PERFORMANCE WORK STATEMENT (PWS)

1. INTRODUCTION:

The Defense Logistics Agency Disposition Services (DLADS) is a Major Subordinate Command (MSC) of the Defense Logistics Agency (DLA) with the responsibility of disposing and reutilizing Department of Defense (DoD) excess and surplus property generated by the military services. This is accomplished through reutilization to other DoD activities, transfer to other Federal agencies, donation to authorized state and local organizations, sale to the public, or ultimate disposal through abandonment or destruction. The headquarters for DLADS is located in Battle Creek, Michigan. DLADS Anniston requires the use of the Custom Cutter Set SSI 100 Shredder to perform Demilitarization functions on required property. It is imperative to ensure the shredder is always operational in order to ensure mission accomplishment and prevent backlog of property and material requiring Demilitarization procedures.

2. PERIOD OF PERFORMANCE:

The performance period shall consist of a twelve-month base period.

3. TASKS TO BE PERFORMED:

The Contractor/Subcontractor shall:

a. Perform lockout/tagout procedures on all hydraulic and electrical systems prior to initiating any work.

b. Perform lockout/tagout clearing procedures on all hydraulic and electrical systems upon completion of the work and returning operational control of the Custom Cutter Set, SSI M100 Shredder to the USG.

c. Obtain any necessary permits for any required “hot” work which may involve acetylene torches, grinding, etc.

d. Provide all fire extinguishers and other safety equipment required by laws, regulations, or procedures for all work operations.

e. Coordinate with the USG to ensure work area is clear of all flammable materials, cover all openings, and monitor the work site for up to two hours following the completion of work.

f. Provide personnel to assume fire watch responsibilities during and after “hot” work is completed.

g. Provide a minimum of ten business day advance notice to the COR before rendering services on the Custom Cutter Set SSI M100 Shredder.

h. Complete the replacement of required wear and tear parts listed in appendix 1 of this PWS no later than six months after contract award unless otherwise coordinated with and approved by the COR.

i. Have five business days to complete the replacement of all required wear and tear parts listed in Appendix 1 of this PWS from the commencement of work unless otherwise coordinated with and approved by the COR.

j. Test the Custom Cutter Set SSI M100 Shredder to ensure full operational status prior to returning operational control to the Government.

k. Daily and upon completion of the annual replacement of parts, clean the workspace, remove, and dispose of any parts and debris resulting from the performance of the work at no additional cost to the USG.

l. Correct unsatisfactory work as soon as possible but no later than three calendar days of USG notification. In accordance with Federal Acquisition Regulation (FAR) 52.212-4 all costs associated with the repair of unsatisfactory work are born by the contractor or subcontractor.

m. Replace all wear and tear items listed in Appendix 1 to this PWS.

4. PLACE OF PERFORMANCE:

The Contractor/Subcontractor shall provide services on USG premises at DLADS CDD Anniston, building 104, except on recognized US holidays or when the USG facility/installation is closed due to local or national emergencies, administrative closings, or similar USG-directed facility/installation closings. Performance shall be at the designated location specified by the Contracting Officer’s Representative (COR). The Contractor shall at all times maintain an adequate work force for the uninterrupted performance of all tasks defined within this PWS when the USG facility/installation is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the work force are essential.

5. FEDERAL HOLIDAYS:

The Contractor/Subcontractor is not required to provide services on the federal holidays observed by the DLA unless approved by the Contracting Officer (KO) or COR. When one of the holidays falls on a Sunday, the following Monday will be observed as the legal holiday. When the legal holiday falls on a Saturday, the preceding Friday is observed as the legal holiday. The following holidays are observed:

6. SAFETY & SECURITY:

a. Unscheduled gate closures by the installation security personnel may occur at any time causing all personnel entering or exiting a closed installation to experience a delay; this cannot be predicted or prevented. Contractors/Subcontractors are not compensated for unexpected closures or delays. Vehicles operated by Contractor/Subcontractor personnel are subject to search pursuant to applicable regulations. Any moving violation of any applicable motor vehicle regulation may result in the termination of the Contractor/Subcontractor’s employee’s installation driving privileges.

b. Contractor/Subcontractor employees shall become familiar with and obey the regulations of the installation, including fire, traffic, safety, and security regulations while on the installation. Contractor/Subcontractor employees should only enter restricted areas when required to do so and only upon prior approval. All Contractor/Subcontractor employees shall always carry proper identification with them and shall be subject to such checks as may be deemed necessary. The Contractor/Subcontractor shall ensure compliance with all regulations and orders of the installation which may affect performance. The USG reserves the right to direct the removal of an employee for misconduct, security reasons, or any overt evidence of communicable disease. Removal of Contractor/Subcontractor employees for reasons stated above does not relieve the Contractor/Subcontractor from responsibility for total performance of this contract.

c. The Contractor/Subcontractor shall comply with all applicable installation/facility access and local security policies and procedures, which may be obtained from the COR. The Contractor/Subcontractor and all associated employees shall provide all information required for background checks to meet installation access requirements to be accomplished by installation security personnel. The Contractor/Subcontractor shall ensure compliance with all personal identity verification requirements as directed by Department of Defense (DoD) and/or local policy. Should the Force Protection Condition (FPCON) change, the USG may require changes in Contractor/Subcontractor security matters or processes.

7. U.S. GOVERNMENT FURNISHED PROPERTY, MATERIAL, EQUIPMENT AND SERVICES (GFP/M/E/S):

a. The USG will provide the property, material, equipment, and/or services listed below solely for the purpose of performance under this contract:

b. Property: The USG will furnish the necessary workspace for the contractor to perform services as outlined in this PWS.

c. Material: The USG will not provide any materials.

d. Equipment: The USG will not provide any equipment.

e. Services: All utilities in the facility will be available for the Contractor’s/Subcontractor’s use in the performance of this contract. The Contractor/Subcontractor shall instruct employees in utilities conservation practices. The Contractor/Subcontractor shall operate under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount.

8. CONTRACTOR FURNISHED PROPERTY, MATERIAL, EQUIPMENT, AND SERVICES (CFP/M/E/S):

a. The Contractor/Subcontractor shall provide the property, material, equipment, and/or services listed below and in paragraph 3 above solely for the purpose of performance under this contract:

b. Property: The Contractor/Subcontractor shall not have a requirement to provide any property.

c. Material:

1) Provide all materials to clean up spills caused by their employees during the performance of services.

2) Provide all replacement parts, petroleum, oil, and lubricants (POLs), cleaning supplies, rags, and other shop items necessary for the replacement of all parts listed in appendix 1 of this PWS.

d. Equipment: Provide all personal protective equipment (PPE) for employees in accordance with (IAW) the Occupational Safety and Health Administration (OSHA) guidance, parts, tools, and all other necessary equipment to install the required replacement parts safely and efficiently.

e. Services: Ensure their employees are trained and certified to perform maintenance on shredder systems in addition to other services listed throughout this PWS.

9. QUALITY ASSURANCE (QA):

The USG will evaluate the Contractor’s/Subcontractor’s performance under this contract IAW the Acceptable Performance Levels listed below. They are primarily focused on what the USG will do to ensure that the Contractor/Subcontractor has performed in accordance with the performance standards as defined. They define how the performance standards will be applied, the method of surveillance, and acceptable quality level(s) or defect rate(s).

11. SPILL RESPONSIBILITY:

a. The Contractor is solely responsible for all spills or leaks during the performance of this contract, which occurs because of, or is contributed to by the actions of its agents, employees, or subcontractors. The Contractor shall clean up such spills or leaks to the satisfaction of the USG in a manner that complies with applicable Federal, state, and local laws and regulations. The clean-up shall be at no cost to the USG. The Contractor shall report all such spills or leaks, regardless of their quantity, to the COR and Contracting Officer (KO) immediately upon discovery. A written follow-up report shall be submitted to the COR and KO not later than twenty-four hours after the initial telephonic report. The written report shall be in narrative form, and as a minimum shall include the following:

1) Description of item spilled (including identity, quantity).

2) Whether amount spilled is EPA or state reportable, and if so, whether it was reported. Exact time and location of spill including a description of the area involved.

3) Containment procedures initiated.

4) Summary of any communications Contractor has with press or USG officials other than the KO.

5) Description of clean-up procedures employed or to be employed at the site including disposal location of spill residue.

6) Description of item spilled (including identity, quantity).

12. CONTRACTOR REPORTING:

The Contractor/Subcontractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the DLADS via the secure data collection site, http://www.sam.gov. The Contractor/Subcontractor shall completely fill in all required data fields.

13. DLADS ENVIRONMENTAL MANAGEMENT SYSTEM (EMS):

DLADS implemented an Environmental Management System (EMS) in accordance with ISO 14001:2015(E), DOD, and DLA requirements at all appropriate DLADS facilities. An EMS is an overall management system that includes organizational structure, planning activities, responsibilities, practices, procedures, processes, and resources for developing, implementing, achieving, reviewing, and maintaining the environmental policy of an organization. The DLADS EMS is designed to ensure that all personnel, including contract personnel, whose work activities can cause real or potential significant environmental impact, are aware of how their work supports the EMS and are competent to perform their roles, responsibilities and authorities while supporting the DLADS mission. The DLADS EMS program is explained in the agency EMS Core Instruction. Site supplements may detail information required by EMS at a local level such as local, state and host environmental regulations as well as local emergency procedures and operating procedures unique to the location. Site supplements also contain information concerning the local interaction between the appropriate DLADS tenant facility and the DOD/DLA host facility EMS program. Contractors/Subcontractors and their personnel are required to be aware that each appropriate DLADS facility has an EMS and to be aware of EMS policies to perform work and/or gain access to an installation. Each DLADS facility maintains EMS awareness posters that identify the DLADS Environmental Management Representative (EMR) and host facility EMR for specific guidance concerning an individual facility’s EMS program. Contractors/Subcontractors may request current copies of EMS information identified in this Section by contacting the local COR.

14. INVOICING INFORMATION:

The Contractor will invoice on a monthly basis through the Department of Defense Wide Area Workflow (WAWF) system. Invoices must be submitted through WAWF in accordance with Defense Federal Acquisition Regulations Supplement (DFARS) 252.232-7003. Refer to https://wawf.eb.mil for additional information.
