3. CONTRACT EFFORT REQUIRED

A. Minimum Level of Work. The Contractor must perform an assessment and take all steps and measures to provide a minimum HVAC System operational availability of 97% and no more than 4 unscheduled outages per 12-month period. The maintenance of the HVAC system must be in accordance with all industry standards.

B. Personnel Requirements. The Contractor must provide qualified HVAC mechanics, work crews, and supervisory personnel in such numbers, places, and times as may be required to fully meet the contract requirements. Must have proper certifications.

C. Working Hours. All scheduled contract work must be accomplished during normal hours (7:00am-4:30pm Monday-Friday), excluding federally observed holiday, FAA moratoriums and confirmed with the Contracting Officer’s Representative (COR). The Contractor's must respond to unscheduled and/or emergency service calls 7 days per week, 24 hours per day.

D. Federally Observed Holidays. The contractor must not schedule routine maintenance for the following Days:

(1) New Year’s Day

(2) Birthday of Martin Luther King Jr.

(3) Washington’s Birthday

(4) Memorial Day

(5) Juneteenth National Independence Day

(6) Independence Day

(7) Labor Day

(8) Columbus Day

(9) Veteran’s Day

(10) Thanksgiving Day

(11) Christmas Day

E. Facility Maintenance Moratoriums. The FAA has established moratorium dates for construction activity at critical Air Traffic Control facilities. The intent is to minimize impact on the ability of FAA to perform its operational activities during peak air travel dates.

Moratorium dates are typically scheduled over the Thanksgiving Holiday and the Christmas/New Year Holiday and local event that increase air traffic to certain level i.e.

Daytona 500, Super Bowl, etc. The Contractor must be aware of these dates and request specific information yearly if he/she anticipates scheduling work on or around the moratorium periods. All activity during moratorium periods must be approved in advance by the FAA. Submit items of work to be performed during moratorium dates no later than forty-five (45) days prior to the moratorium dates. Activities that have, in the sole opinion of the FAA, potential to negatively impact FAA operations will not be approved. A written waiver will be provided by FAA to the Contractor outlining the allowable work items. No additional time or cost will be allowed for such denial.

F. Airport Operations. Access to work areas may be restricted from time to time by necessity of airport operations. Contractor acknowledges that it has taken into account and provided in its planning, scheduling and pricing for disruptions including but not limited to, restricted access to portions of the site that will not be immediately available, delivery time limitations, and moratorium dates.

G. Contractor Conduct. All persons furnished by the Contractor, including subcontractors, are the sole responsibility of the Contractor. The Contractor must be responsible for their compliance with all applicable laws, rules, regulations and security clearances.

H. Account Representative. The Contractor must assign an individual to work directly with the Contracting Officer. This individual will be responsible for all matters pertaining to the contract requirements.

4. SCOPE OF WORK

A. Acceptance of Existing Equipment.

(1) In accordance with standard HVAC industry practice, this is a full-service maintenance contract. The Contractor must inspect, maintain, repair, test, and clean all of the HVAC equipment.

(2) The Contractor must accept these HVAC Systems "as is". Obsolescence is not recognized in the terms of this contract. Except as listed below, no components are excluded from the requirements of this contract.

B. Performance Requirements.

Scope of Work for ABE ATCT, RDG ATCT, ABE ASR, and RDG ASR.

General provisions:

1. Provide all labor to execute this contract. Repair and/or replace worn or defective parts and components with like when necessary to maintain and/or restore all HVAC systems in the ATCT to normal operation.

2. Provide, without limitations, 24-hour seven day a week callback response for the ATCT HVAC systems: 4 hours response for ABE ATCT, 16 hour response for RDG ATCT, next day for the ASR-11s and as directed by the COTR to maintain manageable conditions within the operations areas of ATCT facilities.

3. Provide preventative maintenance to all HVAC systems, subsystems, and support devices, as prescribed in this contract.

4. Provide all filters (MERV 13), belts and refrigerant.

5. Recover all refrigerant and maintain all records required by the EPA.

6. For any individual unit or incident of repair (i.e., per service call), the Contractor shall furnish all labor and all repair parts, sub-assemblies, assemblies, and other materials required to complete the repair up to a total maximum cost of $5000.

However, the Contractor will be reimbursed for the cost of materials to the extent that the total direct material cost exceeds $2500 per service call. Material estimated to cost more than $2500 shall not be purchased without prior approval of the Contracting Officer Technical Rep (COTR). The limitations of this paragraph do not apply to repairs required to correct damage caused by the contractor.

