequency necessary.

12 Statement of Work section Requirement #8 4 This section states the following: Bidder must provide a report covering the last two state fiscal years (10/1/16-9/30/18) of the average response time for interstate tests and cases involving county jails and state or federal prisons and jail facilities.

What is meant by “response time”? Is that the amount of time the vendor needs to schedule the collection, or the time the vendor needs to collect the actual sample or the time required to report results? The response time is from the request for the collection speciman to the test results being provided. In addition, the time from the receipt of the final specimen to the test results being provided.

13Proposal Instructions, #16 Confidential Treatment5Regarding sub item 16.a.ii, in which format (native or PDF) do you want the Public Copy submitted? Please submit the Confidential Treatment Form in PDF format.
14Proposal Instructions, #16 Confidential Treatment5Regarding sub item 16.a.ii, does the Public Copy also need to be emailed? If so, in which format (native or PDF)?Yes. In PDF format.
15Statement of Work, #10 Postage Paid Specimen Drawing Kits5You state "Bidder must provide a specimen kit with their proposal." Since we are submitting an electronic proposal, would a photograph of the collection kit be sufficient?Yes, a photograph imbedded in a word or PDF document would be acceptable.
16Statement of Work #116Statement of Work #11 page 6 states - Bidder must describe their complete self-collection procedure from the point of providing the kit to the person doing the self-collection through the receipt of the samples into the laboratory for testing.
Are we correct in assuming that by self-collections the state means sample collected by agency staff at a child support office or other state facility?Yes
17Statement of Work section # 126Statement of Work section 12 states - Buccal Swabs/Blood Samples - Contractor must have the ability to perform Polymerase Chain Reaction (PCR) testing methods on DNA samples collected by either buccal swabs or blood draws and have the ability to perform Restriction Fragment Length Polymorphism testing when requested by the OCS designated child support paternity establishment personnel or the child welfare caseworkers, in conjunction with the Circuit Court. AABB standards have not included standards for RFLP testing since 2010.

We are not aware of sources for the reagents (chemicals) necessary to perform this technology; thus, making it impossible for labs to meet these requirement. RFLP is an antiquated technology that is no longer in use in relationship or forensic testing. We respectfully request the State remove the requirement for RFLP testing and sample exchange program from the RFLP. In the Statement of Work, page 6, #12, the State agrees to remove the requirement for RFLP testing when requested from the Statement of Work, page 6, #12. The State still requires that the bidder will provide their expertise on the current technology used while following the industry standards in the Bidder Response box.

18 Statement of Work, #12 Buccal Swabs/Blood Samples 6 In this item, you list the requirement for RFLP testing. The material to perform these tests are no longer available, and RFLP has been replaced with PCR as the industry standard. Could the State please remove the requirement for RFLP testing since it is impossible to perform? In the Statement of Work, page 6, #12, The State agrees to remove the requirement for RFLP testing when requested. We rely on the bidder to provide their expertise on the technology used, following the industry standards.

19Contract Terms, #18.4 Subcontracting8Are the independently contracted Specimen Collectors considered Subcontractors? Are collection sites i.e., hospitals, health deparments, or clinics also considered Subcontrators? These types of arrangements are routinely used in the industry. The laboratories have agreements with the entities to ensure compliance. Would the state need to provide written consent approval for each site/location? Collection sites and collectors are used throughout the US and internationally to provide collection services for Interstate and International case participants.Yes. Anyone performing any service under the awarded contract will be considered subcontractors. Please review Secton 18.4, page 8 of the Contract Terms. For bidding purposes, the State is not requiring bidders to submit each of their locations that they use as collection sites. However, the State will not modify any language in this RFP pertaining to subcontractors.
20Statement of Work, #19 Specimen Storage8American Association of Blood Banks (AABB) standards require storage of the actual specimen for 6 months after a result is issued. Once a sample is tested and a report is issued meeting all AABB requirements, it is not necessary to maintain the actual sample in order to re-use the data in a subsequent case (assuming proper order and consent is obtained). It is important to maintain all chain of custody records, the report, genetic data, etc. for a minimun of 5 years or longer based on any contractual obligations. We request that the wording be revised to the following:

Contractor must be able to store all necessary data and/or specimens for a minimum of 10 years unless they have been excluded and are required to be destroyed pursuant to Michigan Statue, MCL722.716a.

a. Bidder must describe how long they are currently storing data and/or samples and their experience with the reuse of stored data and/or samples.

