About this file

This is a Faithful Performance Bond template document issued by the County of Orange, California for use in competitive bidding and contract award processes. The bond serves as a security instrument required of contractors awarded County contracts to ensure faithful performance of contracted work and compliance with all terms, conditions, and specifications outlined in the underlying service or supply agreement.

The performance bond establishes a penal sum obligation wherein the Principal (Contractor) and Surety (bonding company) are jointly and severally liable to the County of Orange for the faithful execution of contract duties. The bond remains in full force until the Principal performs all covenants, conditions, and agreements specified in the underlying contract in the manner and timeframe prescribed. The Surety waives notice of any changes, extensions, alterations, or additions to contract terms and agrees that no such modifications shall affect its bonding obligations. The County reserves the right to recover all reasonable costs, expenses, and attorney fees incurred in enforcing the bond obligation, which shall be taxed as costs in any resulting judgment. Execution requires notarized signatures from both the Contractor (adhering to California Corporations Code Section 313 requirements for corporate signatories) and the Surety representative, with approval required from both the County's Chief Executive Officer/Risk Management and the Office of the County Counsel prior to bond effectiveness.
