Solicitation Number: Pleasant Grove and Spanish Fork Ranger District Vault Pumping BPA

(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

(ii) This solicitation is issued as an _ Request for Quotation (RFQ)_.

(iii)The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2022-04.

(iv)This procurement is set aside for 100% Total Small Business. The NAICS code is 562112 and the Small Business Size Standard is $4.7 Million.

(v) Schedule of Items/Price Schedule

Schedule Notes:

a) Quote on all items within a district. The quoted price per location includes all costs associated with the services provided. Service fluctuates depending on the use during the season. Toilets shall be pumped at a frequency and schedule identified in the individual call issued. Only quotes to the nearest cent will be accepted.

b) Multiple awards may be made. It is anticipated awarding a BPA for each district, but one BPA for both districts may be awarded if it is determined to be in the Government’s best interest.

c) Pricing and Estimated Quantity:

Since the needs of the Government are undefined, it is mutually agreed that, upon request of the Government, the contractor shall furnish the service listed herein to the extent the contractor is willing and able at the time of order.

This agreement is valid only with the vendor whose name appears in the Blanket Purchase Agreement (BPA). The vendor is responsible for notifying the Government of any change in name, ownership, and prices (if included). The Government shall not be responsible for payments other than those in the terms of this agreement.

The prices to the Government shall be as low as or lower than those charged any other customer for comparable quantities under similar terms and conditions, in addition to any discounts for prompt payment.

The Government is under no obligation to purchase from the vendor of this BPA. The Government is obligated only to the extent of authorized purchases actually made under this BPA. The vendor is under no obligation to supply any items or quantities not readily available.

The Aggregate dollar limitation for the life of this BPA is $200,000.00. There is no minimum order guarantee under this BPA. No single order under this BPA shall exceed $200,000.00.

Statement of Work Toilet Pumping Contract

Uinta-Wasatch-Cache National Forest Pleasant Grove and Spanish Fork Ranger Districts

United States Department of Agriculture (USDA), Forest Service (FS), Intermountain Zone, Uinta-Wasatch Cache National Forest, Pleasant Grove and Spanish Fork Ranger Districts have a need for toilet vault pumping services. To include 19 CXT vault toilet locations (including 8 double vaults) on the Pleasant Grove Ranger District and 15 CXT vault toilet locations (including 5 double vaults) on the Spanish Fork Ranger District, on an as-needed basis.

1. Scope Of Contract Pleasant Grove Ranger District Contractor will be required to pump 27, 1,000 gallon vault toilets, eight of which are double vault toilets in 19 locations.

Spanish Fork Ranger District Contractor will be required to pump 20, 1,000 gallon vault toilets, five of which are double vault toilets in 15 locations.

This service will be on an As-Needed Basis throughout the year ( Note: One location =one unit = each). Service will fluctuate depending on use during the year.

These restrooms are located within the Pleasant Grove and Spanish Fork Ranger Districts, and can be accessed either by asphalt or dirt roads. (Reference Map below) Exact mileage and directions can be found on the following lists:

1-A Description of Vault Toilets All vault toilets on the Pleasant Grove and Spanish Fork Ranger Districts are CXT Concrete toilets, capable of holding 1000 gallons of waste.

Location of sites and other pertinent information can be found in appendices (“Map” and “List”) and through verbal communication with the District Representative.

1-B Scheduling Work Work shall be assigned on an As-Needed Basis, with number of days and exact dates to be determined by the District Representative. Upon notification by the District Representative, the contractor shall start work within 5 calendar days and complete work after no more than 12 days. Work shall occur between 7:00 AM and 4:00 PM.

In the event that emergency pumping will be required, general servicing of toilets may occur outside of these established time constraints. Both parties will agree on response time for emergency pumping.

