About this file
This is a Justification and Approval for Exception to Fair Opportunity Memo from the Department of Veterans Affairs for a sole source task order. The document covers an annual service maintenance agreement for a 1 AGFA DR 400 Detector System located at the Worcester Belmont Street Campus, with a base plus two firm fixed price annual periods. The maintenance agreement includes 24/7/365 help desk support, remote technical support during normal business hours, preventative maintenance services, and priority onsite response during downtime events.
The sole source justification is based on AGFA US Corp being the only vendor authorized to perform maintenance on their imaging equipment, due to proprietary software, licensing requirements, and FDA regulations for medical devices. Market research confirmed no alternative sources, and AGFA provided a sole source letter stating they are the only vendor capable of maintaining the system's performance, cybersecurity requirements, and providing necessary software updates. The task order will be issued against an existing IDIQ contract (VA797H-17-D-0004), with pricing previously determined fair and reasonable.
