About this file
This document is an Express Form NDAA Certification for Micro-purchases dated September 15, 2020, implementing requirements from the John S. McCain National Defense Authorization Act (NDAA) for Fiscal Year 2019. The form requires vendors to make representations regarding covered telecommunications equipment and services for procurement actions under the micro-purchase threshold. Vendors must disclose whether they provide or use telecommunications equipment from specified manufacturers, with detailed reporting requirements including the percentage of communications platform technology from these manufacturers, a description of equipment used, and willingness to provide a plan to remove such equipment by 2022.
The form includes specific FAR provisions (52.204-24, 52.204-26, and 52.204-25) that mandate vendors review the System for Award Management (SAM) for excluded parties and represent their use of covered telecommunications equipment. If a vendor indicates they do provide or use such equipment, they must complete additional detailed questions about their telecommunications infrastructure. The certification must be signed by an authorized representative of the vendor and returned to the Contract Specialist or Contracting Officer, serving as a compliance mechanism to prevent potential security risks in federal procurement.
