About this file

This is a Justification for a Sole Source Award for Certain Commercial Items issued by the Department of Veterans Affairs, Technology Acquisition Center (Control Number VA-26-00072171).

The VA seeks to award a firm-fixed-price contract to GE Precision Healthcare, LLC for renewal and continuation of MIM Maestro Department Solutions software licenses and associated services for the VA North Dallas Texas Health Care System's Biomedical Engineering Office. The required deliverables include MIM Maestro and related software modules (MIM Contour ProtégéAI+, MIM Encore, MIM Assistant, MIMneuro, SurePlan, and MIMcardiac) licenses, software upgrades, telephone technical support, and ongoing training services. The software serves as the centralized radiation oncology imaging and treatment planning platform, enabling clinicians to import, register, contour, review, and manage treatment planning data in a single system. The contract period spans a 12-month base period with four optional 12-month renewal periods. The anticipated contract value is undisclosed in the document.

The sole source justification is based on GE Healthcare's proprietary ownership of the MIM Maestro platform following its February 2, 2026 acquisition of MIM Software, Inc. Market research, conducted in April and June 2026, confirmed no other vendors can provide compatible software or OEM-level support without requiring complete replacement of the existing validated system. The VA has utilized MIM Maestro for over five years with established configurations and clinical workflows; switching vendors would necessitate system replacement, interface rebuilding, and clinical protocol revalidation, introducing substantial clinical risk and operational disruption. The justification will be made publicly available on SAM.gov in accordance with FAR Overhaul VA Deviation requirements.

JUSTIFICATION FOR A SOLE SOURCE AWARD

FOR CERTAIN COMMERCIAL ITEMS

1. Contracting Activity: Department of Veterans Affairs Office of Procurement, Acquisition, and Logistics

Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724

2. Description of Action: The proposed sole source action is for a Firm-Fixed Price (FFP) contract with GE Precision Healthcare, LLC (GE Healthcare) 3000 North Grandview Boulevard, Waukesha, WI 53188. This contract will provide brand name MIM Maestro Department Solutions and Software services for the Department of Veteran Affairs (VA), Healthcare Technology Management (HTM), Office of Biomedical Engineering, VA North Dallas Texas Health Care System located at 4500 S Lancaster, Dallas, TX 75219.

3. Description of Supplies or Services: VA, HTM, Office of Biomedical Engineering requires the renewal of the existing MIM Maestro and MIM Contour ProtégéAI+, MIM Encore, MIM Assistant, MIMneuro, SurePlan, and MIMcardiac software licenses and associated services, including software licenses and all corresponding components, MIM software upgrades, telephone technical support, and ongoing training services for new features. The VA requires the continued use of MIM Maestro Department Solution to provide a centralized radiation oncology imaging and treatment planning platform so that all relevant studies and planning data can be imported, registered, contoured, reviewed, and managed in one place. VA also requires delivery of actionable imaging and planning information into the daily workflow of clinicians at the point of care, enabling radiation oncologists, physicists, dosimetrists, and therapists to prepare and adjust treatment plans more quickly and consistently. This will enable front line clinical staff to intervene faster and more efficiently, providing better and safer care for each Veteran while reducing rework and delays in treatment. The VA further requires that this department solution includes all necessary software licenses and components, ongoing upgrades and support, and a single access point that streamlines workflow and provides program level administrative oversight of radiation oncology planning activities.

This will ensure that imaging and planning tasks are completed in a timely, standardized, and auditable manner, and that VA clinical and IT staff are fully supported through ongoing software maintenance, including applying updates, patches and upgrades to MIM Maestro and MIM Contour ProtégéAI+, MIM Encore, MIM Assistant, MIMneuro, SurePlan, and MIMcardiac to maintain secure and reliable operations. The required brand name MIM Maestro Department Solution software is currently used by VA North Dallas Texas Health Care System. The period of performance shall include a 12-month base period with four (4), 12-month option periods. The total estimated value of the proposed action is , inclusive of option periods.

4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is 10 U.S.C. 3304(a)(1) as implemented by Revolutionary Federal Acquisition

MIM Maestro Department Solution Control Number VA-26-00072171 and Software Service

Regulation Overhaul (RFO) 6.103-1(d) entitled, “Only one responsible source and no other supplies or services will satisfy agency requirements.”

5. Rationale Supporting Use of Authority Cited Above: MIM Maestro’s licenses and maintenance support provides a unique solution that is fully compatible with the existing clinical systems and current operational needs at the VA North Dallas Texas Health Care System, Biomedical Engineering Department. The VA has been using MIM Maestro and associated MIM Software products within the VA North Dallas Texas Health Care System for over five (5) years. The existing software has been successfully configured and integrated with MIM Maestro and related systems and the imaging and treatment information it manages must remain highly accurate to protect patient safety.