7. Provide all services to ensure efficient operation and reasonable employee comfort of the ABE and RDG ATCTs.

8. A downtime percentage for all HVAC systems of not more than three percent per year (based on 365 days a year/24 hrs. a day.)

Preventative maintenance:

All maintenance inspections shall follow FAA order 6970.3 and manufacture’s equipment instruction and manuals, whichever applies. Perform preventive and corrective maintenance all listed equipment and all electrical, plumbing and mechanical support devices for the HVAC systems.

Perform the following tasks.

Monthly

1. Replace TRACON filters.

2. Inspect TRACON intake grills and clean as needed.

Quarterly

1. Make general visual inspection of all operating HVAC equipment and system. Check indicators on equipment.

2. Check for any vibrations, short cycling of equipment, unusual noises, or abnormal conditions, including frayed or loose belts.

3. Check water, refrigerant, oil, or other fluid leaks from the HVAC system.

4. Check all air filters including ventilation filters. Clean and reactivate permanent types and replace disposable type in needed. (Not Leiberts.) Inspect intake grills and louvers, clean if necessary.

5. Check operating temperatures, operation of capacity safety controls, all evaporator and condensing coils, and auxiliary equipment for proper operation.

6. Check all belts for proper tension, replace any worn belt.

7. Check all motors/fans for proper operation.

8. Review system control for operation.

9. Perform any recommended maintenance directed by the manufacture’s handbooks.

Semiannual

1. Perform seasonal operation checks. (Before heating season, ensure operation of

RDG’s boiler on both gas and oil, check pressure relive valve and expansion tank for proper operation.)

2. Replace water filters and service all humidifiers.

3. Clean all coils with plain water and soap.

4. Replace Leibert filters.

5. Clean and sanitize all split duct drain/condensate pump systems.

C. Performance Standards

1. Perform preventive maintenance is as scheduled and unscheduled.

2. HVAC systems are fully operational 97% of the time.

3. Maintenance records updated upon completion of service is100% after each service call or scheduled service event.

4. Reports submitted within 5 business days is 100% submittal after each service event.

5. Unscheduled/Emergency call is 100% response time as specified in this contract D. Housekeeping.

(1) The Contractor must take all necessary precautions, to safeguard and protect all Government property with which the Contractor comes in contact while performing the contract work.

(2) The Contractor must maintain all building space and any Government-owned equipment the Contractor is authorized to use, in a neat, clean, orderly, and working condition always.

(3) The Contractor will keep Safety Data Sheets (SDS) on file with the on-site COR, for all materials it uses.

(4) The Contractor will use reasonable care to minimize the generation of waste, and will properly dispose of all waste off site. Any waste generated in the course of maintenance at a minimum will be removed from the site daily.

(5) The Contractor will use reasonable care to minimize the risks its work poses to the environment, the customers, the general public, and the contract employees.

E. Equipment Changes

The Contractor must not change or alter the existing HVAC equipment or any electrical circuits, wiring, or controls outside of the contractual terms and conditions without written authorization from the Contracting Officer. If the Contracting Officer authorizes changes, the Contractor must develop and/or make appropriate revisions to the elevator drawings and/or specifications and a copy provided to the Government. All improvements and/or changes must be documented by the Contractor during the term of this contract and must become and remain the property of the Government. Contractor must provide updated as-built drawings within 30 calendar days of the completion of any major repair work.

5. QUALIFICATIONS OF CONTRACT EMPLOYEES

A. HVAC Maintenance Technicians

(1) Qualifications. The personnel employed by the Contractor, to work on this contract, must be trained and qualified in HVAC maintenance and repair work.

(2) Licenses. Where applicable, all persons employed in a trade, craft, or profession that is licensed by state or local authorities must have the appropriate license prior to performing any contract work. The license must be of a grade or level consistent with the requirements of the work being performed. The contractor must provide appropriate documentation.

(3) The contractor technicians must be able to pass a background check and apply for a

Government PIV card so they may have unescorted entry into facilities.

6. SUPPLIES, MATERIALS, AND EQUIPMENT

A. Furnished By The Government. - NONE see note below Note: When requested by the Contractor, the Government will provide a copy of the drawings and specifications (if available) for the HVAC systems. The Contractor will keep these documents at the work site. When the contract expires, these documents must be returned to the COR.

B. Furnished By The Contractor.

(1) The Contractor must provide all labor, supplies, materials, repair or replacement parts, tools, and equipment as deemed necessary to perform the work specified in this contract efficiently and effectively.

(2) All parts replaced under the provisions of this contract must be from the original equipment manufacturer, manufactured to Original Equipment Manufacturer (OEM) specifications or equal as approved by the CO.

