c) Is determined to be a responsible proposer

5. Proposers pending Small Business or DVBE Certification applications under review by the Department of General Services concurrent with the bid time frame should contact OSDS to request an expedite review/approval of their application in order to be considered for the small business preference during the evaluation of this bid. Contact OSDS at (916) 375-4940 to obtain information about the application expedite process.

Q. Disabled Veteran Business Enterprise (DVBE) Incentive and Participation

1. DVBE Incentive

a) In accordance with section 999.5(a) of the Military and Veterans Code, and

DVBE Incentive Regulations, CCR 1896.99.100, an incentive will be given to proposers who provide DVBE participation.

b) For evaluation purposes only, the State will apply an incentive to bids that propose California certified DVBE participation as identified on the Bidder

Declaration GSPD-05-105 (Attachment 5), confirmed by the State. The incentive amount will vary in conjunction with the percentage of DVBE participation. The Following percentages will apply:

Confirmed DVBE Participation of: DVBE Incentive

5% or over 5% of points

4% to 4.99% inclusive 4% of points

3% to 3.99% inclusive 3% of points

2% to 2.99% inclusive 2% of points

1% to 1.99% inclusive 1% of points

c) The incentive points are included in the sum of non-cost points. Proposer will have points added to their evaluation score based on their participation percentage of the number of non-cost points available in the solicitation. The incentive points cannot be used to achieve any applicable minimum point requirements.

CDFW RFP - Secondary (09/2024)

d) The following is an example of the DVBE incentive calculation:

Proposer: A B C D

DVBE participation 3.99% 0% 100% 4.00%

Technical Evaluation Points (70 points max)

50 50 42 49

Proposal Cost $103 $100 $106 $101

Cost Points (30 points max)

29.1 30.0 28.3 29.7

Total Evaluated Points 79.1 80.0 70.3 78.7

Example: DVBE percentage is calculated according to the DVBE incentive schedule in 1.b) above. That percentage is multiplied by the total possible available points, which in this case is 100. Proposer A did not meet the 4% DVBE threshold, so by the table, their participation is 3%. This 3% is then multiplied by the 100 total possible available points, yielding 3 points. Proposer C is a DVBE, so their participation is 100%, however the incentive is capped at 5%, so they receive 5 points. Proper D has 4% participation and received 4 points.

Point awards prior to incentive points 79.1 80.0 70.3 78.7

Incentive points 3.0 N/A 5.0 4.0

Total final points for each proposer 82.1 80.0 75.3 82.7

Proposer D now has the highest-scoring proposal and will be awarded the contract.

e) Proposer understands and agrees that if award of this contract is based in part on their commitment to use the DVBE subcontractor(s) identified in their bid or offer, per Military and Veterans Code 999.5(e), a DVBE subcontractor may only be replaced by another DVBE subcontractor and must be approved by the

State. Changes to the scope of work that impact the DVBE subcontractor(s) identified in the bid or offer and approved DVBE substitutions will be documented by contract amendment.

f) Failure of Contractor to seek substitution and adhere to the DVBE participation level identified in the bid or offer may be cause for contract termination, recovery of damages under rights and remedies due to the State, and penalties as outlined in M&VC §999.9; Public Contract Code (PCC) §10115.10, or PCC

§4110 (applies to public works only).

g) Pursuant to Mil. & Vet. Code Section 999.7, ten thousand dollars ($10,000) will be withheld from the final payment, or the full final payment if less than ten thousand dollars ($10,000), until the Prime Contractor complies with the certification requirements of subdivision (d) of Mil. & Vet. Code Section 999.5.

Prime Contractor shall be given 30 days’ notice to cure the defect. If, after thirty

(30) calendar days from the date of notice, the Prime Contractor refuses to comply with the certification requirements, CDFW shall permanently deduct ten

CDFW RFP - Secondary (09/2024) thousand dollars ($10,000) from the final payment, or the full payment if less than ten thousand dollars ($10,000).

Section 4: Evaluation and Award Process

R. Evaluation and Selection

1. Phase 1: Administrative Evaluation

a) Phase I is scored as a “Pass” or “Fail” according to the criteria indicated in the RFP Proposal Evaluation which is attached as a separate document. All items listed must be completed and provided in this phase to be considered responsive and continue to the next phase.

2. Phase II: Minimum Qualifications & Technical Evaluation

a) Phase II is scored and evaluated by a review panel consisting of qualified CDFW personnel.

b) Phase II, Part 1 – Minimum Qualifications: The evaluation team will first assess each Proposer’s minimum qualifications on a Pass/Fail basis. The evaluation team will continue to score each response that has “Passed” all minimum qualifications according to the criteria listed in the Sample Agreement’s Exhibit A, Scope of Work and the RFP Proposal Evaluation attachment.

c) Phase II, Part 2 -Technical Evaluation: The evaluation team will review and score each proposal based on the scoring criteria listed in the RFP Proposal Evaluation attachment. The Technical Evaluation is separated into Technical Questions and Cost Evaluation. This phase is worth a total of 100 points (note:

costs must represent 30% of the total technical score):

• Technical Questions – 70 points

• Cost Evaluation – 30 points

d) Proposers must pass all Minimum Qualifications and achieve a minimum of 70 points in the Technical Evaluation to advance to the next phase.

e) Cost Evaluation: Proposer’s total costs will be ranked from low to high. The response with the lowest cost will receive the maximum number of available points for the cost evaluation. The remaining responses will receive an incrementally lower score based on the percentage difference of their cost to the response with the lowest cost. See sample evaluation in the RFP Proposal Evaluation attachment.

f) Preference Incentive Adjustments: Proposals will be evaluated for eligibility to receive a Small Business (SB) and/or Disabled Veterans Business Enterprise (DVBE). The Proposer scores for the technical and/or cost evaluations will then be adjusted as explained in Section 3, Preference and Incentive Programs.

CDFW RFP - Secondary (09/2024)

3. Phase III: Reference Check

a) The references provided as part of the solicitation response will be contacted by the evaluation team. The evaluation team will make a reasonable effort to contact the references, but it is the sole responsibility of the Proposer to ensure that the provided reference is available to respond in a timely manner. The reference check will consist of asking for the reference to verify the details the

Proposer has provided on Attachment 11 and to describe their overall experience working with the Proposer. References will be evaluated as “Pass” or “Fail”. If a reference cannot verify the details provided by the Proposer or describes a negative experience in working with the Proposer, that reference check will be considered a failure. Failing a reference check may result in the disqualification of the Proposer.

4. Phase IV: Interview

a) Proposers who meet the minimum required points in the technical evaluation

(Phases I and II) and successfully pass the reference checks (Phase III) will be invited to an interview conducted via Microsoft Teams. The interview will be evaluated on a Pass/Fail basis, considering clarity, conciseness, quality of responses, and overall professionalism. A “Fail” in any interview evaluation may result in disqualification from further consideration. Specific evaluation criteria are provided in the RFP Proposal Evaluation attachment.

b) The interview will consist of a presentation by the Proposer (approximately 20 minutes), followed by a Q&A session in which the Proposer will respond to interview questions asked by CDFW. All Proposing Firms will be asked the same set of questions. Firms advancing to this phase will receive the interview agenda, instructions, and the interview questions in advance to facilitate preparation.

c) The Proposing Firm must not introduce any new proposals during the interview that were not included in the original submitted proposal. Any such new proposals will not be considered or evaluated.
