PERFORMANCE WORK STATEMENT

1. INTRODUCTION:

a. The Defense Logistics Agency Disposition Services (DLA DS) is a Major Subordinate Command (MSC) of the Defense Logistics Agency (DLA) with the primary responsibility of disposing of and reutilizing Department of Defense (DoD) excess and surplus property generated by the military services. This is accomplished through reutilization to other DoD activities, transfer to other Federal agencies, donation to authorized state and local organizations, sale to the public, or ultimate disposal through abandonment or destruction. The headquarters for DLA DS is in Battle Creek, Michigan.

b. DLA DS Bragg requires grounds maintenance services around building J1334 (see attachment 1), and lots 5&6 (See attachment 2), to include trimming of bushes and shrubs in landscaped areas on property around DLA DS Bragg in a manner that will promote the growth of healthy grass, trees, shrubs, and plants and present a clean, neat and professional appearance.

c. DLA DS Bragg Point of Contact (POC) will request a service as needed.

d. Building J1334 is approximately 9 acres, Lot 5 is 1.70 acres, and Lot 6 is 2.45 acres, with at least 90% of the area being concrete, gravel or asphalt surfaces.

e. The term Contractor applies to all subcontractor personnel/equipment/supplies that may be hired/provided by the Contractor.

2. DEFINITIONS:

a. Brush: Weeds, grass, vines, vegetation, shrubs, or saplings that have grown to a height greater than 8 inches.

b. Clear-Cut: To remove or cut brush.

c. Debris: Leaves, grass cuttings, tree and shrubbery limbs, construction waste (excluding any waste generated by another Contractor) and similar waste material.

d. Drawings (Plot Plans): Plot plans will designate areas and type of service.

e. Edging: The cutting of overhanging vegetation away from the edges of a hard surface (curbs, sidewalks, driveways, etc.) to include actual depth penetration of soil.

f. Grass: Botanical, any plant of the Gramineae family which is characterized by narrow leaves with parallel veins; the leaves are composed of blades, sheath, and ligule. The plants have jointed stems and fibrous roots, and inconspicuous flowers usually arranged in spikelet.

g. Grounds: All land and water acreage on the installation. Precautions shall be taken to prevent scalping, uneven mowing, rutting by equipment, and damage to fences, buildings and property stored in the yard. The contractor shall repair or replace damage that occurs during mowing operations. All mowing equipment shall be properly adjusted. Grounds are grouped in the following three categories.

h. Improved: Includes the areas at the facility where the grass will be cut/mowed (mulched) between two (2) and (3) inches high, sidewalks, parking lot and driveways will be trimmed and edged. To include picking up all visible grass trimmings, fallen tree limbs, trash and other debris.

i. Semi-Improved: Grounds that require mowing only, no trimming or edging performed except for along fences. Grass will be cut between two (2) and three (3) inches high as scheduled. Includes picking up all visible grass trimmings, fallen tree limbs, trash and other debris.

j. Unimproved: Grounds not included in the above categories (gravel area). Areas that require very limited service. Grass will be cut between two (2) and four (4) inches high as scheduled. Requires mowing only, no trimming, edging, or pruning performed, except for along fences. Includes picking up all fallen limbs from trees, trash, and other debris.

k. Quality Assurance (QA): Actions taken by the Government to inspect or check goods or services to determine that they meet the requirements of the contract in accordance with Section 9 Acceptable Performance Levels (APLs).

l. Trimming Grass/Weeds: The cutting of grass and weeds in areas that are inaccessible to mowers due to obstacles.

m. Turf: A surface layer of soil containing a dense growth of grass and its matted roots.

n. Weeds: Any plant growing where it is not desired. Plants such as, but not limited to clover, dandelions, purslane, chickweed, plantain, knot weed, black medic, and volunteer trees are also considered weeds. Grass is plant, rock, and shrub beds, cracks in sidewalks, streets, and parking lots are also considered weeds.

3. PERIOD OF PERFORMANCE:

This is a Firm-Fixed Price (FFP) contract which consists of one (1) 12-month base period and four (4) 12-month option periods. The total contract length shall not exceed five (5) years.

