About this file
This file is a Request for Information (RFI) containing three questions and answers related to a solicitation for Rapiscan X-Ray Backpack systems issued by the New York Army National Guard (Solicitation Number: PANNGB26P0000040198). The solicitation is a total small-business set-aside incorporating FAR clauses 52.219-6 and 52.219-14 for the procurement of a Rapiscan MINI Z 140HP Handheld Z Backscatter Screening System (Part Number: 369-0500-EN-01) with accessories, operator training, and installation services.
The RFI addresses three key procurement questions: (1) clarification regarding whether small-business nonmanufacturers may offer Rapiscan products under the nonmanufacturer rule, with the Government's response indicating exceptions apply and reference to SAT requirements; (2) confirmation that manufacturer-issued certifications regarding hardware and components not being manufactured, assembled, or sourced from the People's Republic of China may be satisfied through submission of a qualified SAM 889 certification in the SAM.GOV entity profile; and (3) verification that installation and commissioning under CLIN 0002 may be performed by either Rapiscan Systems directly or an authorized Rapiscan installation partner, provided the company supplies proof from the manufacturer. Amendment 1 incorporating this RFI established a new close date of September 9, 2026. The contract is structured as a Firm-Fixed-Price award for commercial items with an unfunded requirement notation under FAR 52.232-18.
