Performance Bond for Playground Replacement Parts and Repair Services Contract

This is a Faithful Performance Bond document issued by the County of Orange, California for a playground replacement parts and repair services contract. The bond serves as a financial guarantee that the selected contractor will faithfully perform all obligations outlined in the underlying contract between the County and the contractor. The performance bond requires the contractor to secure a surety company authorized to conduct business in California, with the bond penal sum to be specified based on the contract value. The document establishes joint and several liability between the principal (contractor) and the surety to ensure completion of all work in accordance with contract specifications, timelines, and terms. The bond remains in effect throughout the contract duration, including any extensions, and protects the County against contractor default or failure to perform required playground maintenance and repair services across the 20 specified park and trail locations.

The performance bond requires full notarization of the surety representative's signature with a certificate of notarization attached to the document. The surety company name must be typed or stamped above the surety representative's signature line. The bond includes provisions that the surety waives notice of any changes, extensions, alterations, or additions to the contract terms and agrees that such modifications do not affect its obligations. The County's approval authority encompasses review by both the Risk Management/CEO office and the County Counsel's office. Corporate signatories must comply with California Corporations Code Section 313, requiring either two authorized officers (chairman, president, or vice president paired with secretary, assistant secretary, chief financial officer, or assistant treasurer) or a single officer with evidence of binding authority. All enforcement costs, reasonable expenses, and fees incurred by the County in pursuing bond obligations shall be taxable as costs and recoverable in any resulting judgment.