4. TASKS TO BE PERFORMED:

The Contractor shall:

a. Furnish all properly trained personnel, management, supervision, subcontractors, equipment, tools, materials, transportation, products and supplies necessary to perform ground maintenance at: DLA DS Fort Bragg, NC.

b. The cycles will be completed as needed and determined by the Fort Bragg POC.

i. Complete Law Service Cycles: Mowing, weeding, trimming, edging, and policing of all areas which have been mowed shall constitute a mowing cycle. All mowing, weeding, trimming, edging, and policing shall be done as one operation, to be fully completed before acceptance by the POC. The term “Mowing of areas” shall include trimming by Contractor around fire hydrants, expansion joints in sidewalks and curbs, between sidewalks and curbs and between cracks in the paved areas, electrical poles, internal fence lines, parking lot and other areas supporting vegetation. All grass, weeds, vines, etc. will be removed from the fences (both sides) and railroad tracks. Clippings deposited on driveways, sidewalks, and adjacent streets because of the mowing, trimming and edging operations shall be cleared promptly after completing the above operations. Trimming of shrubs and bushes in landscaped areas will be included in a Mowing Cycle as determined by the contractor and POC.

ii. Grass/Vegetation Mowing: Contractor shall perform this service where specified in the plot plans. Areas will be cut to a uniform height between two (2) to four (4) inches during each service. Grass clippings shall be removed or may be mulched if the lawn maintains a neat appearance and no clippings are visible. Grass clippings shall be disposed of properly. Fence lines will be maintained at the mowing cycle frequency on both sides of the fence. The grass on the outside of the warehouse yard fence near the front parking lot shall be maintained at a height between two (2) to four (4) inches to the tree line during complete lawn service cycle.

iii. Trimming of Shrubs and Bushes: Landscaped area will be included in a Mowing Cycle as needed, as determined by the POC.

c. Perform landscaping services within five (5) days of receiving a request by the DLA DS Bragg POC.

d. Take precautions to prevent scalping, uneven mowing or cutting by equipment.

e. Repair damaged government facilities, government owned property and equipment.

f. Control grass and weeds growing in the paved areas through cracks, holes, around the scales, scrap bins, buildings, and internal fence lines.

g. Mow/trim and remove any vegetation surrounding all fire hydrants within the DLA DS Bragg perimeter to ensure they are accessible to emergency personnel.

h. Perimeter security fences shall be maintained with a five (5)-foot-wide access cleared of brush and trees on both sides.

i. Supplement with hand operations in locations that are inaccessible to the Contractor’s equipment.

j. Edge around areas as part of each mowing cycle including lawns where they adjoin sidewalks, curbs, and paved roadways.

k. Pick up and dispose of litter to include paper, bottles, cans, cardboard, plastic, rags, tree limbs, branches, twigs, broken glass, chunks of concrete/asphalt, leaves, tumbleweeds, and plastic hung on fences and under/around them within a ten (10)-foot perimeter on either side as identified by the POC. The Contractor shall place all material in United States Government (USG) provided containers.

5. HOURS OF OPERATION AND HOLIDAYS:

The service to be performed under this contract shall be performed during normal USG business days. The schedule of service will be Monday through Friday 7:00 AM – 2:30 PM, and if not finished that day will return on the following workday to complete the task. Services will not be scheduled to be performed on a regular Federal holiday (see below), or one designated by Presidential proclamation unless approved by the POC.

*The holiday is observed on the preceding Friday or the following Monday when the holiday occurs on Saturday or Sunday, respectively.

6. BASE ACCESS AND SECURITY:

a. The Contractor shall coordinate base installation access for all their employees. The Contractor shall be familiar with and comply with all Base Command policies regarding security considerations for all Contractor employees.

b. Unscheduled gate closures by the installation security personnel may occur at any time causing all personnel entering or exiting a closed installation to experience a delay; this cannot be predicted or prevented. Contractors are not compensated for unexpected closures or delays. Vehicles operated by Contractor personnel are subject to search pursuant to applicable regulations. Any violation of applicable motor vehicle regulation may result in the termination of the Contractor employee’s installation driving privileges.

c. Contractor employees shall become familiar with and obey the regulations of the installation, including fire, traffic, safety, and security regulations while on the installation. Contractor employees should only enter restricted areas when required to do so and only upon prior approval. All Contractor employees shall always carry proper identification with them and shall be subject to such checks as may be deemed necessary. The Contractor shall ensure compliance with all regulations and orders of the installation which may affect performance. The USG reserves the right to direct the removal of an employee for misconduct, security reasons, or any overt evidence of communicable disease. Removal of Contractor employees for reasons stated above does not relieve the Contractor from responsibility for total performance of this contract.

d. The Contractor shall comply with all applicable installation/facility access and local security policies and procedures, which may be obtained from the POC. The Contractor and all associated employees shall provide all information required for background checks to meet installation access requirements to be accomplished by installation security personnel. The Contractor shall ensure compliance with all personal identity verification requirements as directed by DoD and/or local policy. Should the Force Protection Condition (FPCON) change, the USG may require changes in Contractor security matters or processes.