The MIM Maestro platform is a foundational component of the VA North Dallas Healthcare System and is the only solution that can meet the functional and existing infrastructure requirements of providing treatment planning and dose monitoring for both Radiation Oncology and Nuclear Medicine. MIM Maestro serves as the core preplanning and contouring system. MIMcardiac, MIM neuro, and MIM Encore are designed around PET/CT, SPECT/CT, CT, and MRI usage to assist in image reconstruction and analysis of the given specialty. For example, MIMcardiac evaluates blood flow through the heart and MIMneuro evaluates neurological conditions like Alzheimer’s. MIM Assistant and MIM SurePlan serve as more tools used for data management automation. Tasks are initiated and run in the background (contouring, image fusion, and data routing) to further assist with developing a treatment plan. MIM SurePlan has an additional focus on auto-calculating patient-specific radiation dosage based on anatomy. Contour ProtégéAI+ provides highly automated contouring within the established simulation and planning workflow so that reviewed structures are available in MIM or the treatment planning system without additional manual steps.

Because this environment relies on proprietary configurations, data structures, and clinical workflows developed around the MIM products, no other vendor’s software can integrate into this configuration and provide the same level of safety and reliability without replacing the entire MIM stack, rebuilding interfaces and clinical protocols, and re-validating plan quality and safety from the ground up. Doing so would introduce substantial clinical risk, such as mis-registration, inconsistent contours, and delays to treatment start and would require significant time and resources. If a different vendor were chosen, VA would effectively have to discard the current MIM Maestro–based environment and restart with an entirely new radiation oncology imaging and treatment planning platform. Discarding the current MIM Maestro environment would lead to disruptions or misconfigurations that would lead to incorrect targeting, delays in therapy, or the need to re-plan treatments. These activities would consume significant time and resources and would inevitably introduce periods of reduced efficiency and heightened risk as workflows are rebuilt and staff adapt to the new system. Because the existing MIM environment is already configured, validated, and embedded in daily care, maintaining it avoids these risks and helps ensure that Veterans continue to receive timely, accurate radiation therapy.

Additionally, GE Healthcare is the only source that offers the proprietary MIM Maestro Department Solution, associated upgrades, and original equipment manufacturer (OEM)-level support specifically designed for and proven with VA’s current MIM Maestro, MIM Contour ProtégéAI+, MIM Encore, MIM Assistant, MIMneuro, SurePlan, and MIMcardiac implementation. Without MIM software, patients and clinicians in Radiation Oncology and Nuclear Medicine would be negatively impacted as treatment planning will be compromised.

6. Efforts to Obtain Competition: Market research was conducted, details of which are in Section 8 of this justification. This effort did not yield any additional sources that could meet the Government’s requirements. In accordance with FAR Overhaul VA Deviation

5.301 and 6.301(b)(2), the award notice for this action will be synopsized on the Contracting Opportunities website, SAM.gov, and the justification will be made publicly available with the solicitation.

7. Actions to Increase Competition: The Government will continue to conduct market research to determine whether changes in the marketplace to be competed. Specifically, the Government will continue to monitor the marketplace to determine whether other brand name software could integrate into VA’s existing hardware components.

8. Market Research: VA technical experts conducted market research in April 2026 to identify suppliers capable of providing the brand name MIM Maestro Department Solution software licenses, maintenance, and OEM-level support compatible with the existing MIM Maestro and MIM Contour Protégé AI, MIM Neuro, MIM Cardiac, MIM Assistant, Sure Plan software (and add-ons) currently deployed at the VA North Texas Healthcare System. Market research has concluded that the developer and sole provider of MIM Maestro and its associated licenses/add-ons, is the sole source provider of MIM Maestro licenses, services, upgrades and direct support for existing and future implementations of the software. MIM software is proprietary and only MIM or its authorized resellers are the only sources capable of providing the software subscription, preventative maintenance, and emergency (unscheduled) repair services necessary to ensure continuous, reliable clinical operation of the software. It should be noted MIM Software, Inc. was acquired by GE Healthcare on February 2, 2026 and all assets of MIM Software, Inc., both rights and obligations, passed to GE Healthcare. April 2026, the technical expert received confirmation that GE Healthcare is the sole proprietor for current and future use of MIMs products.

Additional market research was conducted by the Contract Specialist (CS) in June 2026.

On June 18, 2026, the Contract Specialist conducted market research via a Request for Information (RFI) on System for Award Management (SAM.gov) for a duration of seven days, with a closing date of June 25, 2026. The results of the RFI yielded two responses;

ATZ Solutions, LLC, a Small Business (SB), and BHPE, LLC, a Service-Disabled Veteran Owned Small Business (SDVOSB). Both vendors were determined to be not capable of providing the MIM Maestro Department Solution as they do not have a partnership with MIM Software or GE Healthcare for the distribution of MIM Maestro Licenses or Maintenance Services.

Lastly, on June 25, 2026, the Contract Specialist reached out to GE Healthcare with the existing OEM letter dated March 18, 2026, to determine whether the contents of the letter remain accurate stating GE Healthcare is the OEM of the MIM 7.5 Platform CT. On June 29, 2026, the Contract Specialist received an updated OEM letter stating GE Healthcare is the sole proprietor for current and future use of MIMs products and does not have any authorized resellers or service providers.

Therefore, the Contracting Officer has determined that this solicitation will be released as a sole source action to GE Healthcare.
