PRF76 Contract User Guide Summary
This is a Contract User Guide for PRF76, a statewide contract administered by the Massachusetts Operational Services Division (OSD) in collaboration with the Department of Family and Medical Leave (DFML) to procure management consulting, program coordination, and planning services. The contract encompasses nine service categories: Education Services, Program Development and Organizational Planning, Professional Development Services, General Data Analytics and Evaluation Services, Downtown/Town Center Revitalization Consulting, Planning and Zoning Development Consulting, DESE Facilities and Operations Technical Assistance, Health and Human Services, and Specialized Racial and Health Equity Services. The current contract term runs from October 1, 2022 through September 30, 2027, with a potential maximum end date of March 30, 2030 and a possible two-year extension through September 2029 for current vendors. The contract is structured as a fee-for-service arrangement where compensation is determined on a project-by-project basis through individual Statements of Work (SOW). For purchases of $10,000 or above, buyers must solicit quotations from all eligible vendors with a minimum of three responses required; purchases under $10,000 are discretionary. Eligible users include cities, towns, districts, counties, executive and legislative branches, public authorities, public libraries, school districts, public hospitals, institutions of higher education, certified non-profit organizations, and other entities designated by the State Purchasing Agent.
The contract includes approximately 150 pre-qualified vendors offering competitive pricing with prompt payment discounts ranging from 0.25% to 7% depending on payment timing. Several vendors hold Supplier Diversity certifications including Minority-Owned Business Enterprise (MBE), Women-Owned Business Enterprise (WBE), Disadvantaged Business Enterprise (DBE), and Small Business Purchasing Program (SBPP) certifications, with commitment percentages varying by vendor. All purchases must be referenced using the MMARS Master Agreement number PRF76 with an asterisk in the system. Payments for services must be made within 45 days per Massachusetts Bill Payment Policy, with no prepayment, sales tax, or additional fees permitted unless specifically agreed upon in the SOW. The contract eliminates the need for individual solicitations by providing pre-negotiated terms and conditions, simplified procurement processes, and leverages the Commonwealth's purchasing power to provide cost savings and vendor management oversight through two category managers: Hayley Lebert (617-720-3146) and Gerry Dawson (978-429-4512).

· For purchases of $10,000 and above, Buyers are required to solicit quotations from all eligible vendors and obtain a minimum of three (3) responses. This ensures a competitive bidding process and helps the Buyer find the best possible value for their purchase. A “no bid” response is considered an acceptable response.
· For purchases under $10,000, soliciting quotes is at the discretion of the Buyer. However, before making a purchase, Buyers should consult with their Chief Purchasing Officer or equivalent authority.
Purchase Options This is a fee-for-service contract.
Quote Solicitation: Buyers can solicit quotes from multiple vendors (see the Vendor MBPO Listing award vendors, and place orders through COMMBUYS. A solicitation-enabled contract allows the buyer to solicit quotes from vendors who have Master Blanket Purchase Orders (MBPOs) or Statewide Contracts in COMMBUYS. The buyers can create a solicitation-enabled bid using a release requisition, converting the requisition to a bid, and then requesting quotes from eligible vendors.
See the How to Request Quotes from Vendors on Statewide Contracts job aid for more details.
Extend Beyond (Performance and Payment That Goes Beyond Contract End Date) The extend beyond period is primarily used to aid the transition between an expiring contract and its replacement by allowing time for new agreements to be established with newly awarded vendors.
For extend beyond, the following stipulations are in place:
· Buyers cannot enter into any written agreement that will go more than six (6) months beyond the maximum end date of the contract. Existing services may be completed and payments made during this period.
· No new agreements, including leases, rentals, or service contracts, may be made after the contract's expiration.
Setting Up a COMMBUYS Account COMMBUYS is the Commonwealth of Massachusetts' e-procurement platform, serving as a central marketplace for state agencies and other eligible entities to procure goods and services, connecting government buyers and businesses. It aims to streamline the purchasing process, ensuring transparency and efficiency in the procurement process.
For Executive Agencies, COMMBUYS is required. Per 801 CMR 21.00, Executive Agencies must use established Statewide Contracts (SWCs) for the purchase of products and services. To set up a COMMBUYS buyer account or to update an existing agency account, the buyers must email the OSD Help Desk or call 1-888-627-8283.
While COMMBUYS use is not mandated for Non-Executive Agencies and other eligible entities, it is highly recommended to streamline the procurement process and assist buyers in making informed purchasing choices. Eligible entities should follow their internal guidelines for COMMBUYS use.
Finding Contract Documents Buyers may view contract documents (including Contract User Guides, Request for Response, Prompt Payment Discount Form, specifications, and other attachments) on COMMBUYS without requiring a COMMBUYS account or logging in.
