About this file
This is a Single Source Determination document using Simplified Acquisition Procedures (SAP) for a federal contract action not exceeding the Simplified Acquisition Threshold.
The Department of Commerce's National Oceanic and Atmospheric Administration (NOAA), specifically the National Marine Fisheries Service (NMFS) Northeast Fisheries Science Center in Milford, Connecticut, requires specialized engineering services, maintenance, system upgrades, and parts replacement for existing facility infrastructure, including water filtration system maintenance. The contract type is Firm-Fixed-Price (FFP). The single source identified is Burt Process Equipment, LLC, located at 100 Overlook Drive, Hamden, Connecticut 06514. The justification for single-source procurement is based on compatibility and capability to the existing systems: the laboratory's current infrastructure was originally engineered, custom-designed, and commissioned by Burt Process Equipment, LLC, and relies on proprietary configurations, specialized mechanical/electrical layouts, and integrated software logic unique to their design. Only Burt Process Equipment possesses the original design specifications, baseline design data, blueprint schematics, and technical expertise necessary to service and maintain the system without introducing operational risks or voiding equipment integrity. Market research confirmed that no other vendors possess the original design specifications or proprietary system knowledge required for this specific custom-built system. The technical/requirements representative certified that this requirement constitutes the government's minimum needs, and a determination was made that only one source is reasonably available.

SINGLE SOURCE DETERMINATION USING
SIMPLIFIED ACQUISITION PROCEDURES (SAP)
FOR AN ACTION NOT EXCEEDING THE SIMPLIFIED ACQUISITION THRESHOLD
(AUTHORITY: FAR 13.106-1(b)(1))
REQUIREMENTS-26-0122 / 143021-26-0122
1. Agency and contracting activity. Department of Commerce, NOAA, National Marine Fisheries
Service (NMFS), Northeast Fisheries Science Center (NEFSC), Milford, CT Lab.
2. Description of supplies or services required to meet agency needs (including the estimated value). The Milford, CT Laboratory requires specialized engineering services / maintenance / system upgrades / parts replacement -( e.g., water filtration system maintenance) for the existing facility infrastructure system. The intended use is to ensure continuous, uninterrupted laboratory operations and maintain standard compliance.
Period of Performance / Delivery Date:
● Contract Type Planned: Firm-Fixed-Price (FFP)
3. Identification of the single source to be solicited.
Burt Process Equipment, LLC
100 OVERLOOK DR,
HAMDEN, CONNECTICUT 06514
4. Supporting rationale. Only one source or brand name is reasonably available as detailed below:
Other - Only one source is capable/compatibility to existing systems or equipment: The required services and supplies must be compatible in all aspects (form, fit, and function) with the existing laboratory infrastructure system, and the source is uniquely qualified to meet the requirement. The current system was originally engineered, custom-designed, and commissioned by Burt Process Equipment, LLC. Because of this, the system relies on proprietary configurations, specialized mechanical/electrical layouts, and integrated software logic unique to their design. Introducing an outside vendor to modify or service this infrastructure would introduce significant operational risks, potential system mismatches, and void existing equipment integrity. Burt Process Equipment, LLC possesses the unique technical expertise, baseline design data, and original blueprint schematics necessary to interface seamlessly with the existing equipment without interrupting critical lab operations.
143021-26-0122
Therefore, to ensure uninterrupted critical lab operations and equipment compatibility, Burt Process Equipment is the only reasonably available source.
5. Market Research.
Market research was conducted by reviewing historical procurement data, searching the Small Business Administration (SBA) Dynamic Small Business Search, and evaluating similar industry vendors. While other general equipment or service vendors exist in the marketplace, this research confirmed that no one possesses the original design specifications, proprietary system knowledge, or direct compatibility assurance required for this specific, custom-built Burt Process system.
Consequently, Burt Process Equipment, LLC is the only reasonably available source capable of fulfilling the government's minimum requirements without causing substantial duplication of costs or unacceptable operational delays.
6. Technical/Requirements Representative Certification
I certify that this requirement constitutes the Government’s minimum needs and the supporting data provided herein is accurate and complete to the best of my knowledge and belief.
7. Determination
I hereby determine that the circumstances of this action deem only one source is reasonably available. This determination is accurate and complete to the best of my knowledge and belief.
