About this file
This document contains a single source justification and special notice for an annual audiology equipment calibration contract. The Department of Veterans Affairs intends to award a sole source, firm-fixed-price base contract plus three option years to E3 Diagnostics for calibration services. The services include annual electroacoustic calibration of audiology equipment in ten sound-attenuating exam rooms at the Portland VA Medical Center to American National Standards Institute specifications. Pricing is provided for a base year and three option years. The justification cites that continued use of E3 Diagnostics is essential to maintain horizontal data integrity for ongoing research projects conducted over several years. The special notice satisfies FAR requirements and states that no other solicitation will be issued as this is a sole source procurement. The anticipated award date is January 19, 2024 for services to be provided to the Portland VA Medical Center.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
In accordance with FAR 13.106-1(b) this will be single sourced to the large business , e3 Diagnostics.
The Portland VAMC currently has sound-attenuating rooms for which e3 Diagnositcs has provided the annual calibration since the construction of the R&D Center was completed in 2006. Horizontal data integrity is required. It is impera nd sensitive

Last Updated: 02/01/22 Page 2 of 2 audiometric evaluation and recording equipment be calibrated on an annual basis by a vendor that can provide documentation assuring that results maintain a high degree of reliability, sensitivity and specificity. Use of any other vendor to perform the requisite calibration would require the NCRAR to establish new baseline calibration values for the data due to difference in calibration methods and instrumentation, and make it virtually impossible to merge and compare data obtained since 2006 with data that would be obtained after a new vendor s calibrations. This would compromise the reporting of audiometric data collected by a multitude of ongoing funded research projects over the past several years, and potentially result in the fleecing of hundreds of thousands of VA research funds that were expended to support this data collection.
4. Description of market research conducted and results or statement why it was not conducted:
Market research was conducted to satisfy the requirements of the FAR 10.002(b) and is in the included in the briefcase. As part of the market research the SBA VetCert database was searced looking for SDVOSBs/VOSBs capable of providing the requested service. Due to the nature of the service being purchased there is no reasonable expectation that any capable SDVOSB/VOSB would be capable of satisfying this requirement. The results of the VetCert search is recorded in the briefcase. Through the market research it was determined that the services required can only be supplied e3 Diagnostics. As such e3 is the Sole Source provider for this service contract.
The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed. FPDS was searched to establish price reasonableness and revealed awards to VA facilities reflecting prices similar to that which is being offered in the current acquisition. In particular, contract 36C24223P1163, dated 06/16/2023 for , for service and calibration of audiology equipment, and the prior contract for this requirement, 36C26019P0168 for which Option Year 4 was exercised 12/01/2018 for .
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
