About this file

This Request for Proposals (RFP) document is issued by the Port of Brookings Harbor in Oregon for professional engineering services related to the Boat Yard Stormwater Improvements Project. The Port solicits qualified, licensed engineering consulting firms to submit proposals for design and permitting of boatyard facility improvements, including reconstruction of an 85-ton capacity marine travel lift system. The project scope encompasses heavy-duty boatyard resurfacing for marine industrial use, stormwater collection and industrial water quality treatment improvements, electrical power distribution upgrades and exterior yard lighting, and coordination with Port operations, tenants, and regulatory agencies. The RFP was issued on October 28, 2026, with a proposal submission deadline of December 2, 2026, at 10:00 AM Pacific Time. Questions and clarification requests are due by November 16, 2026, and protests of the RFP must be filed by November 25, 2026. The anticipated interview date is December 9, 2026, with consultant selection and Board approval of contract and fees scheduled for January 20, 2027. The selection process is based on qualifications and experience under Oregon Revised Statutes Chapters 279A and 279C, with cost proposals to be submitted only after selection of the highest-ranked firm for contract negotiations.

The RFP prohibits cost proposals during the initial submission phase; compensation will be negotiated with the highest-ranked eligible proposer following selection. If the project receives funding from the U.S. Environmental Protection Agency (EPA) Community Grants, the selected consultant must comply with federal requirements including the Uniform Guidance (2 CFR Part 200), EPA procurement standards, Build America Buy America (BABA) domestic preference requirements, Davis-Bacon and Related Acts prevailing wage provisions if applicable, and American Iron and Steel (AIS) requirements for water infrastructure components. A 20 percent non-federal cost share requirement typically applies to EPA Community Grants unless waived. The consultant must obtain and maintain professional liability insurance with limits of $1,000,000 per claim and $2,000,000 aggregate, along with commercial general liability, commercial automobile liability, and workers' compensation coverage. The evaluation criteria include relevant marine and port project experience (30 points), travel lift and heavy industrial facility experience (25 points), project team qualifications (20 points), project approach and understanding (15 points), and schedule and availability (10 points), for a maximum of 100 points in the written proposal phase. If interviews are conducted, additional scoring addresses proposed key staff and experience, engineering philosophy and approach, and integrity and professional ethics.

c. Waiver; Severability. Waiver of any default or breach under this Agreement by Owner will be effective only in the specific instance and for the specific purpose given. Any such waiver does not constitute a waiver of any subsequent default or a modification of any other provisions of this Agreement. If any term or provision of this Agreement is declared by a court of competent jurisdiction to be illegal or in conflict with any law, the validity of the remaining terms and provisions will not be affected, and the rights and obligations of the parties shall be construed and enforced as if this Agreement did not contain the particular term or provision held invalid.

d. Amendments. Any amendments, consents to, or waivers of the terms of this Agreement shall be in writing and signed by the authorized representatives of both parties.