1-C Definitions Sewage is Liquid, Semi-Liquid, and Solid Waste Matter Debris is all other refuse found in vault toilets, including but not limited to:

1-D Contractor’s Representative Prior to starting work, the Contractor shall designate in writing a person to act for him/her during any absence from work. Contractor shall also specify scope of designated authority to the person who is substituting his/her responsibilities.

Solicitation Number: Pleasant Grove and Spanish Fork Ranger District Vault Pumping BPA 1-E Minimum Pumping Request Guarantee At a minimum, each work order will guarantee two vaults per service call, unless in case of emergency, then both parties will make a mutual agreement. As stated in section 1-B, under Scheduling Work, service is on an As-Needed Basis, depending on toilet usage, and fluctuates year to year, so an exact annual dollar amount of the services cannot be determined.

1-F Measurement and Payment Payment shall be made on a monthly basis, at the unit bid price per month, in accordance with all call-outs accomplished during the previous month. Contractor will need to create invoices in the IPP System at:

1-G Inspections and Acceptance Services performed under this contract shall be subject to inspection and acceptance by the Forest Service. The Contracting Officer will provide to the Contractor written notice of any item not meeting contract requirements.

If deficiencies are not corrected within 24 hours, the Contractor may be considered in default of the contract.

Regardless of inspections by the Forest Service, the Contractor is responsible for self-inspection and maintaining work to the standard required in this contract.

2. Technical Specifications The majority of the toilets within the Pleasant Grove and Spanish Fork Ranger Districts are accessible by asphalt roads maintained by the state of Utah and the Forest Service. However there are two vault toilets, Holman and Silver Lake that are only accessible via dirt roads. (See table on the page 1.) Due to the narrow roads, blind turns, and dirt roads within American Fork Canyon, Pumping Trucks cannot pull trailers.

2-A Equipment The Contractor shall furnish any and all toilet pumping equipment, including but not limited to:

• Tank Truck with the ability to reverse the suction process to clear clogged lines

• Water Truck

• Tools necessary to open manholes and remove risers

• Approved Disinfectant (approved by the Contracting Officer)

• 4-inch Minimum Suction Hose o Length of hose must be long enough to accomplish the required pumping. Some sites may require additional hose to reach vaults from roadway

• High Pressure Jet Washer System o To wash the side and end walls of the Vault and dilute solidified waste at the bottom o To wash last portion of waste down a sloped bottom vault

Water drafting equipment shall be completely separate from toilet waste and any pumping equipment.

2-B Pumping Procedures through an Outside Manhole Contractor shall not pump through the toilet riser when an outside manhole is available, and said manhole opening is greater than, or equal to, 20 square inches. Upon removing the manhole cover, the Contractor shall remove as much debris as possible, prior to pumping out waste. All debris removed from the vault shall be placed into a leak proof container, so that no contamination will result to the surrounding ground.

Procedures for flat bottom vault as follows:

When waste has been removed within four to five inches of the bottom of the vault, the four-inch hose will begin to suck air. At this time the Contractor will use a smaller hose to remove any further debris that was not http://www.ipp.gov/index.htm

Solicitation Number: Pleasant Grove and Spanish Fork Ranger District Vault Pumping BPA removed earlier. Using a high-pressure jet-washing system, the Contractor will wash down the interior walls of the vault, before the clinging debris has a chance to dry.

If heavy concentration of solids remains, the high pressure, jet-washing system will be used to break up and dilute the solids. Contractor will continue to pump waste until the hose is sucking too much air, and pumping becomes impractical.

The flat bottom vault shall now be pre-charged with enough clean water to fill the vault to 10 inches.

Procedures for slopped bottom vaults as follows:

Contractor shall pump waste, from the deep end, until the pump begins to suck air. Remove any remaining debris, and begin to wash the walls using a high pressure, jet-washing system, and wash any remaining waste down the sloped bottom. Pump out rest of waste until the hose begins to suck air. The flat bottom vault shall now be pre-charged with enough clean water to fill the vault to 10 inches.