In the Statement of Work, page 8, #19 is hereby changed to read:

Contractor must be able to store all necessary data and/or specimens for a minimum of 10 years unless they have been excluded and are required to be destroyed pursuant to Michigan Statue, MCL722.716a.

a. Bidder must describe how long they are currently storing data and/or samples and their experience with the reuse of stored data and/or samples.

21Statement of Work, #20 Expungement Process8We can perform the required Expungement Process according to Michigan Statute MCL722.716a. This is a very time consuming and costly process. Would the state consider allowing an additional method of notification requirement to the alleged father to incude an electronic email notification? USPS certified return receipt adds an approximate additional cost of $7.00 per case requiring expungement. This would allow options for the vendor in order to provide a more economical method of delivery.Current statute requires certified mail. The State is interested in alternatives should the statute change during the contract term.
22Statement of Work #229Statement of Work #22 on page 9 states the following - Expert Witness Testimony – The Contractor must make available expert witness testimony in court at the request of the OCS designated child support establishment personnel or the child welfare caseworker. The expert witness provided by the Contractor must be certified as an expert witness in all courts of the state of Michigan. Scheduling arrangements related to the provision of expert witness testimony by the Contractor are the responsibility of the requesting child support paternity establishment personnel or the child welfare caseworker. Contractor’s failure to provide this service at the court appointed time may be considered for corrective action, liquidated damages or default of the Contract. The number of requested engagements will vary and is not under the control of the State of Michigan. An expert witness engagement is defined as an appearance by one witness for not longer than one day per case. The Contractor must, upon request, provide an affidavit or signing of pleadings in support of Summary Disposition.
There is no state-wide “certification” or “certification process” for experts that we are aware of in the State of Michigan. Are we correct to assume that our expert’s competency to testify will be established in the usual manner by the various courts when and where they come to testify?Yes.
23Contract Terms section 18.910Is the Offeror supposed to populate sections of the Contract Terms document like section 18.9 and return it as part of its proposal?Yes. Items highlighted in green should be populated by the bidder with information that pertains to that section
24Contract Terms, #20.2 Hosted Services11This question concerns the depth of the IT security requirements. Child Support's involvement with a lab's web portal is far less involved than that of other Child Support vendors such as fiscal collections, fiscal disbursements, statewide system management, call center management, etc. The genetic testing labs do not access your statewide system. Additionally, only a very few OCS and child welfare associates access the lab's database portal that maintains information about the genetic testing cases. The public never accesses it, and each Child Support associate has a unique username and password. Could you please delete this requirement since it is not applicable to the genetic testing RFP?No, the IT Security requirements will not be removed. The IT Security requirements pertain to the Web portal and the infrastructure hosting the web portal and storing/archiving the data presented via the web portal.
25Statement of Work, #26 Turnaround Time for Reports11Please confirm if the turnaround time specification of "7 days or less after the receipt of the final specimen" is Business Days or Calendar Days.Business Days
26Statement of Work #2812Statement of Work #28 state the following - Procedures Manual – The Contractor must have and maintain a manual detailing all laboratory procedures and policies. Bidder must provide a copy of their current procedures manual.

Our standard operating procedures (SOPs) are numerous (number in the 100s) and are very technical in nature. They are also considered proprietary and it would be time consuming to request confidential treatment for each SOP. All SOPs are available for review on site. Would the agency accept a list of our SOPs as evidence we meet this requirement and in lieu of providing copies of the actual policies and procedures themselves? Yes, a list would be sufficient. However, the state may request a copy of the SOPs upon need.

