About this file

This is a Payment Bond template document issued by the City of Santa Monica for contract performance requirements under California Civil Code Section 9550. The bond is designed to secure payment claims from contractors, subcontractors, laborers, materialmen, and other persons involved in the performance of City contracts. The bond amount is set at 100% of the proposal amount and serves to guarantee payment for materials, equipment, labor, and amounts due under the Unemployment Insurance Act. The surety executing the bond agrees that no changes, extensions of time, alterations, or modifications to the contract or work will affect its obligations, and further waives notice of such modifications.

The payment bond is executed by both the Principal (contractor) and the Surety, with signatures and corporate seals required from each party. The document requires attachment of both notarial acknowledgement of the surety and power of attorney documentation. The bond obligates the surety and its successors jointly and severally, creating a direct right of action for claimants listed under California Civil Code Section 9100. In the event of litigation, the bond covers reasonable attorney's fees as determined and awarded by the court. This bond template is applicable to the City of Santa Monica's Printed Materials for Big Blue Bus contract, which requires successful bidders to provide comprehensive print production materials by the specified deadline of December 18, 2025.
