About this file
This document is a Request for Proposals (RFP) issued by the Maryland Department of Labor (MD Labor) for Heavy Equipment Operator (HEO) Training Simulators, identified as LABOR-FY-2024-002. The RFP outlines the requirements for providing HEO training simulators, including configuration backups, disaster recovery, and security measures. Bidders are required to submit proposals that adhere to the specifications and pricing outlined in the RFP. While the RFP allows for optional backup services, the requirements for disaster recovery, information technology, security logs and reports, security plan, and data breach responsibilities remain unchanged. The contract term is not specified, and the RFP does not indicate whether there are any renewal options.
Regarding pricing, the RFP includes a Financial Proposal Form that requires bidders to provide unit prices for the HEO training simulators and annual support. However, the RFP has been amended to clarify the pricing and quantity requirements. The insurance requirements have also been amended, with the removal of the requirement for cyber security/data breach insurance. The RFP does not mention any set-asides, incumbents, or specific funding sources and amounts.

REQUEST FOR PROPOSALS - #LABOR-FY2024-002
QUESTIONS & RESPONSES SERIES #1
DEPARTMENT OF LABOR
REQUEST FOR PROPOSALS
HEAVY EQUIPMENT OPERATOR (HEO) TRAINING SIMULATORS
NUMBER: LABOR-FY-2024-002
QUESTIONS AND RESPONSES #1
Question 1: The RFP document section 2.3.1 A and B, and Attachment B Price Proposal Form requesting adherence and pricing for backup services SSI submits is both unreasonable and not possible. The backup as defined is excessively unreasonable and complicated because Simulator Systems International (SSI) does not store any Confidential data of any type on the simulator, and if there is a failure, SSI provides an external hard drive that allows the instructor to restore the simulator software to factory settings. Also, SSI submits the backup as requested is not even possible, since these simulators are not expected to be connected to the internet.
Therefore, SSI either requires clarification of what is needed within reason, based on scope of this RFP and equipment provided, or for removal of these sections and line item on the Price Proposal Form in its’ entirety.
Answer: Section 2.3.1.A states to provide backups of the configuration and data on a regular basis as a Contract option. Therefore, the back-up configuration is optional.
Question 2: For the same reasons as stated above SSI requests removal of section 3.5 Disaster Recovery and Data, 3.7.4 Information Technology, 3.7.5 Security Logs and Reports Access, 3.7.6 Security Plan, and 3.7.7 Data Breach Responsibilities.
Answer: The requirement for Sections 3.5 Disaster Recovery and Data, 3.7.4 Information Technology, 3.7.5 Security Logs and Reports Access, 3.7.6 Security Plan, and 3.7.7 Data Breach Responsibilities remain unchanged.
Question 3: The RFP section 3.6 Insurance Requirements, requires, in SSI’s opinion, excessive and unreasonable coverage including B) Errors and Omissions / Professional Liability (which is generally required from a prime contractor providing consulting or engineering services, and not from contractors providing off the shelf commodity products), and C) Crime Insurance / Employee Theft Insurance (SSI sees no reason for asking for such coverage from a vendor delivering a simulator), and D) Cyber Security / Data Brech Insurance (SSI will have no control of the equipment at each facility and cannot provide any sort of Cyber security methods). And, as stated above, SSI does not ask for or retain any Confidential information from any user. SSI requests that requirements B, C, and D are removed from the Insurance requirements.
Answer: The Insurance requirements will remain except for Section 3.6.1(D); see Amendment #3.
Question 4: On page 5 of the RFP, SSI requests changing the wording to be” Updates.
Throughout the length of the Contract, Contractor will provide to the State at no additional charge all new releases and bug fixes (collectively referred to as “Updates”) for any licensed software Deliverable purchased by the State”.
Answer: see Amendment #3.
Question 5: Section 4.6 - Will multiple options in one (1) proposal be acceptable to MD Labor?
Answer: No
Question 6: Specific to L3 Technologies, Inc. We have had previous contracts with Maryland government organizations. One such contract is with “The County Commissioners of Carroll County, Maryland.” The Agreement is titled “Law Enforcement Driver Training Simulator, Software and Services.” The contract can be provided upon request. Could MD Labor be open to piggybacking on said contract?
Answer: No
Question 7: Is the idea that we will enter the unit price in the “Price Column”? Furthermore, in the first row you note the simulator “with three year manufacture warranty.” Then in the penultimate row, you note “Annual Support.” Is the “Annual Support” for optional years of warranty?
Answer: See Amendment #3
Question 8: Furthermore, in the first row you note the simulator “with three-year manufacture warranty.” Then in the penultimate row, you note “Annual Support.” Is the “Annual Support” for optional years of warranty?
Question 9: There is no quantity listed in the Financial Proposal Form.