2-C Pumping Through Toilet Riser Contractor shall only pump through the toilet riser when no outside manhole is available. Remove the toilet riser prior to pumping or removing any debris. Contractor will begin to pump waste in accordance with 2- B. Extra care shall be taken to prevent waste from spilling. Toilet Paper dispenser and toilet riser will be covered with a waterproof material, prior to removing debris, and starting the pumping process. Contractor will thoroughly wash and disinfect the inside and outside of the toilet riser, including the seat and cover, prior to replacing the riser. Both the riser and the seat will be dry before the Contractor leaves the work site.

2-D Drafting of Water Water may be drafted from lakes, ponds and streams under the following conditions:

• Drafting shall be accomplished:

o Where it least interferes with public use of facility o Areas least viewed by the public

• Any hoses and/or tubes used for pumping toilets shall not be used for drafting water

• No waste shall be introduced into any body of water

• The District Representative shall approve all sites used for, and prior to drafting water

• All Federal, State, and Local regulations must be followed

2-E Conduct of Personnel The Contractor and his/her personnel shall make every reasonable effort to prevent any interference with the normal use of recreation areas, while engaged in the performance of the contract. Contractor and his/her employees shall keep themselves and their equipment clean and presentable at all times. The District Representative may, in writing, require the Contractor to remove any employee deemed incompetent, careless, and discourteous to the public, or for theft of any government owned property. All contract personnel are required to identify themselves as contractors. In any situations where their contractor status is not obvious to third parties, they must make their status known to avoid creating an impression that they are Government employees.

3. Deliverables

• Toilet pumping must begin within 5 days of notification, and be complete 12 days after initial notification

• Services are subject to inspection and acceptance by the government

• Contractor is to pump toilets in a manner consistent with all specifications as outlined in this BPA solicitation o Meeting all pumping, waste removal, and cleaning specifications

4. Administration 4-A Resource Damage: Any damage or defacement that occurs to government property or land resources during the contractors operations shall be repaired at the contractor’s expense to its original condition. Onsite inspection will be made by the Contracting Officer’s Representative prior to acceptance of work.

4-B BPA Period of Performance: The BPA period of performance is for a five year period of time:

Base Year : August 15, 2022 - August 14, 2023 Option Year 1: August 15, 2023 - August 14, 2024 Option Year 2: August 15, 2024 - August 14, 2025 Option Year 3: August 15, 2025 - August 14, 2026 Option Year 4: August 15, 2026 - August 14, 2027

The estimated date of award is August 1, 2022. The Agreement period is for five years from the date of award.

This agreement may be terminated upon a 30 day written notice by either party. The Forest Service may at any time with thirty (30) day advance notice cancel/terminate the BPA.

This BPA Expires August 14, 2027.

The agreement period shall extend for one year. Continuation of this Agreement is subject to the yearly review of this BPA to ensure that it still represents the best value to the Government. At the option of the Government, the agreement may be renewed for additional one-year periods, not to exceed four renewal periods, at the same terms and conditions. The Government will notify the Contractor of the annual review, not less than sixty (60) calendar days prior to the expiration of the current Agreement period and allow the Contractor to update their pricing for that year.

4-C BPA Call Orders: The specifics of the effort to be provided under this Agreement will be contained in each BPA Call Order request issued. The request will identify:

a. Specification of vault toilets to be pumped

b. Schedule for pumping

c. Period of performance

BPA Call Orders will be placed against this BPA via Integrated Acquisition System.

4-D Ordering Procedure: BPA Calls under the BPA will be issued as Firm Fixed Price orders.

4-E Authorized Users: Any Warranted Contract Specialists or Purchasing Agents within the Intermountain Zone

4-F Basis of Measurement and Payment: Payment will be made according to the quantity and unit of measure identified in the schedule of items for accepted products and shall not to exceed the agreed upon cost for the work assignment.

