OREGON CITY SCHOOL DISTRICT
2025 BOND
INVITATION TO BID
FOR
Beavercreek ES Asbestos Flooring Removal
SOLICITATION # B15-2026
Introduction
Executive Summary Oregon City School District No. 62 (“district”) is requesting competitive sealed and written bids from qualified firms to provide Beavercreek ES Asbestos Flooring Removal Project for the OCSD 2025 Bond Projects.
The general scope of the OCSD 2025 Bond Projects include major renovations at John McLoughlin Elementary School, Candy Lane Elementary School, Holcomb Elementary School, Beavercreek Elementary School, Gaffney Lane Elementary School and Redland Elementary School.
The district intends to enter a contract with the selected firm for the entire scope of work at all school sites.
Background Oregon City School District No. 62 is a unified public school district that was originally formed in 1872.
Located in southeast Portland, Oregon metro-area, the district encompasses approximately 125 square miles of land. The school district serves students living in Clackamas County, and parts of unincorporated Clackamas County, which includes multiple neighborhoods and communities. The district is committed to providing a high-quality and equitable education for approximately 7,000 students from kindergarten through grade 12. The district encompasses a diverse range of schools, including elementary, middle, and high schools, each playing a vital role in shaping the future of our community.
Care and upkeep of the district’s aging facilities continues to be financial and operational challenge. The newest elementary school was built in 1975, while the average age of all elementary schools are over 60 years old. Recognizing the aging infrastructure of its elementary school facilities, updates needed to modernize CTE programs, and the need to create modern learning environments that support contemporary educational practices, OCSD recently embarked on a crucial initiative to address these challenges. The voters in Oregon City School District approved a significant bond measure in November 2024 specifically earmarked for the renovation and modernization of the district's elementary schools and Career and Technology Education (CTE) at Oregon City High School.
Project Summary:
The goal of this project is Beavercreek Elementary School classrooms: 3, 5, 6, 17, 18, 19, 29, 30, 31, 32, 33 and 34: Remove and dispose of approximately 13,711 square feet of tile, carpet and asbestos containing mastic. Work will be accomplished using wet and manual methods, within neg-air containment by Oregon certified asbestos workers and supervision in accordance with regulatory requirements for the safe handling and disposal of Class II friable asbestos products. After removal, grind concrete floor with 25 grit blades to remove mastic without using solvent. Work will be accomplished using wet and manual methods, within neg-air containment by Oregon certified asbestos workers and supervision in accordance with regulatory requirements for the safe handling and disposal of Class II friable asbestos products.

All bid and pricing information shall be typewritten and shall be signed in ink or digital signature by an authorized representative of the company. Alterations (including white out) shall be initialed in ink or with digital initials by the authorized representative. It is the responsibility of the bidder to verify that bids have been received.
B. Bids shall be submitted via email no later than the date and time listed in Table 1 “Important Dates” to Kim Davis, Bond Program Coordinator, at kimberly.davis@orecity.k12.or.us. Late bids will not be considered. Bids will be opened at the time shown in Table 1.
C. First-tier subcontractor lists, if applicable, shall be submitted via email by the time shown in Table 1.
D. Bids received after the appointed time in Table 1, and bids that are not accompanied with the required subcontractor's list, if applicable, by the appointed time, will be deemed incomplete and will NOT be considered.
E. Oregon City School District encourages bids from Minority, Women, Emerging Small Businesses and Service-Disabled Veteran Owned Businesses.
F. The resulting contract is a Public Works, ORS 279C.800 though 279C.870, where BOLI Prevailing Wage Rates are applicable. Prevailing Wage publication applicable to this contract is the Prevailing Wage Rates for Public Works Contracts effective as shown in Table 1, and as may be amended in the future. https://www.oregon.gov/boli/employers/Pages/prevailing-wage-rates.aspx
2.0 Product Quality
Brand names, when used, indicate the quality desired. Alternate brands must be of equal quality, merit, and utility as determined in the Owner’s sole judgment.
A. Method of Bidding – Base Bid and Alternates. Bid evaluation will be based on lowest total of base bid modified by Owner accepted alternates. Bidders must bid upon all alternate bid items.
The Owner reserves the right to reject stipulated and/or unbalanced bids that are determined by The Owner to not be in its best interest.
B. Examination of Plans, Specifications, and Work Site. It is understood that a Bidder, before submitting a bid, has made a careful examination of the scope of work documents; that the Bidder has a complete understanding of the quality and quantity of materials and the character of the work required;
and that the Bidder has made a careful examination of the location and conditions of the worksite and the sources of supply for materials.
It is further understood that a bid awarded hereunder is subject to the Owner being able to comply with local building code restrictions and conditions for the structure or structures contemplated in the bid;
any or all of which conditions may be contained in the contract and may result in termination of the contract, if such conditions are not satisfied. The Owner will in no case be responsible for any loss or for any unanticipated costs that may be incurred by the Contractor as a result of the Contractor's failure to acquire full information about work conditions prior to submitting an offer to perform the work.
C. Substitutions. When a brand name is required by the specifications, all Bidders shall provide the specified product unless another product or products is/are of equal quality, merit and utility (as determined in the Owner’s sole judgment). Substitution requests must be made prior to award. Bidders may be required to provide information to the Owner to determine product acceptability prior to award of Contract. Substitution requests must be submitted by the prime contractor who will be submitting a bid to the Owner. Substitution requests from subcontractors will not be considered.
