JUSTIFICATION AND APPROVAL (J&A)
FOR OTHER THAN FULL AND OPEN COMPETITION
FAR Part 6.3
1. Identification of the agency and the contracting activity:
The Department of State Office of Acquisition Management, Regional Procurement
Support Office-Frankfurt (RPSOFR) is conducting this acquisition of other than full and open competition for an Automated Biometric Identification System on behalf of the
Bureau of Narcotics and Law Enforcement Affairs (INL).
2. Nature and/or description of the action being approved.
A new purchase order will be issued on a brand name basis to procure 3M Cogent’s
Automated Biometric Identification System (CABIS) and associated services on a firm fixed price basis as a part of an upgrade to an existing 3M Cogent’s Automated
Fingerprint and Palm Print Identification System (CAFIS) owned by the Republic of
Kosovo’s Agency on Forensic (AKF). Such upgrade will satisfy all AKF’s functional requirements and will enable the implementation of the system within twelve (12) months with minimal risk by ensuring full compatibility, as well as interoperability.
3. A description of the supplies or services required to meet the Department’s needs.
The requirement is to provide “Automated Biometric Identification System” ABIS in the
Republic of Kosovo at all regional and border locations. In order to ensure maximum compatibility, and interoperability between the existing system and the upgrade, such supplies and services need to be supplied on a brand name basis. This will allow the AKF to accomplish its mission objective.
The system being procured will include the following components:

4. An identification of the statutory authority permitting other than full and open competition.
This acquisition is conducted under the authority of 41 U.S.C. 3304, as implemented by
FAR 6.3 and substantiated by the following:
☒ FAR 6.302-1 – Only one responsible source and no other supplies or services will satisfy agency requirements.
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the action require use of the authority cited.
3M Cogent’s Automated Biometric Identification System (CABIS) is a commercial, off-the-shelf software application for large-scale, distributed biometric identification systems. The system has customizable workflows allow easy integration with industry-standard biometric recording workstations/devices and with external systems that is uniquely qualified to provide these services to the Kosovo Forensic Agency based upon the following:
A multifactor, scalable, and customizable software package that allows users to perform a wide range of tasks for processing, editing, searching, retrieving, and storing biometric images and subject records.
One of the most accurate systems in the world, and a software familiarity to the current operators with more than 15 years.
Fully interoperable and compatible with existing backup system.
6. A description of efforts to ensure that offers were solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies.
As this is a brand name justification, offers will be solicited from as many potential sources as possible. This brand name justification will be included with the combined synopsis/solicitation.
7. A determination by the ordering activity Contracting Officer that the anticipated cost to the Government is fair and reasonable.
The Contracting Office determines that the anticipated price(s) will be fair and reasonable based on competition. By signing the justification the Contracting Officer makes a determination that the price to the Government are expected to be fair and reasonable.
8. A description of the market survey conducted (see Part 10) and the results or a statement of the reasons a market survey was not conducted.
Based on past acquisition history within the last twelve (12) months for similar requirements, the Contracting Officer expects there will be competition, even with a brand name justification, since there are several authorized resellers.
9. Any other facts supporting the use of this justification.
None.
10. A listing of any sources that expressed a written interest in the acquisition.
None.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
The requirement will be competed among as many potential sources as possible with an estimated purchase order award early January 2018.
