About this file

This is a performance and payment bond template document prepared for the Sacramento Housing Authority Repositioning Program, Inc. (SHARP) and The Sharp Investment LLC for construction contracts in California. The document establishes the bonding requirements for a fire damage rehabilitation project involving a single-story triplex located at 6161, 6143, and 6145 Terrell Drive in Citrus Heights, California. The project solicits competitive, lump-sum bids from licensed Class B General Building Contractors through Invitation for Bid SHARP IFB-2026-089-PS. Interested contractors are required to attend at least one of two pre-bid meetings that include mandatory site inspections to verify existing conditions. Bids must be submitted via OpenGov no later than 2:00 p.m. on Tuesday, November 10, 2026. The project contemplates subcontracting work across multiple trades including electrical, plumbing, roofing, HVAC, drywall, painting, concrete, landscaping, and flooring. The successful bidder must furnish performance and payment bonds for the duration of the contract, with the performance bond remaining in effect for one year after work completion to cover defects in workmanship or materials.

For bids exceeding $300,000, bidders must provide a bid bond equal to not less than 5 percent of the total bid price. The successful bidder is required to furnish performance and payment bonds in amounts not less than 100 percent of the contract price. The performance bond template specifies that the surety shall either complete the contract or obtain competitive bids for completion and arrange payment for any costs exceeding the remaining contract balance. The payment bond protects all claimants, including subcontractors and material suppliers, with a claimant claim window of 90 days after final labor or material provision and an overall claim period not to exceed one year. The bonds are issued pursuant to California Civil Code Sections 9550-9566 and waive certain statutory provisions under Sections 2819 and 2845, ensuring surety obligations remain unaffected by contract modifications or time extensions. All general and contractual questions should be directed to Monica Albert, Buyer—Procurement Services, at msalbert@shra.org, with technical questions submitted via OpenGov.

WHEREAS, Contractor and Surety are held and firmly bound unto the Owner, as Obligee, in the penal sum of ____________________________________ Dollars ($_____________), for the payment whereof Contractor and Surety bind themselves, their heirs, executors, administrators, successors, and assigns, jointly and severally, firmly by these presents.

The term “balance of the Contract price” shall mean the total amount payable by Owner to Contractor under the Contract and any amendments thereto, less the amount properly paid by Owner to Contractor.

No right of action shall accrue on this bond to or for the use of any person or corporation other than the Obligee named herein or its successors and permitted assigns.

As a condition precedent to final completion, this obligation shall remain in full force and effect for a period of one (1) year after completion and acceptance of the Work, during which time the Surety shall be responsible for defects in workmanship or materials as required under the Contract.
