PERFORMANCE WORK STATEMENT
Septic Pumping Englebright Lake (EBL)
17 June 2025
Part A - General Information:
1. The Contractor shall furnish all labor, materials, equipment, supplies, transportation, and supervision necessary to provide Sewage Pumping Services at Englebright Lake, Nevada County, Smartsville, CA. All work, materials and equipment shall be subject to the approval of the Contracting Officer’s Representative (COR).
2. All work completed under this contract shall be performed on the days as requested by the COR. A business day is considered Monday through Friday. No work shall be conducted on days other those scheduled without prior approval from the COR. Work completed for this contract shall be accomplished between the hours of 8:00 a.m. to 4:30 p.m. Monday through Friday and not including any holidays without prior authorization from the COR.
3. In the event that any part of the service area is closed, those segments of this contract pertaining to that area may not be required and therefore not utilized. The number of facilities may vary. Contractor shall not perform work in closed areas or facilities not in use and shall not be compensated for work not accomplished.
4. This contract consists of a Base Year and four (4) Option Years.

6. Authorities/Technical Direction: The Contractor shall not take direction from any Government employee, or any person other than the Government Contracting Officer that changes the terms and conditions of this contract action, scope or impacts the cost, price, or schedule. Changes authorized by the Contracting Officer will be in the form of a written, official, signed modification to the contract action received by the Contractor before the Contractor shall act upon those changes. The Contractor shall comply with the changes clause of this contract when the Contractor believes direction has been given from persons other than the Government Contracting Officer that equate to a change by notifying the Contracting Officer as directed by the clause. Any direction given by any Government employee or any other person outside their authority must be reported to the Contracting Officer. The Contracting Officer's Representative (COR) is limited to the authorities stated in the COR appointment letters.
7. Invoices & Payments: The Contractor shall be paid after the completion of specified services for the amount of work accomplished. Invoices shall be verified by the COR before payment can be authorized. Invoices shall be sent in arrears WITHOUT all required information including any necessary supporting documentation to the following address:

Final payment shall be authorized when the COR approves the work as complete and contractor removes all materials, equipment, supplies, transportation, and all reporting requirements have been met. All invoices must reflect contract number and final invoice shall be marked “FINAL”.
8. Pre-work Conference: A pre-work conference between the Contractor, his/her representatives, supervisors, workers, etc. and the COR shall be scheduled prior to the start of any work at the respective sites. Contractor shall submit to the COR, all required reports, plans, permits, licenses, and other items outlined in this contract.
Part B – Contractor Responsibilities:
1. General Information: The Contractor shall provide all labor, equipment, materials and supplies necessary to perform all Sewage Pumping Services at Englebright Lake. The pumping service will include 4 vaults/holding tanks as listed below.
a. Joe Miller Restroom is a 5,500 gallon holding vault
b. Barge Sewage Tank is a 1,200 gallon holding tank
c. Narrows CXT restroom is a 1,000 gallon holding vault
d. Rice’s Crossing CXT restroom is a 1,000 gallon holding vault
2. The contractor is liable for all damage to property, equipment, and landscape features in performance of this work. Any such damage shall be immediately reported to the COR and repaired at the contractor’s expense.
3. Safety: All work shall be performed in accordance with safety requirements set forth in the
Corps of Engineers Safety Manual, EM 385-1-1. Copies are available at https://www.usace.army.mil/Missions/Safety-and-Occupational-Health/Safety-and-Health- Requirements-Manual/.
4. Sewage Pumping Services: The basic pumping service shall consist of pumping the tank(s) or vault(s) empty at the request of the Operation Project Manager. Disposal of sewage waste materials shall be accomplished off-site and in accordance with all applicable State and County sanitation regulations.

