About this file
This file is a Provisions and Clauses document for a commercial items solicitation (RFQ F9E0CC6168AW01) issued by the 106th Rescue Wing of the New York Army National Guard for the acquisition of a vital signs/defibrillator monitor. The document incorporates by reference and provides full text of standard Federal Acquisition Regulation (FAR) and Defense Federal Acquisition Regulation Supplement (DFARS) clauses, along with Air Force-specific clauses applicable to commercial products and services acquisitions. Key contractual provisions include representations and certifications requirements (system for award management, responsibility matters, small business status, tax compliance), compliance obligations (combating trafficking in persons, employment eligibility verification, environmental standards, export controls, security prohibitions), and administrative procedures (disputes, protests, payment methods via WAWF electronic invoicing). The solicitation incorporates a total small business set-aside under FAR 52.219-6, includes limitations on subcontracting for small businesses at 50 percent, and requires contractor compliance with antiterrorism training, base access procedures through F.S. Gabreski Air National Guard Base with DBIDS badges, and escort requirements for high-security areas including the BDOC and cryptographic facilities. Payment will be processed through DFAS Columbus with electronic invoicing submission required, and award will be made to the responsible offeror whose offer is most advantageous to the Government based on technical acceptability of equipment compatibility with the Advantor Access Control System and delivery schedule adherence.

(a) The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
1. Technical Acceptability: The quote must demonstrate that the proposed equipment meets all salient technical characteristics of the Advantor Access Control System (ACS) and is fully compatible with the existing base-wide ASN headend at BDOC.
2. Delivery Schedule: The contractor must meet the required delivery and installation time frames outlined in the Statement of Work.
(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. (c) Notice of award. A written notice of award or acceptance of an offer, furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
