CONTRACTOR-BADGE REGULATIONS

(1) Contractor-badges. The NGA, thorough the Office of Protection Services (AOP), issues non-employee identification badges (“Contractor-badges”) for reasons relating to the promotion of safety and security. Contractor-badges include a color photograph of the individual, his or her full name, and a designation to indicate that the individual is a Contractor.

(2) Responsibilities. It is the responsibility of the Contractor to maintain accountability of

Contractor-badges issued to its employees, subcontractors and others under the control of the

Contractor and to ensure that all such individuals (collectively, “Badge Holders”) comply with these provisions. Where a Non-employee Badge is issued, the Badge Holder is required to display the badge to identify themselves and their association with the NGA at all times while on the NGA grounds and premises. When not on the NGA grounds and premises, the Badge Holder must take all reasonable precautions, and such other actions as may be directed by the NGA, or in the absence of such direction, in accordance with sound business practice, to safeguard and protect the badge.

(3) Loss. Badge Holders must report the loss or theft of a Non-employee Badge to the COR as soon as possible and in any event no later than one (1) hour of discovery. Badge Holders must file an incident report with AOP within three (3) business days of the discovery and in any event before a replacement may be issued.

(4) Return. Contractor-badges remain the property of the NGA. The Contractor must retrieve and return Contractor-badges to the COR immediately, if directed to do so by the COR, or within three (3) business days of when: the Contract expires or is terminated; the work under the

Contract is completed; the badge expires; the badge holder ceases to perform services for which the badge was issued, no longer requires access to the NGA grounds or premises, resigns, retires, is terminated, laid-off, on strike, or is on medical or maternity leave.

(5) In cases when a Non-employee Badge is not or cannot be retrieved from the individual at the time of separation, the COR must be notified, by telephone or in person within eight (8) hours. If termination of an individual by the Contractor is for cause, and the Contractor does not have the

Non-employee Badge, notification must be made immediately. In these cases, written notice indicating what steps the Contractor has taken to retrieve the badge from the individual must be provided to the COR within 3 business days of the separation.

(6) Fees. A late fee of $10.00 per business day will be charged for each badge that is not properly returned within the timeframes specified herein. A $200 failure to return fee will be charged in lieu of the late fee, when the Contractor cannot retrieve and return a Non-employee Badge due to loss, theft or for any other reason.

(7) Offset. A set off will be made against the contractual agreement into which this clause is incorporated and/or unrelated contractual agreements as means to collect the moneys due under this clause, unless the NGA requires payment by check, cash or electronic deposit. The NGA reserves the right to withhold final payment due to the Contractor under the contractual agreement into which this clause is incorporated and/or unrelated contractual agreements until the

Contractor’s obligations under this clause are satisfied.
