About this file

This document is a letter from the U.S. Coast Guard's Division of Boating Safety addressing Boating Law Administrators regarding modifications to the Department of Homeland Security Standard Terms and Conditions, version 3 (dated April 18, 2025). The letter explains that due to a court injunction in the case of Illinois, et al. v. FEMA, et al., two specific paragraphs related to communication with DHS/Immigration officials and anti-discrimination grant award certification have been suspended for this funding opportunity.

The communication is from Pavlo Oborski, Grants Management Branch Chief (BSX-22), who provides contact information (571-607-5426, Pavlo.Oborski@uscg.mil) and indicates that recipients will be notified of any future changes to the DHS Standard Terms and Conditions. The letter serves as a follow-up to a previous email sent on October 17, 2025, and provides clarity for states seeking guidance on the current grant funding terms.

Text version

Attention Boating Law Administrators, This is a follow up to the e-mail I sent on Friday, October 17, 2025.

Some states have asked questions concerning the application of the current Department of Homeland Security Standard Terms and Conditions, v. 3 (Apr. 18, 2025), given the injunction entered by the Court in Illinois, et al. v. FEMA, et al. Consistent with the injunction, Paragraph C.IX (Communication and Cooperation with the Department of Homeland Security and Immigration Officials) and paragraph C.XVII(2)(a)(iii) (Anti-Discrimination Grant Award Certification regarding immigration) of the Standard Terms and Conditions do not apply to any federal award under this funding opportunity.

If there are any changes in the Department of Homeland Security Standard Terms and Conditions, you will be notified.

If you have any questions, please do not hesitate to contact me directly.

Sincerely.

Pavlo Oborski USCG/Division of Boating Safety Grants Management Branch Chief (BSX-22) 571-607-5426 Pavlo.Oborski@uscg.mil