(3) ABE’s HVAC has a Siemens proprietary control system. The contractor will ensure the control system has the most current software revision, have a certified Siemens technician semi-annually check software for proper operation at the facility.

7. INSPECTIONS AND TESTS

A. Maintenance and Repair Inspections by Government. The Government reserves the right to make any test or inspection it deems necessary to make sure that all performance requirements are being maintained. The Contractor must complete any repairs or deficiencies specified in the inspection report within 30 calendar days. Deficiencies not corrected within the given time frame may result in withholding of payment. When all listed deficiencies have been corrected, the Contractor will sign and date the inspection report and return it to the CO. At its discretion, the Government may then re-inspect the work.

B. Contract Close-out Inspection.

(1) Within 90 calendar days prior to the expiration of the contract, the Contractor and the

COR together will inspect all HVAC systems. The Contractor will prepare an Existing Deficiency Report in conjunction with the COR that lists the deficiencies found for Government review/approval. The Contractor will correct all deficiencies that fall within the scope of this contract. The COR has the right to bring in a 3rd party inspector. The Contractor must also be responsible for latent deficiencies that are discovered after the close-out inspection. All deficiencies must be corrected within 30 calendar days of notification to the Contractor.

8. REPAIRS

A. "Repairs" are defined as unscheduled work required to prevent the breakdown or failure of the HVAC system, or to return the HVAC system back to service after a breakdown or failure.

B. The Contractor must complete all repairs within 24 hours after discovering the problem or of receiving notification that corrective action is required. The Contractor will notify the CO/COR immediately if repairs cannot be made within 24 hours. If the Contractor cannot complete the repairs within 24 hours, he/she must present, within two working days, a plan to the COR for completing the work.

C. Upon request the Contractor must furnish a record of all repairs made to the elevators, their accessories, or appurtenances.

D. Any repair work outside the scope of this contract must have prior written approval by the

CO.

9. SERVICE CALLS

A. Definition. "Service Call" is a report of an elevator malfunction made by authorized

Government personnel or designated building occupants and the Contractor's subsequent response to, and correction of, the problem.

B. Whenever called by authorized personnel (7 days per week, 24 hours per day), the Contractor must respond promptly as specified in this contract.

C. For each service call, the Contractor must provide to the COR documentation that contains the following minimum information.

(1) A description of the problem.

(2) The location of the problem.

(3) A description of the action taken to resolve the problem.

(4) The time and date corrective action was completed.

(5) The name of the person who corrected the problem.

10. PREVENTIVE MAINTENANCE

A. Definition. "Preventive Maintenance" (PM) is regularly scheduled work on the elevator(s) that the Contractor must do to accomplish the following:

(1) Ensure their safe, reliable and continued operation.

(2) Prevent breakdowns due to worn parts.

(3) Provide a comprehensive MCP.

B. Schedule. Not later than five working days before the full-service maintenance start date, the Contractor must submit to the CO/COR an annual maintenance work schedule, in accordance with the MCP. A simple schedule indicating, for example, the HVAC technician will be in a particular facility the first Tuesday of month. The purpose is to let the facility personnel know when to expect the elevator mechanic.

C. Prior to removing an HVAC system from service, the contractor must coordinate the service removal with the COR or designated facility representative. .

11. ASSESSMENT

A. Assessment Considerations. Assessment should consider and include a detailed on- site/field investigation of HVAC system, components and building spaces related to the HVAC system, design and construction (in accordance with national, state and local codes).

Proposed changes impacting the design or layout of an existing HVAC system configuration must be submitted detailing the proposed changes with the proposal package.

12. SAFETY AND HEALTH

A. Applicable Requirements. All work must comply with the applicable requirements of 29

CFR 1910/1926 and 40 CFR 761. All work must comply with applicable state and municipal safety and health requirements. Where there is a conflict between applicable regulations, the most stringent will apply.

B. Responsibility. The Contractor must assume full responsibility and liability for compliance with all applicable regulations pertaining to the health and safety of personnel during the execution of work.

C. Safety Equipment/PPE. The Contractor must provide all necessary safety equipment and ensure that equipment and all relevant safety procedures are applicable for the job being performed and are utilized properly.

13. QUALITY

Contractor will be required to submit a quality control plan including the following:

(1) Maintenance work schedule

(2) Maintenance record updates

(3) HVAC maintenance technician licensing

14. DELIVERABLES

The contractor must submit the listed required document appropriate to the Performance Work Statement as follows:

(1) Quality control plan

(2) Service call report

(3) Delayed-repair work plan.

(4) Safety Data Sheet (SDS) for all product used on-site.
