GSA is required to track spending for each of the three appropriations it received under the Inflation Reduction Act of 2022 (IRA) -- for low-embodied carbon (LEC) materials, emerging and sustainable technologies, and high-performance green building measures -- and has established “budget activities” for each of these appropriations. A contract line item number (CLIN) for each of these budget activities has been included in the Agreement as necessary. In addition, subCLINs will be used to track spending on each of the LEC materials designated for IRA funding -- asphalt, concrete, glass, and steel.

Offerors must include separate prices for IRA work under the corresponding IRA CLINs and subCLINs.

Amounts for each IRA CLIN should reflect all expenses necessary to accomplish acquisition and installation of IRA work elements. A list of possible expenses follows below; this list is not exhaustive.

Document: DB201A/April 2024 (The Solicitation) mailto:krista.miller@gsa.gov

● Expenses of acquiring and transporting products and materials required for IRA-funded work to the construction site;

● Labor, general and administrative expenses, and overhead and profit reasonably attributable to installation of IRA-funded work;

● Expenses for materials, tools, riggings and equipment (including safety equipment) required to install IRA-funded work;

● Design, submittal and documentation expenses reasonably attributable to IRA-funded work;

● Demolition and disposal expenses reasonably necessary for and attributable to IRA-funded work

● Expenses necessary to return space to its condition preceding IRA-funded work;

● Environmental remediation expenses required in execution of IRA-funded work; and

● Phasing and commissioning expenses reasonably attributable to IRA-funded work.

(2) Qualifications, Exclusions and Conditions

If the Offeror communicates in its proposal any qualifications, exclusions, or conditions to the proposed prices not provided for in the Contract Documents, the Contracting Officer may reject the proposal and exclude the Offeror from further discussions.

II.D. Technical Proposal

EVALUATION CRITERIA ELEMENTS WEIGHT Technical Evaluation Factors are listed in Order of Importance (Highest to the Lowest weight)

1. Quality of Design Concept

2. Past Experience of Design-Builder Team

3. Past Performance of Design-Builder Team

4. Sustainability

5. Small Business Participation

Definition of “SIMILAR PROJECT” - SIMILAR PROJECT means a construction project with all of the following characteristics:

Magnitude: Contract award of at least $3 million, substantially completed within last ten

(10) years from due date of proposals.

Document: DB201A/April 2024

Technical Factor 1: Quality of Design Concept Description: This factor considers the completeness and quality of the Offeror’s Design Concept. The standard of evaluation is met, when all the required elements are included in the design.

Design Concept must include the following to meet the standard of evaluation:

1. Overall concept designs including drawings, renderings, and photos.

2. Narrative that identifies historic status and related potential constraints, including consultation with Regional Historic Preservation Officer, regarding 106 compliance requirements.

3. P100 compliance matrix with confirmation that performance tiers can be met (or if exceeded, please identify higher tiers)

4. Annotated site plan describing overall vegetation approach and how water required for irrigation may be harvested from non-potable sources

5. Identify any special materials or potential construction methods that are planned or could potentially be required.

6. Narrative overview of accessibility/ABAAS compliance for base and options

7. Statement outlining proposed methods to manage the observed and expected changes in climate, based on the criteria in the Statement of Work and the climate profile information provided by the GSA.

8. Conceptual designs for waterproofing system with consideration of geotechnical conditions and to reduce risk to facility life cycle performance. Include a site plan, section(s), selected details, and narrative. Narrative should describe the overall waterproofing system, products used, proposed mock-ups, and testing procedures.

9. Narrative summarizing anticipated security requirements and standards, and how they will be met.

10. Narrative identifying project site characteristics and civil design challenges, and how those challenges will be addressed.

11. Identify preliminary SITES silver certification strategy.

12. Include all option work in design concept.

Additionally, to meet the standard of evaluation, the Offeror’s design and construction lead team members must participate in an in-progress design workshop virtual presentation to the Source Selection Evaluation Board. During this presentation, which will be recorded, the Offeror will present their design as it is developing, before it is finalized for submission, so that the SSEB and federal Subject Matter Experts may provide feedback on the design in terms of its feasibility and adherence to contract and solicitation requirements. The feedback may not be all inclusive as to all areas that the Offeror needs to address to meet the standard of evaluation. The Offeror is still ultimately responsible for the content of their proposal.

