About this file
This is a Performance Bond document for the County of Orange, California, establishing a faithful performance bond requirement for contractors entering into agreements with the County. The bond obligates the principal contractor and surety company to ensure faithful performance of contract obligations, with the bond remaining in effect for the duration of the contract term and any alterations thereof. The document requires notarization of the surety representative's signature and specifies that the bond amount, premium rate, and contract details must be completed prior to execution. Approval is required from both the County's CEO/Risk Management office and the Office of the County Counsel before the bond becomes effective. For corporate signatories, the document mandates compliance with California Corporations Code section 313, requiring either two authorized officers to sign or a single officer with documented authority through corporate resolution.
The Performance Bond establishes that the penal sum amount must be determined based on the contract price and applicable premium rates, with the surety waiving notice of any contract modifications, extensions, or alterations. The bond secures the contractor's obligation to perform all work according to contract specifications and timelines while indemnifying and defending the County against claims. In the event of contractor default, the County may enforce the bond to recover costs, reasonable expenses, and attorney fees incurred in recovery efforts, which are taxable as court costs and included in any judgment rendered. The bond document serves as a standard requirement for the Orange County Channel Cleaning Services contract valued at $4,500,000.00, covering debris removal and channel maintenance services across Orange County's flood control channels for an initial three-year term with optional two-year renewal.
