About this file
This is a Payment Bond form required by the City of Santa Monica for a five-year vehicle emergency lighting, equipment installation, maintenance, and parts contract. The bond is executed under California Civil Code Section 9550 and secures payment obligations to all contractors, subcontractors, laborers, materialmen, and other persons employed in contract performance. The bond amount equals 100 percent of the proposal amount and covers materials, equipment, labor, and any amounts due under the Unemployment Insurance Act. The surety agrees that no changes, extensions of time, alterations, or modifications to the contract or work will affect its obligations under the bond, and it waives notice of such changes. The bond obligates both the principal and surety jointly and severally and inures to the benefit of all persons named in California Civil Code Section 9100, providing them with a right of action against the bond. Should suit be brought on the bond, the surety will pay reasonable attorney's fees as fixed by the court and included in any judgment rendered.
The bond requires execution by both the principal and surety with corporate seals affixed and must be notarized, with a Power of Attorney attached. The document includes signature lines for authorized representatives of both parties and requires the surety's mailing address and telephone number. The bond becomes void if the underlying contract conditions are fully performed; otherwise, it remains in full force and effect. This payment bond protects the City and all persons performing work or supplying materials under the contract and ensures financial recourse for unpaid claims related to the vehicle emergency lighting and equipment installation services.