If the Offeror’s proposal meets all the requirements for the standard of evaluation, they may be credited in the evaluation with the following additional considerations, if they are met:

Document: DB201A/April 2024

1. Design includes a proposed location for the retention basin other than Triangle Park.

2. Design includes use of only non-potable water for all landscaping areas.

3. Design utilizes materials or physical elements that are low-maintenance and that facilitate easy cleaning.

4. Design includes SITES certification strategy for reaching gold level.

5. Design includes SITES certification strategy for reaching platinum level.

6. Design includes 3D graphics and/or animation depicting a walk-thru of the designed courtyard.

7. P100 matrix which demonstrates exceeding required performance tiers.

8. Construction method that allows for a proposed shorter period of performance. (If proposal is selected for award, proposed shorter period of performance will be incorporated into the contract requirements at award.)

Technical Factor 2: Past Experience on Similar Projects by the Design-Build Team

Description: This factor considers the corporate experience of the Offeror on two (2) SIMILAR PROJECTS. This factor will be evaluated based upon the written response to the RFP by the Offeror and the experience demonstrated by the presented projects.

The standard of evaluation is met when the Offeror submits two (2) SIMILAR PROJECT descriptions including:

1. Project name and location, site view project photographs (no more than three (3)).

2. Project Delivery Method, Initial Contract Award Amount and Final Contract Value, and Substantial Completion Date.

3. Provide a detailed project description describing the elements that qualify it as a SIMILAR PROJECT and any additional consideration.

4. The two project requirement applies for both the Construction Prime Contractor, and the Lead Designer. Two projects must be submitted for each the Construction Prime Contractor and Lead Designer. If both the Construction Prime Contractor and the Lead Designer worked on a project together, it may count for one project for both entities.

**Please note that each project submitted under Technical Evaluation Factor 2 shall be limited to a total of two (2) double-sided, 8-1/2” x 11” pages.

If the standard for evaluation is met, then the Offeror’s proposal may be credited with the following additional consideration:

Document: DB201A/April 2024

1) Project was performed in Hawaii.

2) Project involved exterior landscape and/or hardscape work.

3) Project was delivered by Design-Build method.

4) Project involved application of the Secretary of the Interior’s Standards for

Rehabilitation and Guidelines for Rehabilitating Historic Buildings.

5) Project was performed by both Lead Designer and Prime Construction

Contractor.

6) Project achieved SITES certification.

7) Project occurred in federal facility.

8) Project involved coordination with the Hawaii State Historic Preservation Division

Technical Factor 3: Past Performance of Design-Builder Team

This factor considers the past performance of the Offeror. The Offeror shall submit references (a person or persons who may be contacted regarding the quality of the Offeror’s past performance). The Offeror must provide the name, title, company name, current address, current phone number, and current fax number for each reference.

The Offeror must submit a Past Performance Questionnaire (PPQ) (included in the solicitation, or a substantially similar PPQ from another federal agency), completed by the applicable client, for two projects. The projects for which PPQs are submitted do not need to be for the same projects submitted under Factor 2: Past Experience, and do not need to meet the definition of “similar project” in Factor 2.

Completed PPQs should be submitted with the proposal. Ensure correct phone numbers and email addresses are provided for the client point of contact. Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the Offeror is unable to obtain a completed PPQ from a client for a project before proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the project. If the client requests, the client may submit a questionnaire directly to the Government's point of contact, via email at _krista.miller@gsa.gov__________ prior to proposal closing date and time. Offerors may resubmit questionnaires previously submitted with other proposals or may obtain an updated/new PPQ from a client for any submission. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs.

Also include performance recognition documents received within the last eight (8) years such as awards, CPARS reports, award fee determinations, customer letters of commendation, and any other forms of performance recognition. In addition to the above, the Government may review any other sources of information for evaluating past Document: DB201A/April 2024 performance. Other sources may include, but are not limited to, past performance information retrieved through the Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the Offeror's proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), previously submitted PPQ information, and any other known sources not provided by the Offeror. While the Government may elect to consider data from a variety of sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror. GSA will not maintain a database of PPQs submitted by Offerors.

If two PPQs are submitted for each the Lead Designer and Prime Construction Contractor, the standard for evaluation will be met. A PPQ for a project on which both the Lead Designer and Prime Construction Contractor performed, will count as one PPQ for each entity. If the standard for evaluation is met, the Offeror’s proposal may also be evaluated for the following additional consideration:

1. A project that receives better than Satisfactory ratings on the PPQ.

2. Narrative descriptions on the PPQs by references indicating positive performance reviews.

3. Performance recognition documents.

4. A PPQ submitted under Factor 3: Past Performance, is also for a similar project submitted under Factor 2: Past Experience, and has at least Satisfactory ratings

An Offeror with no record of past performance will be rated a neutral “Satisfactory” rating of a 3 out of 5 for this Factor 3.