4-G Invoicing and Payment The Forest Service utilizes the Invoice Processing Platform (IPP) for the electronic submission and tracking of contract/purchase order, invoices, and payment information. IPP is a Government-wide, Web-based invoice

4-H Invoices – A summary invoice shall be submitted to both the Contracting Officer and the IPP system upon the completion of all work identified under the BPA Call. Copies of individual delivery tickets issued during each billing period are required support for each invoice.

4-I Delivery Tickets - All completed BPA Call orders under this agreement shall be accompanied by delivery tickets that shall contain the following minimum information:

a. Name of Contractor;

b. BPA call number;

c. Date of order;

d. Invoice number;

e. Locations pumped and cost per pump;

f. Date and location of treated area.

4-J Use of Premises: The Contractor shall comply with the regulations governing the operation of premises which are occupied and shall perform this agreement in such a manner as not to interrupt or interfere with the conduct of Government business

4-K Landscape Preservation: The Contractor shall confine operations to within the clearing limits or other areas designated in contract documents. Operation shall be scheduled and conducted to minimize erosion of soils and to prevent silting and muddying of streams, rivers, irrigation systems, and impoundments (lakes, reservoirs, etc.). Pollutants such as fuels, lubricants, bitumens, raw sewage, and other harmful materials shall not be discharged into or near rivers, streams, and impoundments or into natural or manmade channels leading thereto. Wash water or wastewater from sewage operations shall not be allowed to enter live streams.

4-L Use of Bio-based Products: The contractor must comply with Section 9002 of the Farm Security and Rural Investment Act of 2002 (FSRIA), Executive Order (EO) 13423, “Strengthening Federal Environmental, Energy, and Transportation Management,” and the Federal Acquisition Regulation to provide bio-based products.

The contractor shall utilize products and material made from bio-based materials (e.g., bio-based greases, bio-based hydraulic fluids, bio-based absorbents) to the maximum extent possible without jeopardizing the intended end use or detracting from the overall quality delivered to the end user. All supplies and materials shall be of a type and quality that conform to applicable Federal specifications and standards. All supplies and materials to be used in the performance of work described herein are subject to the approval of the Contracting Officer’s Representative (COR).

The following is a list of products that may be used in this contract for toilet pumping services for which bio-based products are available. The list is not all inclusive. It is desirable that vendors be able to supply the greatest number of bio-based products listed meeting the health and environmental specifications.

Citrus Deodorizer Disinfectant

Bio-based products that are designated for preferred procurement under USDA’s BioPreferred program must meet the required minimum bio-based content as stated in the USDA Final Rule available at www.biopreferred.gov. The contractor should provide data for their bio-based products such as bio-based

Solicitation Number: Pleasant Grove and Spanish Fork Ranger District Vault Pumping BPA content. In addition to the bio-based products designated by the U.S. Department of Agriculture in the BioPreferred Program, the contractor is encouraged to use other bio-based products.

The contractor shall submit with the initial proposal a complete list of bio-based products, indicating the name of the manufacturer, cost of each material, and the intended use of each of the materials that are to be used in carrying out the requirements of the contract. Additionally, the winning contractor on each anniversary date of the contract shall compile a complete list of bio-based products, including the information above, purchased to carry out the contract requirements. The contractor shall list volume to be used and total cost for each individual product. This information will be used for reporting purposes.

The contractor shall comply with the provision at FAR 52.223-1, Bio-based Product Certification.

The contractor shall comply with the clause at FAR 52.223-2, Affirmative Procurement of Bio-based Products Under Service and Construction Contracts.

The contractor shall include the use of bio-based products in the Quality Control Plan. This submittal shall be approved by the COR in writing. The contractor shall not commence work until the submittal is approved by the COR in writing. The plan must be reviewed and updated annually, and as required by the COR. The plan must contain and define the following elements:

The contractor’s written policy stating its commitment to the use of bio-based products, employee health and safety, and sound environmental management practices.

