About this file
This document is an Acquisition Alert for Executive Order 14173, which revokes previous diversity, equity, and inclusion (DEI) policies in federal contracting. The executive order requires all government contractors to certify that they:
- Comply with all federal anti-discrimination laws, and 2) Do not operate any DEI programs that could potentially violate anti-discrimination statutes. Contractors must sign a certification acknowledging these requirements, with the understanding that the certification is material to government payment decisions and subject to the False Claims Act. The document specifically rescinds previous Executive Order 11246, which had mandated non-discrimination and affirmative action requirements for government contractors and subcontractors.