Technical Factor 4: Sustainability

Background and Overview This project is funded in part by Section 60503 of the Inflation Reduction Act of 2022 (IRA), which provides funding for purchase of construction materials with substantially lower levels of embodied greenhouse gas emissions.

GSA’s IRA Low Embodied Carbon asphalt, concrete (and cement), glass and steel requirements establish numeric global warming potential (GWP) limits for certain EPA-approved construction materials: concrete (and cement), asphalt, steel, and glass (IRA-Eligible Materials). For each material, GWP limits have been established for the best performing 20% of materials in terms of Document: DB201A/April 2024 (The Solicitation) https://www.gsa.gov/system/files/Asphalt%20-%20GSA%20IRA%20Low%20Embodied%20Carbon%20Requirements%20%28Dec.%202023%29_508.pdf https://www.gsa.gov/system/files/Concrete%20-%20GSA%20IRA%20Low%20Embodied%20Carbon%20Requirements%20%28Dec.%202023%29_508.pdf https://www.gsa.gov/system/files/Glass%20-%20GSA%20IRA%20Low%20Embodied%20Carbon%20Requirements%20%28Dec.%202023%29_508.pdf https://www.gsa.gov/system/files/Steel%20-%20GSA%20IRA%20Low%20Embodied%20Carbon%20Requirements%20%28Dec.%202023%29_508.pdf embodied carbon (Top 20% Limits), the best performing 40% of materials in terms of embodied carbon (Top 40% Limits), and better than industry average (Better Than Average Limit).

This Evaluation Factor calls for Offeror commitments to furnishing IRA-Eligible Materials with the lowest possible GWP values. IRA Limit commitments proposed under this evaluation factor will be incorporated into the successful offeror’s resultant contract.

Individual materials’ GWP values may be found on individual manufacturers’ environmental product declarations (EPDs). EPDs must meet the standards reflected in GSA’s IRA Low Embodied Carbon asphalt, concrete (and cement), glass and steel requirements (see Compliance Documentation criteria listed for each IRA-Eligible Material).

Technical Acceptability and Scoring Offerors will only meet the standard for technical acceptability under this Factor if they commit to furnish all required IRA-Eligible Materials with a GWP better (lower) than each IRA-Eligible Material’s Better Than Average Limit.

Offerors meeting the standard for technical acceptability will receive a number of Raw Scores, one for each IRA-Eligible Material required by the Contract:

● Offerors will receive a Raw Score of 100 for each IRA-Eligible Material commitment that is better (lower) than GSA’s Top 20% Limits.

● Offerors will receive a Raw Score of 40 for each IRA-Eligible Material commitment that is only better (lower) than GSA’s Top 40% Limits.

● Offerors will receive a Raw Score of 20 for each IRA-Eligible Material commitment that is only better (lower) than GSA’s Better Than Average Limit.

Offerors shall complete the “IRA Sustainability Factor Table” attached to this solicitation by filling out the applicable IRA Limit they commit to meet for each IRA-Eligible Material. Based upon the offeror’s selection in the “IRA Limit Commitment” column, the associated Raw Score, the Weighted Score, and the Total Weighted Score will be automatically calculated.

In addition, for each IRA-Eligible Material identified in the IRA Sustainability Factor Table, offerors shall submit EPDs listing that material’s GWP. Such EPDs must meet the standards reflected in GSA’s IRA Low Embodied Carbon concrete (and cement).

Note 1: By submitting an offer, Offeror consents to unrestricted GSA use of supplier names and the GWP values associated with supplier materials. Such information may be disclosed publicly or used to inform other low embodied carbon procurement activities. Technical solutions, supplier pricing and supplier-offeror terms and conditions will not be shared. Any objection shall be transmitted to the Contracting Officer by the due date for offers and shall adhere to 41 C.F.R.

§ 105-60.601.

Note 2: For each offeror that is unable to submit any of the compliant EPDs by the proposal due date, the offeror shall submit a statement for each such missing compliant EPD certifying that it is unable to submit the compliant EPD by the proposal due date. Failure by an offeror to submit any compliant EPD or its certification (as described in the immediately preceding sentence) by the proposal due date shall result in the offeror’s proposal being unacceptable and the offeror being ineligible for award.

The contract resulting from this solicitation shall have the following provision: “Within 180 days after contract award, the Contractor shall submit a compliant EPD for any IRA-eligible Material for which the Contractor was unable to submit a compliant EPD by the proposal due date. Such EPD must reflect GWP values that comply with the IRA Limit Commitments incorporated into the contract. GSA shall not issue a Notice to Proceed with construction services to the Contractor until the Contractor has submitted a compliant EPD for each IRA-eligible Material for which the Contractor was unable to submit a compliant EPD by the proposal due date. In addition to other remedies available to the Government, if the Contractor fails to comply with the 180-day requirement in this paragraph for submission of compliant EPDs, GSA shall have the option to cancel the contract for the construction services at no cost to either the Contractor or

GSA.

