.No. Reference Questions Answers
1 General
With reference to RFP titled 'Environmental Health Perspectives
(EHP) Language Translation Scientific Services', could you please let us know whether an organization from India is eligible to participate in this event.
Reference Attachment I – Statement Of Work, Section 12.0 for information on the Place of Performance.
The Federal Acquisition Regulation (FAR) does not explicitly prohibit awarding a contract to a foreign entity for services. However, there are restrictions through the Buy American Act, implemented by FAR 25, that restricts the procurement of foreign-origin supplies and materials. There are also restrictions through various trade agreements that the US has entered into with foreign countries that could have an impact on a contract. Additionally, there are restrictions imposed by the US on foreign countries that might present a national security concern. When award a contract to a foreign entity, a Contracting Officer might have to exercise due diligence to determine whether a foreign entity is eligible for award. Additional information can be located at FAR 25 “Foreign Acquisition”, in particular, please review FAR 25.801 and FAR 25.802 for further guidance:
FAR 25.801 General.
Treaties and agreements between the United States and foreign governments affect the evaluation of offers from foreign entities and the performance of contracts in foreign countries.
FAR 25.802 Procedures.
(a) When placing contracts with contractors located outside the United States, for performance outside the United States, contracting officers must—
(1) Determine the existence and applicability of any international agreements and ensure compliance with these agreements;
and
(2) Conduct the necessary advance acquisition planning and coordination between the appropriate U.S. executive agencies and foreign interests as required by these agreements.
(b) The Department of State publishes many international agreements in the “United States Treaties and Other International
Agreements” series. Copies of this publication normally are available in overseas legal offices and U.S. diplomatic missions.
In addition to this, treaties and agreements between the United States and foreign governments affect the evaluation of offers from foreign entities and the performance of contracts in foreign countries. It depends on the foreign “organization” and/or company.

Question regarding the test translation project:
• The word “Focus” at the beginning of the article, could you confirm it is a section of the scientific journal?
Would the NIEHS be able to answer this last question before our team begins the test translation project and we submit our bid?
The word “Focus” at the beginning of the article is a section of the scientific journal. Just specific to the word “focus”, it also appears in the same article provided by the National Center for Biotechnology Information, U.S. National Library of Medicine at https://www.ncbi.nlm.nih.gov/pmc/articles/PMC6108581/ https://www.ncbi.nlm.nih.gov/pmc/articles/PMC6108581/
