About this file
This document is a Justification and Approval (J&A) for Other Than Full and Open Competition from the Defense Logistics Agency (DLA) Contracting Services Office. The document seeks to extend a sole source contract for multi-functional production devices (MFPDs) for DLA Document Services in Japan. The original contract (SP7000-19-P-0077) for 7 devices expired on 02/28/2025, and subsequent follow-on contracts (SP7000-25-P-0029 and SP7000-25-P-0058) encountered technical issues. The current J&A aims to exercise options for December 2025 and January 2026 to provide additional time for DLA Document Services to develop a new requirement and for DCSO to solicit a follow-on contract.
Key challenges include a previous contract's devices not meeting mission requirements and network security testing needs. The sole source extension is justified by the need to maintain continuous device leasing, the complexity of network security compliance (estimated 20 business days), and device delivery timelines. A Sources Sought notice was published on SAM.gov, receiving one response from BHPE LLC. The document emphasizes that this will be the final sole source extension, and any future delays in awarding a follow-on contract will not be supported by additional sole source justifications.

4. An identification of the statutory authority permitting other than full and open competition.
41 U.S.C. 1901 - Simplified Acquisition Procedures and FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements.
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.
Although other vendors are available to supply MFPDs with consumables and services, the MFPDs required must be tested for compliance with Network Security which involves an estimated 20 business days. Additionally, the typical device delivery time of 30 days must be accounted for.
Therefore, there are no vendors who would be able to deliver devices in time for a December 1, 2025 start date. Also, since the devices in place are under a lease, no other vendor can service the lease of another vendor without violating the lease terms. Due to these situations, the devices being leased with the current contract, must remain in place and leasing services need to be extended on a sole source contract. The only way to ensure uninterrupted support is to issue a contract to the current vendor.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under 5.202 applies.
The J&A will be posted to SAM.gov in accordance with FAR 5.202(a)(2). The post will be made for 30 days.
7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
SP7000-25-P-0058’s December 2025 and January 2026 options are at the same price as purchase order SP7000-19-P-0077. An informal analysis will be completed prior to exercising SP7000-25-P- 0058’s December 2025 and January 2026 options verifying the options’ pricing is fair and reasonable.
8. A description of the market research conducted (see part 10) and the results or a statement of the reason market research was not conducted.
Sources Sought notice 85796FDDW22174 (SP7000-26-RFI-1004) was published on SAM.gov on 11/25/2025 with a close date of 11/26/2025 and one response was received from BHPE LLC.
9. Any other facts supporting the use of other than full and open competition.
1. SP7000-19-P-0077 is the original contract for the MFPDs and it expired on 02/28/2025.
2. Sole source contract SP700025-P-0044 was awarded on 03/03/2025 with an expiration date of 05/05/2025. This sole source was required because request for quote (RFQ) experienced delays due to a change in RFQ requirements and interested vendor questions. It was also needed to allow for the testing, delivery and installation of the follow-on contract’s devices prior to 05/01/2025.
3. Sole source contract SP7000-25-P-0058 was then awarded on 05/05/2025 with an expiration date of 09/30/2025. P00001 was awarded on 09/03/2025 and it extended the base CLINs expiration date from 09/30/2025 to 11/30/2025. P00001 also added the December 2025 and January 2026 option CLINs.
4. Follow-on contract SP7000-25-P-0029 was awarded on 04/25/2025. Upon installation of the devices, it was discovered by DLA Document Services that the devices, even though previously found technically acceptable, do not meet the requirements needed to meet mission requirements.
SP7000-25-P-0029’s requirements were submitted by DLA Document Services containing a fatal flaw because the devices provided by SP7000-25-P-0029 are high-capacity multifunctional devices but not MFPD’s that are required to meet production level printing. In summary, the awardee of SP7000-25-P-0029 provided devices that met the technical requirements of SP7000-25-P-0029’s solicitation; however, DLA Document Services provided a requirement that would not meet their technical requirement for the devices to successfully meet the need of the follow-on MFPD contract.
5. Additionally, Contracting Officer (KO), , awarded sole source contract SP7000-25-P- 0058 adding the December 2025 and January 2026 options without completing the required sole source justification. Adding and now exercising these options is a change in scope to the original SP7000-25-P-0058 sole source contract. , the KO for this sole source action, must complete this Justification and Approval (J&A) document so the December 2025 and January 2026 contract options can be exercised.
6. The reason for SP7000-25-P-0058’s J&A was to give time to allow follow-on contract SP7000-25- P-0029’s devices to be delivered and installed. SP7000-25-P-0029 turned out to not be a follow-on contract because its requirements contained a fatal flaw resulting in its awarded devices not meeting mission requirements. Based upon this information and IAW DFARS 206.304(a)(S-70)(ii) the approval authority for this J&A is one level above the KO because SP7000-25-P-0058’s statement to remove or overcome barriers was not met.
10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.
One response was received from the Sources Sought notice posted on SAM.gov and it was from
BHPE LLC.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
The exercising of the December 2025 and January 2026 options is required to provide more time for DLA Document Services to submit their follow-on requirement and additional time for DCSO to solicit the follow-on requirement for SP7000-19-P-0077. Additionally, any future delays to awarding the follow-on requirement to include testing, delivery and installation of devices will not be supported by a separate sole source justification.
