About this file

This is a Purchasing Affidavit form issued by the State of West Virginia Purchasing Division, required under W. Va. Code 5A-3-10a for all state and political subdivision contract awards and renewals. The affidavit mandates that no contract may be awarded to any vendor or related party that owes a debt exceeding one thousand dollars in aggregate or is in employer default status. The form requires the vendor's authorized representative to affirm under penalty of law for false swearing that neither the vendor nor any related party meets the debt or employer default criteria, with limited exceptions for contested taxes, workers' compensation premiums, permit fees, or environmental fees and assessments that have not become final, or for vendors in compliance with established payment plans or agreements.

The affidavit defines "debt" as any assessment, premium, penalty, fine, tax, or other amount owed to the state or its political subdivisions due to judgment, fine, permit violation, license assessment, or defaulted workers' compensation premium that is presently delinquent or due, including accrued interest or penalties. "Employer default" encompasses outstanding balances or liabilities to workers' compensation funds, policy defaults, failure to maintain mandatory coverage, or failure to meet obligations as a self-insured employer, with exceptions for employers in compliance with repayment agreements with the Insurance Commissioner. "Related party" includes individuals, corporations, partnerships, associations, limited liability companies, or other entities related by blood, marriage, ownership, or contract that will receive or control a portion of benefits, profit, or consideration equal to or exceeding five percent of the total contract amount. The form requires notarization and must be completed with the vendor's name, authorized signature, date, state, and county information.
