Justification for Other Than Full and Open Competition (JOFOC) – Revolutionary FAR Overhaul (RFO)

This document is a federal contracting justification for a non-competitive contract extension. The National Institutes of Health (NIH) seeks to extend comprehensive occupational medical services under existing Contract 75N98020C00002 with Eagle Health LLC for six months (July 1, 2026 through December 31, 2026) via bilateral modification, obligating an estimated $3,249,630.00 and increasing total contract value from $27,232,595.97 to $30,482,225.97. The original contract was awarded on a full and open competitive basis with a performance period revised to July 1, 2021 through June 30, 2026. The extension clause (RFO 52.217-8, Option to Extend Services) was not evaluated during initial competition, rendering it effectively a new procurement requiring justification under RFO 6.103-2 (Unusual and Compelling Urgency).

The requirement provides medical support services for approximately 20,000 NIH employees across five locations: the primary occupational medical clinic in Building 10 at NIH's Bethesda campus, plus satellite clinics at the Integrated Research Facility in Frederick, Maryland; Biomedical Research Center in Baltimore, Maryland; Rocky Mountain Laboratories in Hamilton, Montana; and the National Institute of Environmental Health Sciences campus in Research Triangle Park, North Carolina. Services include occupational injury and illness treatment, OSHA-mandated medical surveillance programs, medical qualification examinations for high-containment laboratory staff, and biosurety evaluations controlling access to high-containment laboratory space. The contractor provides a multidisciplinary team including physicians, nurse practitioners, registered nurses, and medical clerks, supported by program management staff, plus four licensed social workers supporting the Employee Assistance Program. The government determined unusual and compelling urgency applies due to external federal workforce optimization directives (Executive Order 14210) that disrupted procurement timelines, making full and open competition impossible before the June 30, 2026 contract expiration. No advance notice under FAR Part 5 was issued. The government conducted no market research prior to award due to the urgency but will conduct market research for the planned competitive follow-on solicitation expected for release in August or September 2026, with successor contract award anticipated in December 2026.
