About this file
This document is a Payment Bond form from the City of Napa Public Works Department, dated February 13, 2024, which serves as a legal instrument to ensure financial protection for subcontractors, laborers, and material suppliers on a public works project. The form provides a template for a bond that guarantees payment by a contractor to authorized claimants for work performed, with the bond amount set under California Civil Code § 9550. The bond covers potential failures by the contractor or subcontractors to pay for labor, materials, equipment, and required employment-related deductions, with the surety company obligated to cover any unpaid amounts.
The bond includes specific provisions that outline the surety's obligations, beneficiary rights, and duration of coverage. Key legal protections are built into the document, including waivers of certain notification requirements, specification that the bond is governed by California law, and establishment of Napa County Superior Court as the venue for any disputes. The form requires signatures from the surety, contractor, and city approval, with space for attaching a notary seal and power of attorney. The bond remains in effect until all payments for labor, materials, and equipment are made in full compliance with contract and legal time requirements.