Detail on how contractor’s written policy stating its commitment to the use of bio-based products, employee health and safety, and sound environmental management practices.

Detail on how the contractor intends to keep abreast of the development and increasing availability of bio-based products and how any new or improved products will be incorporated on an ongoing basis into contract performance.

NOTE: A contractor may propose more than one product within a product category and/or propose a product or products addressing more than one product category.

The product guides which define standard operating procedures for instructing staff in the proper use, storage, and disposal of bio-based products; proper maintenance of equipment; and other procedures/instructions to accomplish work under this contract.

A demonstration of proper use, an effective training program, and technical assistance are essential to the success of the purchase and use of some bio-based products that may function differently than a conventional product. Therefore we will look for a contractor who will 1) demonstrate products, and 2) when selected, offer any necessary training to all of the construction staff and 3) be available with technical assistance to trouble shoot problems.

Solicitation Number: Pleasant Grove and Spanish Fork Ranger District Vault Pumping BPA Attachment A - Quality Assurance Surveillance Plan Introduction: The Quality Assurance Surveillance Plan (QASP) has been developed to evaluate contractor actions while implementing this Statement of Work (SOW). It is designed to provide an effective surveillance method of monitoring contractor performance for each objective listed on the performance objectives. The QASP provides a systematic method to evaluate the services the contractor is required to furnish. This QASP is based on the premise the Government desires to maintain a quality standard in providing toilet pumping for the Pleasant Grove Ranger District and that a service contract to provide that service is the best means of achieving that objective.

The contractor, and not the Government, is responsible for management and quality control actions to meet the terms of the contract. The role of the Government with respect to quality assurance is to ensure contract standards are achieved for the purpose of authorizing payments. In this contract, the quality control program is the driver for service quality. The contractor is required to develop a comprehensive program of inspections and monitoring actions. The first major step to ensuring a “self-correcting” contract is to ensure that the quality control program approved at the beginning of the contract provides the measure needed to lead the contractor to success. Once the quality control program is approved, careful application of the process and standards presented in the service delivery summary will ensure a robust quality program.

Surveillance: The Contracting Officer’s Representative (COR) will receive complaints from Forest Service personnel and pass them to the contractor’s quality control inspector (QCI) for correction. Complaints will be recorded on the Quality Control Checklist.

Standard: The contractor shall perform all work required by the task in a satisfactory manner in accordance with the appropriate statement of work paragraph. The COR shall not consider the task complete until all deficiencies have been corrected.

Procedures: The COR will inspect work tasks periodically and complete the Quality Assurance Checklist prior to approval of invoice for payment. The completed checklist will be provided to the contractor and the contracting officer. The inspection is required to ensure contractor compliance with the appropriate paragraphs of the statement of work each time the service is performed and record results of inspection, noting the date and time of inspection. If any inspection indicates unacceptable performance, the COR will notify the contract manger or QCI of the deficiencies. Due to the nature of this service, any unacceptable performance must be corrected before the contractor leaves the toilet pumping site.

Quality Assurance Checklist – Vault Pumping Services

Debris is removed from vault prior to pumping out waste

All debris is placed in a leak proof container

Interior walls of vault are washed down with a high pressure jet washing system after waste is pumped out

Vault is pre-charged with enough clean water to fill the vault to 10 inches

When no outside manhole is available, pumping will be through the toilet, after the riser has been removed

-Remove debris after removing the riser

-Toilet Paper Dispenser and Toilet Riser shall be covered with waterproof material before prior to removing debris or pumping

-Toilet riser is thoroughly washed and disinfected inside and outside, including the seat cover, prior to replacing riser

-Extra care shall be taken to prevent waste from spilling when pumping through the toilet.

Water may be drafted from lakes, ponds, and streams where it least interferes with public use and view

-Hoses or tubes used for pumping shall not be used for drafting water

-No waste shall be introduced into any body of water
