About this file

This is a Non-Disclosure Agreement (NDA) template for the USS OSCAR AUSTIN (DDG-79) FY26 MDVR contract opportunity (Solicitation #N6817126QN046). The agreement establishes terms for contractors and their subcontractors to receive and handle restricted technical data provided by the Government for proposal development purposes only. Recipients are permitted to use, modify, and disclose the data solely to qualified subcontractors, suppliers, and prospective bidders who require it to submit offers, subject to Contracting Officer approval. All recipients must implement physical security measures to protect the restricted data from unauthorized disclosure and must afford the data the same level of security provided by the Department of Defense.

The agreement requires recipients to accept the data "as is" with no Government warranty and mandates indemnification of the Government against claims arising from data misuse or unauthorized disclosure. Successful contract awardees may continue using the data under DFARS 252.227-7025 provisions, while unsuccessful offerors must destroy all copies of the documentation within 30 days of non-selection and provide written destruction certification to the Contracting Officer. Non-U.S. companies must submit to U.S. laws, regulations, and jurisdiction. Recipients certify they are not debarred, suspended, or ineligible for Government contracts and have not violated U.S. export control laws. The NDA remains effective from execution through notification of non-selection, with obligations surviving termination.