27 Statement of Work Requirement section B.29 12 The Contractor must also provide proof of its compliance with the ADA.

What constitutes proof of compliance – will the state accept a VPAT or is there another mechanism? The contractor is required to comply with the Michigan Digital Standards and also undergo an ADA review. Digital Standards are located at www.michigan.gov/standards
28Statement of Work Requirement section B.3214Bidder must describe their experience with a file transfer process to a statewide or countywide system and provide a graphic representation of the process, examples of the information that was/is transferred and description of the system that receives the information.
Is there already a file transfer process in place and if so can the state please provide a technical description of the protocols employed and the designed file format (XML, HL7, HML, etc.)?The State of Michigan leverages an Enterprise wide File Transfer System based on the product MessageWay.by IPSwitch. Various file formats are supported.
29Statement of Work Technical Specifications section 2.b17All Hosted Services provided by the Contractor must adhere to the Look and Feel Standards
Should the hosted service not initially meet these standards, what would be the provision for allowing us to remediate any deficiencies? The contractor is required to comply with the Michigan Digital Standards and also undergo an Look and Feel review. Digital Standards are located at www.michigan.gov/standards. Non-compliance remediation timeframe will be negotiated with the Contractor.
30Statement of Work Technical Specifications section 2.d18Hosted Services must be capable of supporting the State standard federated single sign on with multi-factor authentication using SAML or comparable mechanisms.
Should the hosted service not initially meet this requirement, what would be the provision for allowing us to provide an alternate implementation or remediation?Non-compliance remediation timeframe or review / acceptance of alternative implementation will be negotiated with the Contractor.
31Statement of Work Technical Specifications section 2.e.218Hosted Services must utilize responsive design practices to ensure the application is accessible via a mobile device. Solution must support iOS, Android and Windows Mobile platforms for mobile devices (e.g. cellular phones and tablets). All features must be able to perform via mobile devices.
Should the hosted service not initially meet this requirement, what would be the provision for allowing us to provide remediation?Non-compliance remediation timeframe will be negotiated with the Contractor.
32Statement of Work Technical Specifications section 2.f.419If applicable, provide multi-factor authentication. This level; however, does not require a hard token at contract execution. Some other method such as SMMS text with passcode, phone call with temporary passcode, or other approved multi-factor authentication for privileged/administrative access, method must be used.
Should the hosted service not initially meet this requirement, what would be the provision for allowing us to provide an alternate implementation or remediation?Non-compliance remediation timeframe or review / acceptance of alternative implementation will be negotiated with the Contractor.
33Statement of Work section Requirement section 5 Reporting24Please provide examples of each of the reports listed in this section as currently being submitted. The State currently receives a monthly report that identifies the following information for each county:

- The number of samples collected;

- The number of cases in each county reported;

- The number of exclusions and inclusions;

- The percentage of exclusions; and

- The average turn-around-time for cases in each county

The State recommends that Bidder propose additional reports and/or format suggestions.

34Contract Terms section 3225Would it be equally acceptable to the State to be listed on the certificate of insurance as certificate holder rather than additional insured?Yes
35Statement of Work section Requirement section 7.3 Liquidated Damages25Please provide examples that explain specific scenarios where liquidated damage will be assessed. For example if a case missed the required turnaround time will these liquidated damages be applied?Examples are within the Statement of Work in the RFP.