7. U.S. GOVERNMENT FURNISHED PROPERTY AND SERVICES:

a. The USG will furnish the necessary workspace for the Contractor to perform services as outlined in this PWS.

b. The USG will provide utilities, if available, at the areas identified in sections 1.b and 1.d, such as electricity and water, for use in the performance of this contract. The Contractor shall instruct employees in utilities conservation practices. The Contractor shall operate under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount.

8. CONTRACTOR FURNISHED MATERIAL, EQUIPMENT, AND SERVICES:

a. The Contractor shall provide all materials such as petroleum, oil, and lubricants (POLs), and spill clean-up items for use during the performance of this contract.

b. The Contractor shall provide all personal protective equipment, tools, and any other equipment required to perform under the provisions of this contract.

c. The Contractor shall provide all supervision, quality control, trained and certified employees, and a primary and alternate POC with phone number.

9. ACCEPTABLE PERFORMANCE LEVELS (APLs):

a. APLs are the minimum performance levels of specific requirements which the Contractor must achieve or risk having the government consider performance unsatisfactory, which may result in monetary or other consideration from the Contractor.

b. If performance falls below the specified performance level, consideration may be taken at the USG’s discretion. Decisions will consider the impact on the USG because of the failure to meet the performance requirement and the number of times the failure occurred throughout the contract period.

c. Performance incentives for the Contractor will include, but are not necessarily limited to, favorable impact on option exercise decisions, future awards of the same requirement, and future awards of similar requirements by DLA DS as well as other government and non-government entities that may review the performance of this contract.

10. CHEMICALS:

Chemicals used in the performance of the work shall be purchased by the Contractor and issued to the Contractor’s employees in the original manufacturer’s containers. All chemicals must be authorized for use on Fort Bragg and meet all the installation requirements. All containers shall identify the type of chemical, instructions for use, dilution, and any hazardous warnings. Products shall be recommended by the manufacturer for their intended use and shall be compatible with other manufacturers’ products used in conjunction with these products. Products must have been available in the market for commercial use for at least two (2) years. The manufacturer’s published data will be the only acceptable evidence of materials meeting this requirement.

11. SPILL RESPONSIBILITY:

The Contractor is solely responsible for all spills or leaks during the performance of this contract that is attributable to the actions of its agents, employees, or subcontractors. The Contractor shall clean up such spills or leaks to the satisfaction of the USG in a manner that complies with applicable Federal, state, and local laws and regulations. The clean-up shall be at no cost to the USG. The Contractor shall report all such spills or leaks, regardless of their quantity to the POC and Contracting Officer (KO) immediately upon discovery. A written follow-up report shall be submitted to the POC and KO not later than twenty-four hours after the initial telephonic report. The written report shall be in narrative form, and as a minimum shall include the following:

i. Description of item spilled (including identity, quantity).

ii. Whether the amount spilled is EPA or state reportable, and if so, whether it was reported. Exact time and location of spill including a description of the area involved.

iii. Containment procedures initiated.

iv. Summary of any communications Contractor has with press or USG officials other than the KO.

v. Description of clean-up procedures employed or to be employed at the site including disposal location of spill residue.

vi. Description of item spilled (including identity, quantity).

12. POINT OF CONTACT (POC):

Point of Contacts will be provided upon award.

13. INVOICING:

The Contractor will invoice monthly through the DoD Wide Area Workflow (WAWF) system. Invoices must be submitted through WAWF in accordance with the Defense Federal Acquisition Regulations Supplement (DFARS) 252.232-7003. Refer to https://wawf.eb.mil for additional information.

14. CONTRACT MINIMUM AND MAXIMUM

The contract minimum shall be $2,000.00. The maximum shall be 150% of the estimated value of the contract. There is no contract minimum for any option period included in the contract.
