About this file
This is a Faithful Performance Bond template document issued by the County of Orange, California, Public Works Department for use in state and local contract opportunities. The bond serves as a guarantee that the Principal (Contractor) will faithfully perform all obligations under their contract with the County. The bond requires the Principal and an authorized Surety company to be jointly and severally liable to the County for the penal sum of the bond, contingent upon the Principal's compliance with all contract terms, conditions, covenants, and agreements. The Surety agrees that no changes, extensions of time, alterations, or additions to the contract terms or work specifications shall affect its obligations on the bond, and it waives notice of any such modifications.
The bond premium is charged at a specified rate per thousand of the contract price. The Surety representative's signature must be notarized with the certificate of notarization attached to the document, and the Surety company name must be typed or stamped above the signature line. The bond must be approved by both the County's CEO/Risk Management and the Office of the County Counsel. Corporate signatories must comply with California Corporations Code section 313, requiring either two authorized officers or one officer with written evidence of binding authority to execute the document. In the event of contract breach, the County may pursue enforcement through legal action with all associated costs, expenses, and attorney fees included as part of the judgment against the Principal and Surety.