36Contract Terms, #34 Software Escrow27This question concerns the depth of the IT security requirements.
37Contract Terms - Schedule B - Service Level Agreement35Is this section applicable to our internally hosted service (application) being accessed remotely?SLAs apply to the availability of the Web Portal. Per Proposal Instructions, The State strongly encourages strict adherence to the Contract Terms. The State reserves the right to deem a bid non-responsive for failure to accept the Contract Terms. Nevertheless, the bidder may submit proposed changes to the Contract Terms in track changes (i.e., visible edits) with an explanation of the bidder’s need for each proposed change. Failure to include track changes with an explanation of the bidder’s need for the proposed change constitutes the bidder’s acceptance of the Contract Terms. General statements, such as that the bidder reserves the right to negotiate the terms and conditions, may be considered non-responsive.
38Contract Terms, Service Level Agreement35This question concerns the depth of the IT security requirements. Could you please delete this requirement since it is not applicable to the genetic testing RFP?No, the IT Security requirements will not be removed. The IT Security requirements pertain to the Web portal and the infrastructure hosting the web portal and storing/archiving the data presented via the web portal.
39Contract Terms - Schedule C – Data Security Requirements - Section 3 Protection of the State’s Confidential Information42For the purposes of our internal database and computing systems, will an attestation from our Corporate Security department suffice to address concerns around security and access (barring specific requirements called out in 3.7 and 3.8)?Contractor is required to participate in the Securtiy Assessment process. Information provided by Corportate Security will be considered as part of the Security Assessment.
40Statement of Work, #28 Procedures Manual43You ask the bidder to provide a copy of its procedure manual. A lab's procedure manual is hundreds of pages, very scientific oriented, and is considered proprietary to that lab. The procedures manual is reviewed by the AABB in the course of the lab's inspection. Based on the manual's size, confidential nature, and being filled with laboratory minutae, would the State be willing to accept AABB accreditation as proof that its procedures manual is valid?Yes
41Statement of Work, # 2a Technical Specifications59This question concerns the depth of the IT security requirements. Could you please delete this requirement since it is not applicable to the genetic testing RFP?No. The IT Security requirements will not be removed. The IT Security requirements pertain to the Web portal and the infrastructure hosting the web portal and storing/archiving the data presented via the web portal.
42License Grant and Restrictions, #1910-11Please confirm how this requirement applies to this genetic testing solicitation. Typically, each genetic testing vendor maintains a secure website that is available to authorized users in each county and/or state. These are not hosted services and while results or case status is online, the secure site is not processing state data. Information regarding case status is able to be exported by authorized users. With regard to State Ownership of Work Product, the product is the results of the testing which are provided to the authorized agency personnel. The vendor maintains the data and actual samples according to contract and accreditation standards.Per Proposal Instructions, The State strongly encourages strict adherence to the Contract Terms.
43Statement of Work Technical Specifications section 2.f.6Remain compliant with:

i. Privacy Act of 1974, Public Law 93-579

ii. Federal Information Security Management Act (FISMA) of 2002, 44 USC 3541 et seq.

iii. Michigan Identity Theft Protection Act, MCL 445.61 through MCL 445.79d

How does the state recommend that we demonstrate compliance with each of these statutes?Contractor is required to participate in the Securtiy Assessment process. Compliance will be evaluated as part of the Securitiy Assessment.
44Contract Terms #32.1 Required Coverage24-26Under Privacy and Security Liability (Cyber Liability) Insurance, the Required Limit is $5,000,000 for Each Occurrence and $5,000,000 for Annual Aggregate. Would the state allow $2,000,000 as this is the industry standard coverage? Under Professional Liability Insurance, it requires $3,000,000 for Each Occurrence and Annual Aggregrate. Our current policy is $1,000,000 for Each Occurrence and $3,000,000 Annual Aggregate. Would the state consider reducing the amount to $1,000,000 for Each Occurrence. The Umbrella or Excess Liability is requiring a Mimial Limit of $10,000,000 General Aggregate, and our current is $5,000,000. Would the state consider reducing to $5,000,000. These requirements seem excessive and are well beyond the typical coverages required in our industry. The cost for these added coverages is significant and currently under review, but it appears to be at least $75,000 per year additional cost that would be incurred.Insurance levels will be reduced to suggested levels per DTMB Central Procurement Risk Management approval as follows:

Privacy and Security Liability (Cyber Liability) Insurance Minimal Limits:

$2,000,000 Each Occurance $2,000,000 Annual Aggregate

Professional Liability (Errors and Omissions) Insurance Minimal Limits:

$1,000,000 Each Occurance $3,000,000 Annual Aggregagte

Umbrella or Excess Liability Insurance Minimal Limits:

$5,000,000 General Aggregate 45 Contract Terms #20.2 Hosted Services, #34 Software Escrow, Schedule B-Service Level Agreement 11, 27, and 35 Our proposal response team members are reviewing the documents and are formulating their questions. One big question that arose concerns the depth of the IT security requirements and Hosted Services. Child Support's involvement with our web portal is far less involved than that of other Child Support vendors such as fiscal collections, fiscal disbursements, statewide system management, call center management, etc. The genetic testing labs do not access your statewide system. Additionally, only a very few Child Support associates access our web portal, our database that maintains information about our genetic testing cases. The public never accesses it, and each Child Support associate has a unique username and password. Please confirm if these services and requirements are intended for the Genetic Paternity Testing Services solicitation. If possible, an expedited response is critical in order for us to properly respond and with such a short response time. The IT Security requirements pertain to the Web portal and the infrastructure hosting the web portal and storing/archiving the data presented via the web portal.
