CLAUSES AND PROVISIONS
Offerors/Bidders/Quoters must review and comply with the FAR Provisions or Clauses listed below, which are applicable to this acquisition, along with addenda included in this RFQ as Attachments 1 through 12. The full text of referenced provisions and clauses may be accessed electronically at https://www.acquisition.gov/far
Provisions:
52.252-1, SOLICITATION PROVISIONS INCORPORATED BY REFERENCE (FEB 1998)
52.212-1, INSTRUCTIONS TO OFFERORS—COMMERCIAL ITEMS (APR 2014)
https://www.acquisition.gov/far
52.212-2, EVALUATION FACTORS FOR AWARD
(a) Simplified Acquisition evaluation procedures as set forth by FAR Part 13 will be applied in the evaluation of quotes received. Only those quotes deemed responsive will be evaluated.
(b) The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation requirements will be the best value and most advantageous to the Government; price and non-price factors considered. The following factors shall be used to evaluate quotations: (a) price, (b) past performance, (c) experience, (d) technical capability, and (e) delivery/completion time. Past performance, experience, technical capability, and delivery/completion time, when combined, are approximately equal to price.
(1) Price – The price considered for evaluation will be the pricing as submitted by the quoter in
Attachment 12 - Quotation Submittal (Section B), and other such pricing information as may be requested by the Contracting Officer during evaluation, and/or as may be negotiated between quoter and the Contracting Officer. A contract may not be awarded if the quoter’s price results in a cost to the government which is determined by the government not to be fair and reasonable. In determining the reasonableness and fairness of the quoter’s price, the contracting officer shall use one or a combination of the following: market research, comparison of the quoted price with the competition or with prices found reasonable on previous purchases, current price lists, catalogs, or advertisements, comparison with similar items in a related industry, the contracting officer’s personal knowledge of the products being purchased and services being performed, comparison to an independent Government estimate, or any other reasonable basis. The prices shown in the quoter’s price breakdown will also be evaluated to determine whether any of the prices are unbalanced. Quoters are cautioned to distribute costs appropriately. The contracting officer will determine whether the final negotiated price is fair and reasonable and constitutes an estimated fair market price.
(2) Past Performance, Experience, and Technical Capability – Quoter must submit relevant evidence of past performance, experience, and technical capability which validates the quoter possesses, or has the ability to successfully perform a federal government contract of the size and scope as described in this solicitation. Ratings in each of the three categories will be given:
(1) Unsatisfactory, (2) Below Average, (3) Satisfactory, (4) Above Average, (5) Excellent.
(i) Past Performance – Quoter’s references from Attachment 12 (Section D) will be contacted, to the extent practical, to ascertain the quality, professionalism, and timeliness of the products, workmanship, and customer satisfaction provided/delivered by the quoter; to include that of any subcontractors utilized by quoter. The data found in the Past Performance Information Retrieval System (PPIRS), Better Business Bureau, and other performance measurement mediums available to the Contracting Officer may also be used.
(ii) Experience – Quoter is to identify and submit on Attachment 12 (Section D), a minimum of three projects (references) where like work in at least the size and scope as required by this contract, has been performed by quoter within the past five (5) years. The degree of relevancy, and similarity in the scope, size and complexity will be rated.
(iii) Technical Capability – Quoter is to submit evidence which demonstrates quoter possesses or has the ability to provide the technical knowledge, capability, resources;
and the business, managerial, and administrative acumen to successfully provide the items and perform the incidental services as set forth in this solicitation.
(iv) Further evidence of past performance, experience, and technical capability may include, but is not limited to, additional references, identification of previous government contracts performed, licenses and or certifications, company capability statement/bio, photographs of relevant completed projects, and awards, certificates of achievement, and letters of recognition pertinent to the disciplines/trades required of the work described in this solicitation.
(3) Delivery / Completion Time – Quoter is to complete Attachment 11 (Contractor’s Proposed
Milestone Dates). It is the Government’s preference that all window coverings be provided, installed, and all deliverables received within six (6) months from the date of award, but not later than nine (9) months from the date of award. A delivery/completion date of 1 to 4 months will be rated Excellent, 5 to 6 months will be rated Above Average, 7 to 9 months will be rated Satisfactory, 10 months will be rated Below Average, and a delivery date of over 10 months will be rated Unsatisfactory. (Note: The Contracting Officer may find it necessary to adjust the range of the above ratings for the delivery dates. This will be contingent upon the average delivery / completion time of all quotes received. For example: If the average delivery/completion time of all quotes received is 11 to 12 months, all ranges could be adjusted accordingly and a 12-month delivery/completion time could be rated as Satisfactory.)
(c) Before the quoter’s specified expiration time of quote, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(d) Pre-Award Survey:
(1) No award shall be made unless the Contracting Officer can make an affirmative determination of responsibility of the prospective contractor as per the standards identified in FAR Subpart 9.1. Quoters are advised that this is accomplished through the information provided in the Quoter’s quote, and a pre-award survey which may require the prospective contractor to provide additional information or documentation as requested by the Contracting Officer. Areas of interest on this survey may include, but are not limited to the following, with regard to the prospective contractor as it relates to the work to be performed under a resultant contract:
(i) Have adequate financial resources to perform the contract, or the ability to obtain them.
(ii) Be able to comply with the required delivery date, taking into consideration all existing commercial and governmental business commitments.
(iii) Have a satisfactory performance record.
(iv) Have a satisfactory record of integrity and business ethics.
(v) Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them, including, as appropriate, such elements as production control procedures, property control systems, quality assurance measures, and safety programs applicable to materials to be produced or services to be performed by the prospective contractor and subcontractors.
(vi) Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them.
(vii) Be otherwise qualified and eligible to receive an award under applicable laws and regulations.
(2) Quoters are advised that accomplishment of this survey is a part of the determination of responsibility process and is not to be construed that a request to the prospective contractor for additional information and documents is an indication that he/she will receive the resultant award.
(e) Before the quote’s specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(f) A contract is expected to be awarded on or about January 30, 2015.
