About this file

This is a Non-Competitive Oversight Committee Justification Form for Pinellas County Utilities, seeking a sole source agreement with Premier Magnesia for THIOGUARD magnesium hydroxide slurry. The proposed contract is a 3-year engagement with a total budget estimate of $4.3 million, covering the purchase and maintenance of magnesium hydroxide and related equipment for wastewater treatment across 19 county locations. The project aims to utilize Premier Magnesia's proprietary, patented technology for odor control, FOG reduction, and corrosion protection in the county's wastewater collection system.

The justification for the non-competitive purchase centers on Premier Magnesia's proven track record, with a previous 5-year contract totaling $7.7 million set to expire on October 19, 2025. The vendor's THIOGUARD product offers 98.5% Mg(OH)2 purity, superior stability, and low dosage rates, providing cost savings and operational efficiency. The MgBalance program is expected to enhance nutrient recovery and biosolids dewatering without requiring infrastructure changes. The Non-Competitive Oversight Committee members have reviewed and approved the sole source agreement, recognizing that discontinuing Premier Magnesia's services could risk force main collapses and generate countywide odor complaints, potentially compromising system reliability.

Total Budget Estimate: $4.3M [~$1,433,333.33/year]

Duration of engagement: 3-Year Contract

Project Manager: Gunner Mitchell

Requisitioning Department: Utilities

Justification for non-compete purchase:

Pinellas County Utilities seeks to enter a sole source agreement with Premier Magnesia for THIOGUARD® magnesium hydroxide slurry. Premier Magnesia’s proprietary, patented technology (U.S. Patents: 11,964,889; 9,845,258; 10,160,674; 10,280,100; 10,287,198) ensures high product quality, with 98.5% Mg(OH)₂ purity, 12-20 m²/g specific surface area, and superior stability, delivering effective odor control, FOG reduction, and corrosion protection. Their product meets stringent specifications (Attachment A), ensuring consistent performance across 19 county locations for the past five years. THIOGUARD®’s chemical robustness and low dosage rates provide cost savings and operational efficiency. The MgBalance™ program enhances nutrient recovery and biosolids dewatering, reducing costs without infrastructure changes. Premier’s reliable technical support and USA-based production ensure seamless operations. This sole source agreement maintains continuity, leveraging Premier’s proven expertise and tailored solutions for our wastewater treatment needs.

Was this vendor utilized on prior contracts? Please explain background:

Premier Magnesia was utilized under contract 190-0480-B, a 5-year agreement totaling $7.7M, set to expire on October 19, 2025. Pinellas County has successfully used THIOGUARD® as a corrosion and odor control chemical in our wastewater collection system, achieving consistent results across 19 locations throughout both north and south county. The vendor’s field staff have maintained a strong working relationship, providing reliable services and technical support. Premier has kept pricing relatively stable compared to other chemical costs, ensuring cost-effectiveness. Discontinuing their services without a ready alternative could risk force main collapses and generate odor complaints countywide, jeopardizing system reliability.
