About this file
This is a Prohibition on Certain Telecommunications and Video Surveillance Services or Equipment certification form required for the City of Gainesville's Regional Transit System (RTS) bus shelters and amenities procurement in Florida. The RTS solicitation seeks competitive bids for seven line items including bicycle racks, trash receptacles, benches, and two types of shelters (Type II and Type III) to be installed at bus stops. Bidders must provide unit pricing for 1-5 and 6-10 piece volumes with estimated annual purchases ranging from one to ten shelters. The question submission deadline is January 27, 2026, with bid responses due February 18, 2026, at 3:00 p.m. All deliveries must occur within 8-12 weeks of purchase orders. The contract term extends from execution through September 30, 2028, with an optional one-year extension, and all pricing must remain firm throughout the period.
This federally-funded procurement through the Federal Transit Administration with a purchase value exceeding $150,000 requires bidders to certify compliance with the John S. McCain National Defense Authorization Act for Fiscal Year 2019, which prohibits procurement of covered telecommunications equipment or services. Bidders must complete a due diligence review of their supply chain and warrant that no prohibited equipment or services will be provided. The solicitation includes a 6.75% overall Disadvantaged Business Enterprise (DBE) agency goal with bidders required to be currently listed in the Florida Unified Certification Program DBE Directory to claim DBE status. Additional mandatory compliance includes civil rights certifications, equal employment opportunity compliance, E-Verify usage, debarment status verification, drug-free workplace compliance, and lobbying restrictions. Contractors must demonstrate financial stability, provide installation instructions and manufacturer literature with deliverables, supply structural drawings from a Florida-licensed professional engineer, and guarantee replacement parts availability for at least ten years post-delivery.

PROHIBITION ON CERTAIN TELECOMMUNICATIONS AND
VIDEO SURVEILLANCE SERVICES OR EQUIPMENT
BIDDER/PROPOSER hereby acknowledges that the John S. McCain National Defense Authorization Act for Fiscal Year 2019, Pub. L. 115232, § 889 (Aug. 13, 2018) (the Act) prohibits the Agency from procuring certain “covered telecommunications equipment or services,” as defined in the Act, in federally assisted procurements and that the instant procurement is a federally assisted procurement subject to that prohibition. BIDDER represents and warrants that it has performed a due diligence review of its supply chain and that no such “covered telecommunications equipment or services” shall be provided to the Agency that would cause the Agency to be in violation of the prohibition contained in the Act.
