STATEMENT OF WORK

(Potawatomi Allotment Tree Shearing Project-2021)

The following services to be provided for:

Bureau of Indian Affairs – Horton Agency, Attn: Wally Leander (Project Manager) 785-486-2161 or 785- 288-0884 cell#

Purpose:

Cut/shred at ground level all undesirable trees (locust, hedge, cedar, elm, mulberry, dogwood, etc.) less than 14” +/- diameter within the designated area on attached map

Location:

There are four (4) allotments located on the Potawatomi Reservation, Mayetta, Kansas slated to have tree shearing work completed. The following is a brief description of each site:

3/8 m south then ½ m east through pasture GPS Coordinates Latitude = 39.35641, Longitude = -95.81521. Area to be cleared = 30 of 160 acres

2) P-766 ½ m south of 182 & G E2 SE 4, Sec 11, T8S, R13 E, Jackson Co, KS GPS Coordinates Latitude = 39.36842, Longitude = -95.92341. Area to be cleared = 62 of 80 acres

3) P-383A ½ m north of 158 & M N2 SW4, Sec 24, T8S, R14E, Jackson Co, KS GPS Coordinates Latitude = 39.33721, Longitude = -95.80957. Area to be cleared = 40 of 80 acres

4) P-664 1/8 m west of 190 & J W2 NW4, Sec 4, T8S, R14E, Jackson CO, KS GPS Coordinates Latitude = 39.38988, Longitude = -95.8649. Area to be cleared = 23 of 80 acres

Total: 155 Acres Description of Service:

The contractor will be required to complete the project as follows:

(1) Within the outline area on the attached aerial photos, the contractor is required to cut/shred all undesirable trees (ie: locust, hedge, cedar, elm, mulberry, dogwood, etc.) that are between +/- two

(2) and fourteen (14) inches in diameter at ground level. Trees with multiple forks will be considered two separate trees. All stumps must be cut flush with the ground when finished cutting.

Along fencerows or near ditches: cut all accessible undesirable trees without harming the fence.

Any damage to existing fences due to tree shearing activity will be repaired by the contractor.

Undesirable trees growing in deep ditches, creek beds or on extremely steep slopes can be excluded from being cut by a tree shearing machine. However, chainsaw work may be needed if requested by the government upon a site inspection.

(2) Spray all undesirable deciduous tree (elm, hedge, locust, elm, mulberry, dogwood) stumps with a stump killer after cutting each tree and spray brushy areas (buck-brush and sumac) in accordance to chemical label recommendations. This may require using a hand-sprayer to adequately treat the stumps and a boom sprayer to treat large areas of brush. The stump killing solution must completely cover the entire stump. Note: Spraying may need to be completed in the spring of 2022.

(3) Stack all tree debris, in dry eroded ditches or designated areas. Do not place any debris in creek beds.

No debris piles will be placed within 150-feet of any perimeter fences.

UNDER NO CIRCUMSTANCES can a person other than the landowner(s) of that property be allowed to remove any wood from a jobsite. Under the Code of Federal Regulations, 25–Indian, strict federal regulations prohibit the illegal use or removal of any products from trust property. If a contractor, sub-contractor, employee, or lessee is found guilty of removing or assisting in the removal of any wood products (firewood, wood posts, etc.) from trust property, they will be prosecuted and fined in accordance to federal law.

Do not attempt any tree shearing when the ground is wet and/or soft. The contractor will repair any excessive rutting at their own expense.

Do not cut any high value desirable trees (Walnut, Oak, Hickory, Maple, Birch, or Ash).

Daily Log and Progress Report:

Contractors will be expected to maintain a daily weather log that is to be submitted with their monthly progress report. The daily weather log must include precipitation amounts to show proof of unfavorable weather conditions that prevent timely job completion.

Contractors will be required to provide the Horton Agency a monthly progress report regarding the progress of their contract with a copy of daily weather logs attached. If progress is found unsatisfactory, the contract may be terminated for default under the terms and conditions of the FAR 52.249-08 and liquidated damages will be assessed. Bonding in the amount of the contract is required to cover potential liquidated damages.

Supplies and Equipment:

Contractor is responsible all of his own equipment to complete this job. This includes transportation, fuel, lubricants and repairs. The contractor will be required to purchase the appropriate labeled chemicals and diesel fuel or surfactant to any bush and tree stumps. A suggested mixture to treat the cut stumps is 1 quart of Remedy Ultra to 1 gallon of diesel fuel (1:4 mixing ratio). Refer to the K-State Chemical Weed Control Manual.

Conditions:

All work shall be coordinated with the Project Manager or his authorized representative. Near the completion of the work, the contractor must contact the Project Manager for a site inspection before the contractor leaves the job site.

Date of Service:

(4) The contractor may start work upon notification to proceed. The completion date of the tree cutting must be done before December 1, 2021. Liquidated damages and penalties may be assessed if required work is not completed by December 1, 2021. If abnormal precipitation prevents the contractors from completing the work by the required date, an extension may be warranted. The weather log will be proof of unfavorable weather conditions. Note: Spraying may need to be completed in the spring of 2022 if weather conditions prevent spraying.

Payment:

Prior to payment the Project Manager will verify the work is to the satisfaction of the government. Upon approval, the contractor will complete his invoicing on a computer using the instructions provided in the solicitation package.

Offer:

Please quote each jobsite separately with an accumulative total for a project lump sum quote. The successful contractor will be selected on technically capability to perform services, past performance and price. If quotes exceed available BIA funding, the BIA will eliminate specific jobsites in accordance to priority to remain within project budget constraints, FAR Clause 52.232-18, Availability of Funds.
