Fontana Unified School District (“District”) will award a contract to one or more responsible proposers with the
“highest scored,” responsive proposal, giving appropriate consideration to the evaluation factors stated herein.
The District reserves the right to make an award to other than the lowest priced proposal. Price alone will not be the sole determining factor in the selection process. Award will be based on the highest number of points given during the evaluation process as indicated in the Evaluation Criteria included in the proposal documents. The decision resulting from the evaluation process as to which proposal best meets the needs of the District remains the sole responsibility of the District and is final. The contract to be entered into by the vendor is set forth in the proposal documents as the “Purchase Agreement Form” and is also referred to herein as the “Contract”.
In the event an award is made to a proposer/s, and such proposer fails or refuses to execute the contract and provide the required documents within five (5) calendar days after notification of the award of the contract to proposer, the District may award the contract to the next lowest responsible and responsive proposer or release all proposers.

Such causes may include: acts of God or of the public enemy, acts of the Government, fires, floods, epidemics, quarantine restrictions, strikes, freight embargoes, or unusually severe weather.
