The lease term is negotiable and must specify the number of years for the initial term and any renewal periods, with renewal terms subject to mutual agreement by both parties.
Pricing shall be structured as a minimum annual base rent for year one, with annual increases beginning in year two at a minimum rate of 2 percent for the lease term and any renewals. Proposers may also propose a revenue-sharing arrangement as additional rent, calculated as a percentage of gross revenues exceeding a specified threshold, with the frequency of revenue-sharing payments to be defined by the proposer. The State reserves the right to negotiate final rental structure terms, including base rent, revenue-sharing percentage, revenue threshold, annual adjustments, and other economic terms, and is not obligated to accept the highest proposed rental amount. Selected proposers must register as a legal entity under North Carolina law before placement on the Council of State agenda. Proposals will be evaluated based on desirability in complementing the Piedmont Triad Farmers Market operation, the proposer's demonstrated ability to execute the proposal, demonstration of sufficient funds, the rent amount offered, and all relevant factors affecting public interest. Compliance with North Carolina General Statute 133-32 and Executive Order 24 regarding gifts from State employees is required.
