About this file

This is a Performance Bond template document issued by the County of Orange, California, for use in conjunction with the Overhead Trolley Lift Crane and Man Basket Certification, Maintenance, Repair and Modifications contract. The bond serves as a faithful performance guarantee requiring the selected contractor to execute all work in accordance with contract terms, conditions, and specifications. The bond is structured as a penal sum obligation that becomes null and void upon successful completion of all contractual obligations, with the surety company remaining liable for any changes, extensions, alterations, or additions to the contract without requiring notice. The contractor must submit the executed bond within seven days of award notification, with the bond amount to be determined based on the final contract value in accordance with California requirements and County standards. The bond must be executed by an authorized corporate officer and notarized, with the surety company's name typed or stamped on the document.

The Performance Bond template establishes joint and several liability between the contractor and surety company for the full penal sum amount. The County may pursue recovery of all reasonable costs and expenses incurred in enforcing the bond obligation, which shall be taxed as costs in any judgment rendered. The surety representative's signature must be accompanied by a notarized certificate of notarization attached to the document. In accordance with California Corporations Code section 313, corporate signatories must comply with specific execution requirements, either utilizing dual signatures from designated officers or providing written evidence of single-signature authority through corporate resolution. The bond remains in full force and effect until County approval as to both surety and limits is obtained, as certified by the County's CEO/Risk Management office and the Office of the County Counsel.
