About this file
This document is a Questions and Answers (Q&A) No. 2 response issued by the Los Angeles County Metropolitan Transportation Authority (LACMTA) on July 20, 2026, addressing inquiries from potential proposers regarding RFP No. AE141998 for CEQA/NEPA Environmental Compliance Services. The Q&A clarifies critical contract requirements and procurement procedures, including confirmation that only prime proposers must complete the Non-Collusion Affidavit, that proposal forms on page 34 are excluded from page count requirements, and that Experience/Performance Questionnaires can be previously collected if contact information is current. Metro confirmed this is a Task Order-based contract requiring proposers to submit direct labor rates and indirect labor rates using Form 60, clarified that the Bidder's List Form and related exhibits belong in Volume IV DEOD Forms and Required Documents, and explicitly stated that Local Small Business Enterprise (LSBE) preference does not apply to this federally funded procurement. Additionally, Metro clarified that the Disadvantaged Business Enterprise (DBE) Compensation Plan is a post-award submittal due 45 days after contract execution, not a pre-award requirement.
The Q&A extensively addresses organizational conflicts of interest (OCI) concerns, confirming that OCI determinations will be made at the Task Order level rather than at initial contract award and that OCIs will be analyzed on a task-order-by-task-order basis for firms holding multiple Metro contracts. Metro stated that contractors performing CEQA/NEPA compliance may generally be precluded from performing other services (engineering design, construction management, program management) on the same project, though mitigation plans may be considered on a case-by-case basis. Prime consultants must disclose all existing Metro contracts that could create actual or perceived conflicts, and environmental monitors must report only to Metro's Environmental Services Division to preserve independence. Metro confirmed that apprenticeship requirements apply only to trades designated as apprenticeable per the California Department of Industrial Relations website and that federal apprenticeship provisions govern applicable wage determinations for 2026-1 journeyman classifications.

Please clarify whether a contractor performing CEQA/NEPA compliance or environmental monitoring under this contract may also provide engineering design, construction management, program management, or other services on the same Metro project.
This contract will necessitate an organizational conflict of interest (“OCI”) assessment for each task order released.
In general, a firm will be precluded from performing CEQA/NEPA compliance/monitoring for a specific project if it is also a member of the contractor (builder) team for the same project. If a CEQA/NEPA compliance task order is issued for a specific project and a firm is providing (or has provided) consultancy services on behalf of the owner (Metro) including design, construction management, and program management, etc. on the same project, an OCI analysis will take place. OCIs are fact dependent and analyzed on a case-by-case basis. If a potential OCI is identified, a firm may provide a proposed mitigation

Amendment plan. Metro will consider the plan and determine whether the mitigation effort can properly remedy the actual or apparent OCI. Firms will be responsible for identifying and disclosing potential conflicts. If a contractor is currently serving as the design engineer, program manager, construction manager, or owner's representative on a Metro project, will that contractor be eligible to perform environmental compliance monitoring, mitigation monitoring, or environmental document preparation on the same project?
Please see answer from Q9 (above) 07/15/2026
11 6/30/2026
How does Metro define an Organizational Conflict of Interest for this contract where a contractor may be responsible for independently evaluating environmental compliance on a project for which it also performs engineering or construction-related services?
OCIs can arise when a contractor/subcontractor’s previous work product, whether completed on behalf of Metro or another public or private entity, has been relied upon or significantly influenced the specifications or statement of work for the upcoming project or contract; or whenever a contractor would be in a position to evaluate their own previous work product, whether it was completed on behalf of Metro or another public or private entity; or whether a firm might be able to provide unbiased advice to the owner; or when prior responsibilities in service of Metro or another public or private entity yields access to confidential information which puts the contractor at a significant competitive advantage over any other potential bidders/proposers.
