About this file
This addendum document, issued by the Palm Beach County Board of County Commissioners Department of Airports on March 29, 2022, modifies the proposal documents for Project PB 22-5, the James L. Turnage Blvd. Bridge Repairs at Palm Beach International Airport. The project involves miscellaneous repairs to seven bridges (Bridges 1, 2, 3, 4, 5, 8, and 10) including concrete joint cleaning and sealing, concrete spall and crack repairs on superstructures and substructures, exterior surface cleaning and refinishing, and friction surface coating application on Bridges 3 and 8. The pre-bid conference was held on March 22, 2022, at 10:00 AM at the Department of Airports' main conference room, with meeting minutes and PowerPoint presentations included as attachments. Sealed bids were due on April 5, 2022, at 2:00 PM at the Palm Beach County Department of Airports. The total contract time is 410 calendar days from Notice to Proceed, with construction to substantial completion required within 320 calendar days and final acceptance within 30 days thereafter. The construction cost estimate is $1.8 million.
The addendum clarifies that the Disadvantaged Business Enterprise (DBE) participation goal is 24.7 percent for the base bid and any additive bids or alternates, with the prime contractor required to self-perform a minimum of 25 percent of the total contract cost. Liquidated damages range from $500 per calendar day for most phases to $1,000 per calendar day for the construction to substantial completion phase. Key clarifications provided include confirmation that staging areas will be provided on site, friction coating can be applied during day shift on Bridges 3 and 8, security access badges will be provided by the owner at no cost to the contractor, and waste containers are the contractor's sole responsibility. All structural work must be performed per FDOT Standard Specifications for Road and Bridge Construction, with all bridge structures receiving a Class 5 finish coating except Bridge 10, whose architectural panels require pressure cleaning only.

BID REQUIREMENTS
DBE Schedules
Completed DBE Schedules must be submitted as a part of the bid response. Failure to complete the forms will result in the disqualification of your bid.
Schedule 1- List of Proposed DBE Firms
Schedule 2- Letter of Intent to Perform as a DBE
Schedule 3- Demonstration of Good Faith Efforts to Achieve DBE Goal (Note: This form has been substantially revised.)
Schedule 6- Bidder’s & Subcontractor’s Information
For this Project:
Base Bid with a 24.7% goal
Common Mistakes
The amounts listed in Schedule 1 for each DBE Firm must be supported by the price included on Schedule 2 in order to be counted toward attainment of the DBE goal. Schedule 2 must be signed by the DBE firm.
Firms must be certified by the Unified Certification Program for the State of Florida as a “DBE”. Information regarding DBE certification status may be found through the Florida Department of Transportation Equal Opportunity Office’s website at:
http://www3b.dot.state.fl.us/EqualOpportunityOfficeBusinessDirectory/;
or by contacting the Palm Beach County Department of Airports’ DBE Office at (561) 471-7403.
Certification as a SBE/MWBE or by any other program SHALL NOT count toward achievement of the DBE goal.
Verifying DBE Certification Status
Although a DBE firm may perform work in categories for which it is not certified, only work to be performed in the DBE’s certified categories will be counted toward attainment of the DBE goal.
DBE firms are certified for certain categories of work in accordance with the North American Industry Classification System (NAICS). Information regarding NAICS can be found at:
http://www.census.gov/eos/www/naics/.
Materials and Supplies – Counting DBE Participation
DBE Manufacturer -100% of the cost of the materials or supplies may be counted.
DBE “Regular Dealer” – 60% of the cost of the materials or supplies may be counted.
Brokers – DBE participation is limited to the amount of the fees or commissions charged; provided that the fees are reasonable and the broker is performing a commercially useful function.
Good Faith Efforts - Generally
The bidder is required to demonstrate that it has made good faith efforts to achieve participation with DBE firms if the DBE goal is not achieved. Failure to demonstrate good faith efforts to achieve the DBE goal shall result in disqualification of your bid in the event that the DBE goal is not achieved.
Determinations of good faith efforts are intrinsically fact-specific and are made taking into consideration the evidence provided by each bidder as to its documented efforts.
Demonstration of good faith efforts include, but are not limited to, the actions identified in Schedule 3. Actions constituting evidence of good faith efforts are described in Appendix A to 49 CFR Part 26.
Schedule 3 Demonstration of Good Faith Efforts
Schedule 3 form has substantially changed and requires submission of additional information. Bidders should read the revised form carefully. In the event the DBE goal is not achieved, Schedule 3 must be completed in its entirety.
Complete required contact log, including the name of each DBE firm contacted, method of initial and follow up contact, dates of efforts and results of contact.
Include copies of backup documentation supporting your contact log.
Include method of solicitation for all subcontracting categories identified on Schedule 3 for DBE participation. Do not list categories where little or no efforts were made to obtain participation.
Schedule 3 Demonstration of Good Faith Efforts
Include copies of advertisements; however, advertising alone is not sufficient to satisfy good faith efforts.
List all quotes from DBE firms. If a non-DBE firm is selected over a DBE firm, the bidder is required to include the actual copies of the quotes submitted by the DBE firm and non-DBE firm. Failure to include the required quotes shall cause the bid to be nonresponsive.
Schedule 3 provides specific examples of actions that raise the question of whether the bidder has used good faith efforts and actions that may cause a bid to be found nonresponsive. This information may be used as a general guide; however, the list is not exhaustive or exclusive.
Examples of actions that do not constitute good faith efforts
Making mere pro forma efforts such as sending blanket e-mails with no documented follow up efforts.
Rejecting DBE firms as being unqualified without sound reasons.
Failing to make portions of the work available consistent with the available DBE firms.
Failing to negotiate in good faith with interested DBE firms.
Providing the Department with inaccurate or misleading information regarding good faith efforts.
Schedule 3 – Attachment 10 24.7% or greater DBE participation
If 24.7% or more DBE Participation is proposed:
(1) Check the top box;
(2) Enter the percentage
(3) Sign & Date
(4) There is no need to complete the remainder of the form.
Schedule 3 – Attachment 10 Less than 24.7% DBE participation
If less than 24.7% DBE Participation is proposed:
(1) Check the second box;
(2) Enter the percentage proposed
(3) Sign & Date
(4) The remainder of the form must be completed and demonstrate the Bidder’s good faith efforts to achieve at least 24.7% participation.