Cancellation of the contract for the construction services by GSA under this paragraph shall not relieve the contractor of its obligation to provide GSA with a completed design in compliance with the contract. The design completed by the contractor in compliance with the contract shall be property of GSA and may be used by GSA to, among other things, obtain construction services under a separate contract with another contractor.”

(1) The Sustainability Factor will be scored as described below.

(2) GSA will verify Offeror’s scoring and that IRA Limits are supported by environmental product declarations (EPDs) from proposed suppliers.

(3) GSA will verify that Offeror’s EPDs adhere to EPD standards reflected in GSA’s IRA Low Embodied Carbon, concrete requirements (see Compliance Documentation criteria listed for each IRA-Eligible Material).

(4) GSA will make any scoring adjustments necessary to correct patent errors.

Once GSA has verified the Offeror’s scoring and, if necessary, made any corrections, the overall weighted score will be assigned an numerical rating, as follows, in accordance with the 1-5 scale on which all factors will be rated:

Weighted Score Numerical Rating

100 points 5

90-99 points 4

Document: DB201A/April 2024 (The Solicitation) https://www.gsa.gov/system/files/Concrete%20-%20GSA%20IRA%20Low%20Embodied%20Carbon%20Requirements%20%28Dec.%202023%29_508.pdf

20-89 points 3

Unacceptable 1

Note 1: Any proposal that does not furnish all required IRA-Eligible Materials with a GWP better (lower) than each IRA-Eligible Material’s Better Than Average Limit will be rated as “Unacceptable” under this factor and will be ineligible for award.

Note 2: Any proposal that furnishes all required IRA-Eligible Material with a GWP better (lower) than GSA’s Top 20% Limits will receive a weighted score of 100 points.

Note 3: If an EPD is not available, GSA will review the offeror’s statement certifying inability to submit a compliant EPD by the proposal due date.

The Offeror is requested to provide a proposal that, to the maximum extent practicable, furnishes IRA-Eligible Materials with the lowest possible GWP values.

GWP values for 3000 psi Concrete are as follows: 257 kgCO2e/m3 = top 20%, 291 kgCO2e/m3 = top 40%, and 318 kgCO2e/m3 = better than average.

GWP values for 4000 psi Concrete are as follows: 284 kgCO2e/m3 = top 20%, 326 kgCO2e/m3 = top 40%, and 352 kgCO2e/m3 = better than average.

IRA Limit commitments proposed by the Offeror will be incorporated into the resultant contract.

Individual materials’ GWP values may be found on individual manufacturers’ environmental product declarations (EPDs). EPDs must meet the standards reflected in GSA’s GSA’s IRA Low Embodied Carbon concrete requirements (see Compliance Documentation criteria listed for each IRA-Eligible Material).

The proposal shall provide construction materials with embodied GWP values that are less than or equal to the GSA IRA Top 20% Limits reflected in GSA’s IRA LEC concrete requirements. If Top 20% materials are not available for certain material categories, please propose materials with embodied GWP that are less than or equal to the GSA IRA Top 40% Limit for that material.

If Top 40% materials are not available for certain material categories, please propose materials with embodied GWP that are less than the Better Than Average Limit for that material.

Where Top 20%, Top 40%, or Better Than Average materials are not available, please explain how you determined that to be the case, including providing details on search parameters, sources contacted, and available materials.

The Offeror shall fill out the table below with the applicable IRA Limit they commit to meet for each IRA-Eligible Material:

IRA-Eligible Material*

IRA Limit Commitment (i.e., Top 20% Limit, Top 40% Limit, Better Than Average Limit)

Raw Score (i.e. 20, 40, or 100)

LEC Materials Evaluation Weight

Weighted Score (Multiply material’s raw score by evaluation weight)

Concrete Specified concrete strength class (compressive strength [f'c] in pounds per square inch [PSI])

3000 PSI .15

4000 PSI .85

** Where provision of concrete that qualifies under these GSA IRA Limits is impractical, GSA’s IRA Limits for cement may be applied to the cement being used in the concrete Mix. If the Offeror intends to meet this factor’s requirements using the cement in the concrete mix, rather than the concrete, the proposal must include a narrative describing why meeting the concrete requirements is impractical and must fill out the following table instead of the above concrete table. GWP values for cement are: 751 kgCO2e/metric ton = Top 20% Limit; 819 kgCO2e/metric ton = Top 40% Limit; and 858 kgCO2e/metric ton = Better Than Average Limit.