5. Environmental Protection: In addition to the safety requirements, the contractor will also comply with Environmental Protection requirements.
6. Equipment: All equipment shall have all safety features intact and in operating condition.
All equipment must be suitable for use on the described project and is subject to the acceptance of the COR.
7. Report: The contractor will supply the Operations Project Manager with a copy of the disposal manifest to document the total number of gallons pumped. The manifest shall be included with the Contractor’s invoice.
8. Exposure Data Report: The Contractor shall submit a Safety Exposure Report, CESPD
Form 94, to the Operations Project Manager with each service invoice. See Attachment 1 for Form 94. It shall be the Contractor’s responsibility to provide additional copies.
9. Hazardous Waste/Hazardous Spill Notification: The Contractor shall immediately notify the Operations Project Manager of any hazardous waste spills. All waste material that is spilled in performing the duties of this contract shall be cleaned from government property and disposed of at an approved waste disposal site. The contractor shall comply with all federal state and local guidelines as they pertain to the proper removal, and disposal of waste material if a spill occurs during the performance of this contract specifications.
10. Contractor Furnished Supplies and Materials: The Contractor shall furnish all supplies and materials to be consumed or incorporated in the execution of this contract. The Contractor shall be responsible for maintaining an adequate supply of materials each working day as necessary for performing the project as described. The Contractor shall mobilize and perform the installation of equipment after pads and all electrical work is completed.
Part C – Work To Be Performed:
1. Sewage pumping of two (1) holding tank and three (3) holding vaults
Part D – Quality Assurance Surveillance Plan (QASP)
1. Monitoring Performance. During the course of the evaluation period, the COR will track Contractor performance. Interim (mid-term) evaluations may be provided to identify strengths and weaknesses in the Contractor's performance during the period being evaluated. At the end of the period, the COR will assess the Contractor's performance in accordance with the Quality Assurance Surveillance Plan (QASP) and report to the Contracting Officer.
2. Contractor Self-Assessment. Following each evaluation period, the Contractor may provide a written self-assessment of its performance to the COR to be considered in its report to the Contracting Officer. The self-assessment shall be submitted not later than 5 working days after the end of each evaluation period. The self-evaluation shall not exceed 1 page per PRS element. The self-assessment shall address both the strengths and weaknesses of the Contractor's performance during the evaluation period. Where deficiencies in performance are noted, the
Contractor shall describe the actions planned or taken to correct such deficiencies and avoid their recurrence. The self-assessment itself will NOT be the basis for the payment re-calculation determination.
3. COR Recommendation. The COR will consider all evaluations and any other pertinent information, including Contractor self-assessment, and will prepare a report to the Contracting Officer with findings and recommendations. The Contractor will be provided a copy of the draft findings and recommendations of the COR and will be afforded the opportunity to identify factual errors. The COR's draft recommendation is not subject to negotiation and the COR will not engage in discussions with the Contractor. Any errors identified by the Contractor will be addressed by the COR in its final report. The Contractor will be provided a copy of the final COR report at the same time the report is submitted to the Contracting Officer.
4. The Quality Assurance Surveillance Plan is one evaluation method the Government uses to surveillance performance to determine whether the Contractor meets the standards of performance as defined in the PWS. The absence of a QASP for any contract requirement, however, shall not detract from its enforceability or limit the rights or remedies of the Government under any other provision of the contract in determining the quality of the Contractor performance.

Part E – AT-OPSEC
1. General Security requirements and guidance: The security requirements described below apply to all contract personal Including employees of the prime contractor) and all subcontractor employees supporting the performance requirements of this contract. The contractor is responsible for compliance with these security requirements. Questions regarding security matters shall be addressed to the designed Government representative (Contracting Officer Representative (COR) Requiring Activity (RA) representative, or Contracting Officer if a COR or other RA representative is not appointed. Contract personnel are critical to the overall security and safety of US Army Corps of Engineers (USACE) installations, facilities and actives and security awareness training contributes to those efforts. The Department of Defense DOD and Army security training requirements specified below, if applicable, are performance requirements, all applicable contract personal shall complete initial training within 30 days of contract award or the date new contract personal being performance on the contract. Within 5 business days from the completion of training, the contractor shall provide written documentation email or memorandum to the government representative. The documentation shall include the names of contract personnel trained and which training they completed, the contractor shall maintain training records as part of their contract files and be prepared to provide copies of training certificates to the government representative. Contractor personnel and vehicles are subject to search when entering federal installations. Additionally, all contract personnel shall comply with Force Protection Condition FPCON measures, Random Antiterrorism Measures commonly referred to as RAMs, and Health protection Condition HPCON measures. The Contractor us responsible for meeting performance requirements during elevated FPCON and HPCON levels in accordance with applicable RA plans and procedures, this includes identifying mission essential and on mission essential personnel. In addition change, the government may implement security changes that affect contract personnel. The contractor shall ensure all contract personnel are aware of their security responsibilities, including any site-specific requirements identify in local polices or procedures.
2. Antiterrorism AT Level Training. All contract personnel requiring routing access to Army installations, facilities, and controlled access areas, or requiring network access shall complete initial and annual refresher AT Level 1 awareness training. 3. Physical security and access control requirements: All contract personnel requiring physical access to a federal installation or facility shall comply with the access control procedures of that location.

Contract personnel requiring unescorted access to meet contract performance requirements on a DoD installation in the US shall be vetted by the installation/facility Provost Marshall Directorate of Emergency Services Security Office using the National Crime Information Center Interstate Identification index and Terrorist Screening Database. Contract personal shall comply with all personal identity verification requirements specified in installation facility policies and procedures. Contract personnel who do not meet requirements for unescorted access to USACE facilities shall coordinate escorted access with Government representative, as needed. Contract personnel who receive keys, access cards, or lock combinations that provides access to government owned property shall comply with key and lock control procedures of the RA.
4. Suspicious Activity Reporting training (e.g IWATCH, CorpsWatch, or see something, say something): All contract personnel shall receive initial and annual refresher training from the RA representative on the local suspicious activity reporting program. This locally developed training provides contract personnel with general information on suspicious behavior, and guidance on reporting suspicious actively to the project manager, security representative or law enforcement entity.
5. Pre-screen candidates using E-Verify Program. Contractors shall comply with requirements set forth in FAR clause 52.222-54 Employment Eligibility Verification and FAR Subpart 22.18 in using the E-Verify Program at https://e-verify.gov/ to meet the contract employment eligibility requirements.
Contractors are encouraged to cooperate with Federal and State agencies responsible of enforcing labor and requirements to include eligibility for employment under the under United States immigration laws n accordance with FAR 22.102-1(i). An initial list of verified eligible candidates shall be provide to the COR no later than 3 business days after the initial contract award. When contracts are with individuals, the individuals will be required to complete a Form 1-9, employment eligibility verification and submit to the contracting officer to become part of the official contract file.
