About this file
This is a regulatory notification from the New York State Department of Labor (NYSDOL) regarding mandatory contractor registration requirements for public works projects under Article 8 of the Labor Law, issued in coordination with the Office for People With Developmental Disabilities (OPWDD). Effective December 30, 2024, all contractors and subcontractors bidding on Article 8 public works projects must be registered with NYSDOL prior to bid submission and before commencing work. For projects with bid deadlines prior to December 30, 2024, but with work commencing after that date, contractors must complete registration before beginning work. Bidders are required to provide their NYSDOL registration number in the designated space on the bid form at the time of submission; failure to provide a valid and verifiable registration number will result in bid disqualification. Subcontractors are not permitted without written OPWDD approval.
The registration process is currently open and available through the NYSDOL website. The NYSDOL estimates that the application review and Certificate of Registration issuance may require approximately 34 weeks, making prompt action essential to avoid disruptions to the bidding process or project schedule. Contractors requiring additional information should consult the NYSDOL Contractor and Subcontractor Landing page or the Frequently Asked Questions section on the NYSDOL website. For specific inquiries regarding the Contractor Registry process, contractors may contact the Bureau of Public Work and Prevailing Wage at 518-457-5589 or labor.sm.pwask@labor.ny.gov.