3.0 Interpretation of Scope of Work Documents
If a Bidder finds discrepancies, errors or omissions from the Scope of Work documents, or has doubt as to their meaning, the Bidder shall at once notify the Owner. The Owner will then investigate the validity of the claim and will determine whether an addendum will be issued (see Protest or Request for Changes of Specifications and/or Bidding Requirements below).
4.0 Protest
A bidder may protest the Notice of Intent to Award, or an adversely affected or aggrieved bidder may submit to the Owner a written protest of the Owner’s Intent to Award within seven days after issuance of the Notice of Intent to Award the Contract, unless a different protest period is provided under the Solicitation Document.
Any bidder wishing to protest this ITB or any provision, specification or contract term herein, must submit such questions, comments or protests in writing and to: The District Office email that is listed as the ITB Contact Info.
The deadline for submitting such protests is the same date as the deadline for questions listed in Table 1 of this
ITB.
The prospective protest must include the following:
A. The rationale that demonstrates how the procurement process is contrary to law or how the solicitation document is unnecessarily restrictive, is legally flawed, etc.
B. Evidence or documentation that supports the rationale on which the protest is based.
C. A statement of the desired changes to the Procurement process or the solicitation document that the prospective firm believes will remedy the condition.
Adversely affected firms who wish to protest the bid rejection as non-responsive or the Intent to Award, may do so providing:
A. The firm is adversely affected because the firm would be eligible to be awarded the contract in the event that the protest was successful.
B. The reason for the protest.
C. All higher-ranked bids are non-responsive.
D. The District has failed to conduct the evaluation of bids in accordance with the criteria or processes described in the RFP.
E. The District has used unreasonable discretion in rejecting the bid as non-responsive.
F. The District’s evaluation of bids or the District’s subsequent determination of award is otherwise in violation of Oregon City School District Public Contracting Rules or Public Contracting Code.
An affected firm may only protest exclusion from a step of competition if the firm is responsible, submitted a responsive bid and, but for the District’s mistake in evaluating the offer, or other offers, the protesting firm would have been eligible to participate in the next step of competition.
A. All protests must be provided in writing and physically received by the Capital Bond Director or designee no later than 5:00 p.m. Pacific Standard Time on the seventh (7th) calendar day after the posted Notice of Intent to Award or postmarked rejection.
Address Protest To: Protest of Award: Request for Bid Number: B15-2026, Attention: David Hobbs, Capital Bond Director
14551 Meyers Rd, Oregon City, OR 97045.
B. Protests must specify the rationale for the protest including the specific citation of law, rule, regulation, or procedure upon which the protest is based. The judgment used in scoring by individual evaluators is not rationale for protest.
C. Protests not filed within the time specified above, or which fail to cite the specific law, rule, regulation, or procedure upon which the protest is based shall be dismissed. An issue that could have been raised by request for clarification or protest of specifications as provided above is not rationale for protest.
5.0 Bidding Requirements
A. Filling in Bid Forms. The bid response shall be made on the form provided in the Invitation to Bid and as prescribed by the Owner. The Bidder may not alter, modify or change the bid form except as directed by bid addendum. Any other form of offer is invalid. Bidders are required to use the form provided within the Invitation to Bid, Section 00 20 00.
Bids may be rejected if they contain any recapitulation or restating of the work to be done, disclaimers, exceptions or other limitations or stipulations.
B. Bids are Offers. The bid is the Bidder's offer to enter into a contract, which, if the bid is accepted for award, binds the Bidder to a contract and the terms and conditions contained in the Invitation to Bid. A Bidder shall not make the bid contingent upon the Owner’s acceptance of specifications or contract terms that conflict with or are in addition to those required in the Bid Documents (except as noted in Time for Bid Acceptance, Section 13 (E) below).
6.0 Proprietary Information/Public Disclosure
Materials submitted in response to this Invitation to Bid and/or the Contract shall become the property of the Owner and are, therefore, subject to public records laws.

A copy labeled “redacted” must be submitted with the transmittal letter must identify the page and the particular exemption(s) from disclosure upon which the claim is made. Each page claimed to be exempt from disclosure must be clearly identified, on the page, by the words: "This data constitutes a trade secret under ORS 192.501(2), and shall not be disclosed except in accordance with the Oregon Public Records Law, ORS 192.
If the Owner receives a request for public records disclosure of the information so designated as confidential by Bidder/Contractor, the Owner will make a reasonable attempt to notify Bidder/Contractor of the request so Bidder/Contractor may claim any exemption Bidder/Contractor is entitled to under applicable laws.
The Oregon Public Records Law exempts from disclosure trade secrets, and the exemption from disclosure applies "unless the public interest requires disclosure in the particular instance," ORS 192.501(2). Therefore, non-disclosure of documents or any portion of a document submitted as part of this solicitation may depend upon official or judicial determinations made pursuant to the Oregon Public Records Law.
In any event, the Owner will, to the fullest extent permitted by Oregon Law, assist the Bidder/Contractor in protecting proprietary information submitted pursuant to this Invitation to Bid."
