About this file

This file is a comprehensive list of Provisions and Clauses incorporated by reference or in full text for federal contract compliance, establishing the legal and regulatory framework for the solicitation.

The document outlines mandatory Federal Acquisition Regulation (FAR) and Defense Federal Acquisition Regulation Supplement (DFARS) provisions applicable to commercial items procurement, covering critical areas including ethics and compliance (gratuities, anti-lobbying, confidentiality restrictions), system requirements (System for Award Management registration and maintenance), contractor responsibility and debarment checks, small business utilization with a 50 percent subcontracting limitation for supplies contracts, employment and labor standards (equal opportunity, anti-trafficking, employment eligibility verification), environmental and safety requirements (pollution prevention, hazardous materials prohibition, hexavalent chromium restriction), Buy American compliance, export control restrictions, payment procedures (electronic funds transfer via Wide Area WorkFlow with specific routing data and DoDAAC codes), and dispute resolution processes. Key evaluation criteria specify that award will be made to the lowest price technically acceptable offeror based on technical acceptability and delivery schedule compliance. The solicitation incorporates an unfunded requirement notice (FAR 52.232-18) stating that Government obligation is contingent upon appropriated funds availability and formal written notification to the contractor. The contract terms apply to the Rapiscan MINI Z System procurement for the New York Army National Guard, a firm-fixed-price commercial items acquisition processed as a Request for Quotation under the FAR Overhaul framework.

(a) The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

Award will be made to lowest price technically acceptable.

Technical Acceptability: The quote must demonstrate that the proposed equipment meets all salient technical characteristics.

A written notice of award or acceptance of an offer, furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
