About this file

This document is a set of guidelines for Weekly Payroll Records and Statement of Compliance required for public works projects in Massachusetts. It outlines the legal requirements for contractors and subcontractors to maintain accurate records of all persons employed on the project and submit weekly payroll reports to the awarding authority. Contractors and subcontractors must preserve these records for three years after completion of the contract, and provide a signed Statement of Compliance attesting that all workers have been paid in accordance with the prevailing wage rates. The awarding authority is also required to preserve the payroll records for three years.

The document provides the format for the Weekly Payroll Records Report and the Statement of Compliance, and specifies that a photocopy of the apprentice's identification card must be attached to the payroll report for any week an apprentice is employed. This ensures compliance with Massachusetts General Law c. 149, 27B regarding prevailing wage requirements on public works projects.

WEEKLY PAYROLL RECORDS REPORT

& STATEMENT OF COMPLIANCE

DIVISION OF OCCUPATIONAL SAFETY, 19 STANIFORD STREET, 2nd FLOOR, BOSTON, MA 02114

In accordance with Massachusetts General Law c. 149, §27B, a true and accurate record must be kept of all persons employed on the public works project for which the enclosed rates have been provided. A Payroll Form has been printed on the reverse of this page and includes all the information required to be kept by law. Every contractor or subcontractor is required to keep these records and preserve them for a period of three years from the date of completion of the contract.

In addition, every contractor and subcontractor is required to submit a copy of their weekly payroll records to the awarding authority. For every week in which an apprentice is employed, a photocopy of the apprentice’s identification card must be attached to the payroll report. Once collected, the awarding authority is also required to preserve those records for three years.

In addition, each such contractor, subcontractor, or public body shall furnish to the awarding authority directly, within fifteen days after completion of its portion of the work a statement, executed by the contractor, subcontractor or public body who supervises the payment of wages, in the following form:
