About this file

This document is a procurement policy file from the Abandoned Mine Land (AML) Division related to contracting preferences for coal industry employees under Section 40701 of the Bipartisan Infrastructure Law. The policy applies to AML construction projects valued over $100,000, with a primary goal of awarding contracts to the lowest responsible bidder while providing employment opportunities for current and former coal mine workers.

The procurement policy offers a unique bidding preference mechanism where qualified contractors who employ at least two former coal mine employees can receive contract priority. Specifically, if a bidder can demonstrate employment of two former coal mine employees and the bid is not more than 2% higher than the lowest bid, they may be given preference in contract award. Bidders must provide proof at the time of bid that current employees include former coal mine workers and that these employees will be utilized in the AML Reclamation project or commit to employing at least two former coal mine employees.

Preference to Contractors that Employ Current and/or Former Employees of the Coal Industry In accordance with the requirements of Section 40701 of the Bipartisan Infrastructure Law (also known as the Infrastructure Investment and Jobs Act). P.L. 117-58, priority may also be given to reclamation projects described in subsection (b)(1) that provide employment for current and former employees of the coal industry.

Potential bidders of an Abandoned Mine Land (AML) construction project with a total value of more than $100,000 are eligible to utilize Procurement Code 30 ILCS 500/45-110.

It is the policy of the AML Division to award a contract to the lowest responsible bidder. If another qualified bidder can fulfill the contract through the use of at least 2 former coal mine employees, then this bidder may be given preference over other bidders if the bid is not more than 2% greater than the low bid.

At time of bid, Qualified bidders will need to provide proof that at least 2 current employees of the bidder are former coal mine employees and that all such declared former coal mine employees in the bid shall be used in the fulfillment of the awarded AML Reclamation project or commits to employing at least 2 former coal mine employees.
