About this file

This document is a Formal Questions and Answers file for the Jakarta ISP Consolidation solicitation (191D3226R0008) issued by the U.S. Embassy Jakarta.

The Q&A clarifies key contract terms and submission requirements for prospective bidders. The Government may elect either a single or multiple contract award, with the solicitation amended to reflect this flexibility. DBA (Defense Base Act) insurance is mandatory for all workers assigned to the project and must be included in total quoted prices, though not as a separate line item; local Indonesian workers' compensation insurance (BPJS Kesehatan) may supplement but cannot substitute for DBA coverage. Additional guidance addresses cybersecurity requirements found in Section 3 and Section 4 of the solicitation, with detailed information in the State Department Secure Software Development Attestation Form (Attachment 1) and C-SCRM Questionnaire (Attachment 2). For foreign entities, completion of IRS Form W-14 is required to ensure compliance with FAR 52.229-11 regarding the 2% excise tax on certain foreign contracts; the form must include company identification information and verification of tax exemption status, signed by an authorized company representative. Complete quotation packages must include SF-1449, Section 1 Pricing, Section 5 Representations and Certifications, additional information per Section 3, IRS Form W-14, SAM Registration proof, and C-SCRM Questionnaire and Software Producer Attestation Form; failure to submit all required documents will result in disqualification, and late or incomplete packages will not be reviewed.

Jakarta ISP Consolidation 191D3226R0008

Formal Questions and Answers

The following questions reflect inquiries received from prospective bidders and the U.S. Embassy Jakarta's responses regarding this solicitation.

1. During the pre-proposal meeting, it was mentioned that this solicitation is for multiple award vs single award contract. However, Section 4 of the solicitation says: The Government intends to establish a single contract award. Please clarify if there will be one contractor selected, or multiple contractors be considered for different categories.

The Government may elect for a single or multiple contract award.

The solicitation is amended reflecting this change.

2. Related to the Cybersecurity Requirements, The Department of State’s Secure Software Attestation, and C-SCRM questionnaire are on our attention, but are there any specific red flags or must-haves we should focus on to meet your standards?

The relevant instructions and requirements can be found in Section 3 (Solicitation Provisions) and Section 4 (Evaluation Factors) of the solicitation, with additional detailed information provided in Attachment 1 (State Department Secure Software Development Attestation Form) and Attachment 2 (C-SCRM Questionnaire).

3. The Indonesian Government has workers’ compensation laws whereby employers provide mandatory health insurance (BPJS Kesehatan) for all employees. Do we still need to purchase DBA insurance?

Yes, DBA insurance is mandatory. Local insurance may supplement but not substitute for DBA coverage.

4. Do I need to include DBA insurance costs in my quote?

Yes. Offerors must include the cost of the DBA insurance policy to the total prices quoted - taking into account the number of workers assigned to the project. However, please do NOT put the cost of the DBA as a separate line item on the price schedule.

5. Where can I find out more about DBA insurance?

You can find out more about DBA insurance at the Department of Labor’s Division of Longshore and Harbor Workers' Compensation (DLHWC) web page at this link:

https://www.dol.gov/agencies/owcp/dlhwc/FAQ/DBAFaqs

6. Based on the solicitation, the IRS Form W-14 ("Certificate of Foreign Contracting Party Receiving Federal Financial Assistance") is required to ensure compliance with FAR 52.229-11, which imposes a 2% excise tax on certain foreign contracts. Please provide the guidance on what to complete on the form so our company as a foreign entity can be exempted from this 2% tax?

Here is how to complete and submit the W-14 for U.S. Embassy solicitations:

Steps to Complete Form W-14

1). Download the form: Obtain the latest version of Form W-14 and its instruction directly from the IRS website at www.irs.gov/w14.

2). Part I (Identification): Enter your company's full legal name, address, and Employer Identification Number (EIN) or Foreign TIN if you have one.

3). Part II (Compliance): This is the most crucial part. You are generally affirming that you are a foreign person/entity and verifying whether you are exempt from the 2% tax under FAR 52.229-11.

4). Sign and Date: The form must be signed by an authorized representative of the company.

7. How does a complete quotation package look like to be accepted by the Embassy?

To submit an offer or quotation, you must follow the instructions in Section 3 of the Solicitation; complete the required sections of the attached document(s); and submit a comprehensive offer package in a single email on or before the due date, according to the instructions below. Failure to follow any of the instructions will disqualify your proposal from being reviewed. Under no circumstances will late or incomplete packages be reviewed.

Packages must be complete to be considered for award. Failure to complete or submit a required document or element will result in the offer being determined incomplete and will result in disqualification.

You should carefully review the requirements in the full Solicitation as well as all supporting materials, to include this cover letter.
